Can You Legally Decompile a Game You Own? A U.S. Practical FAQ

Owning a game copy does not automatically make decompilation lawful. U.S. law treats copyright infringement and DMCA anti-circumvention separately, with narrow exceptions for interoperability and certain discontinued-server restoration.

Not automatically. In the United States, owning a copy of a game does not by itself give you permission to decompile it, bypass an access control, modify it, or share altered files. The answer depends on what you do, why you do it, whether you circumvent a technological measure, and whether a specific exception applies. This is general information about U.S. federal law, not a determination about a particular game or activity; it does not establish the law in other countries.

What does “decompile a game” mean legally?

People use “decompile” to describe different activities: inspecting a program’s object code, making intermediate copies, bypassing an authentication check, changing game files, or distributing a patch or modified game. Those acts can raise different legal questions. The label alone does not determine whether an activity is lawful.

Start by identifying the actual steps you plan to take. In particular, distinguish analyzing code from circumventing a technological measure that controls access, and distinguish private experimentation from sharing code, assets, modified files, or circumvention tools.

Why does owning a copy not settle the question?

Copyright in a game and ownership of a copy are not the same thing. The U.S. Copyright Office explains that section 1201 of the Digital Millennium Copyright Act (DMCA) generally prohibits circumventing technological measures used to prevent unauthorized access to copyrighted works, including video games and software. It states: “The Digital Millennium Copyright Act (DMCA), codified in part in Title 17, section 1201, of the United States Code, generally makes it unlawful to circumvent technological measures used to prevent unauthorized access to copyrighted works, including copyrighted books, movies, videos, video games, and computer software.” — U.S. Copyright Office, Ninth Triennial Section 1201 Proceeding, 2024 cycle.

That anti-circumvention question is separate from whether copying or modifying material infringes copyright. A use might raise one issue, both, or neither; resolving one does not automatically resolve the other. Section 1201 exceptions are limited to the conduct and conditions they cover.

When can reverse engineering qualify for the interoperability exception?

17 U.S.C. § 1201(f) provides a narrow exception related to interoperability. It is not a general right to reverse engineer any game you bought. The provision applies only when its conditions are met:

  • You lawfully obtained the right to use a copy of the program.
  • You circumvent an access-control measure solely to identify and analyze elements of the program necessary to achieve interoperability.
  • The intended interoperability is with an independently created program.
  • The elements needed for interoperability were not previously readily available to you.
  • The acts do not constitute copyright infringement.

The purpose matters: “I want to make a mod” does not, on its own, establish that the work is solely for interoperability with an independently created program. Nor does satisfying one condition excuse conduct outside the exception. The Copyright Office discusses reverse engineering and interoperability within the broader section 1201 framework.

Can you restore a game after its authentication server shuts down?

A current U.S. regulation creates a limited exemption for certain complete games when the provider has ceased providing access to an external server required for authentication. Under 37 C.F.R. § 201.40, circumvention is permitted only for the specified purposes and subject to the rule’s conditions.

Personal local gameplay

The exemption covers copying and modifying the program to restore the game for personal gameplay on a local computer or console. It does not create a general right to decompile any game, restore any online service, or operate a replacement public server.

Institutional preservation

A qualifying library, archives, or museum may circumvent to preserve the game in playable form under the regulation’s conditions. Those include limits on making the preserved game available beyond the institution’s physical premises. An individual owner should not assume that an institution’s preservation provision applies to them.

This is a defined restoration and preservation exemption, not blanket permission to distribute the game, its assets, or modified files. The fact that a server has shut down does not by itself establish that every proposed workaround falls within the rule.

Does a security-research exemption make all testing safe?

No. The current regulation includes a class for good-faith security research, but it expressly cautions that qualifying research may still create liability under other applicable laws. A DMCA exemption addresses only the provision and activity it covers; it does not settle every copyright, contract, computer-access, privacy, or other legal question.

How should you assess a proposed project?

Before acting, write down the specific conduct rather than relying on the broad word “decompile.” These questions identify the issues that matter:

  1. Which country’s law governs? The rules described here are U.S. federal law; the result elsewhere is not established here.
  2. What exactly will you do? Separate inspection, copying, bypassing authentication, modifying files, and sharing files or tools.
  3. Will you circumvent an access control? If so, identify the specific statutory or current regulatory exception that could cover that precise act.
  4. What is the purpose? Interoperability with an independently created program, personal local restoration after a server shutdown, security research, and other purposes are not interchangeable.
  5. Does every condition of the claimed exception fit? Check the law or regulation itself; owning a copy is not a substitute for its requirements.
  6. What do the game’s terms say? Review the applicable license and terms. Their effect depends on the particular agreement and is not resolved by the general rules above.
  7. Will anything be distributed? Do not assume that permission for a limited act of circumvention also permits sharing code, assets, modified files, patches, or tools.

The Copyright Office’s 2024 ninth triennial proceeding concluded with a final rule and recommendation. Its tenth proceeding for the 2027 cycle is underway; the Office states that petitions for renewal and new exemptions were due August 24, 2026, and that renewed exemptions are expected to remain in force for October 2027 through October 2030. Those expected dates concern the rulemaking process, not a guarantee that any proposed exemption will be adopted. The current text of 37 C.F.R. § 201.40 remains the relevant regulation for existing exemptions.
