Yes. Bail may be available after a Customs or GST arrest in India, but release is not automatic: the route depends on whether arrest has happened, the exact offence alleged, its classification and the case facts. The Supreme Court has also held that anticipatory bail is maintainable under both laws when a person has a real and reasonable apprehension of arrest.

Which kind of bail applies to your situation?

Arrest is feared but has not happened Apply for anticipatory bail In Radhika Agarwal v Union of India (2025 INSC 272), the Supreme Court recognized that anticipatory bail is maintainable under the Customs and GST laws when the applicant shows a real and reasonable apprehension of arrest. The Court decides whether to grant relief; an investigation alone does not guarantee it.
The person has been arrested Seek the applicable post-arrest bail remedy The route depends on the offence charged, whether it is bailable or non-bailable, and the procedural stage. Arrest does not itself entitle a person to release.
The person has received a summons Assess the facts; a summons is not an arrest A summons to attend an investigation does not by itself mean the person has been arrested or that arrest is certain. Anticipatory bail is not categorically barred merely because the matter involves GST or Customs; the applicant still needs a real and reasonable apprehension.

Can you seek anticipatory bail in a Customs or GST case?

Yes. The Supreme Court’s 27 February 2025 decision in Radhika Agarwal v Union of India recognizes anticipatory bail under both regimes where the apprehension of arrest is real and reasonable. That addresses whether a court can consider such an application; it does not decide whether a particular applicant will succeed.

Earlier restrictive observations in State of Gujarat v Choodamani Parmeshwaran Iyer and Bharat Bhushan v DGGI should not be treated as a binding rule that anticipatory bail is unavailable in these cases. The Gujarat High Court’s Supreme Court Chronicle describes the 2025 ruling as displacing that restrictive ratio.

What changes after an arrest?

Once a person has been arrested, the immediate question is not simply whether the case is called a GST or Customs case. Counsel needs to identify the precise statutory offence alleged and check its current classification and the applicable post-arrest procedure. The Customs Act, 1962, section 104, and the CGST Act, 2017, sections 69 and 132, are central provisions, but they do not make every offence or case alike.

For a person in custody, the first production and remand status also matter to the next procedural step. A lawyer should promptly examine the arrest documents and grounds, the provision relied on, and the court record. There is no single answer or monetary threshold that makes all Customs or GST cases bailable.

What arrest safeguards should you check?

In Radhika Agarwal, the Supreme Court upheld the challenged arrest powers while explaining that they must be exercised within statutory and constitutional safeguards. These include material supporting the officer’s reasons to believe, recording those reasons, and informing the arrested person of the grounds of arrest.

For Customs matters, section 104 is the arrest provision and applies to covered offences when an empowered officer has reason to believe the person committed one. IndiaCode’s section text was current as of 1 October 2026; the specific allegation and current statutory wording should be checked in an actual case. For GST, section 69 concerns arrest authority and procedure, while section 132 sets out offences and classifications. The GST Council lists CBIC Instruction No. 02/2022-23-[GST-INV], dated 17 August 2022, as guidelines for arrest and bail.

What is the reported 2026 development for CGST arrests?

In its 12 August 2026 report on Union of India v Sunil Biyani, LiveLaw says the Supreme Court required a CGST section 69 order recording the Commissioner’s reasons to believe to be communicated to the proposed arrestee before arrest. The report says communication may be electronic and gives the person an opportunity to seek pre-arrest bail. This is a reported account of the ruling; its precise scope should be checked against the full judgment before relying on it in an individual case.

Quick Recap

What should you do if arrest is feared or has happened?

  1. If arrest is feared: Ask an India-qualified criminal or tax lawyer to assess whether the facts support a real and reasonable apprehension and whether to apply for anticipatory bail. For a CGST section 69 matter, have counsel check the relevant order and the full Sunil Biyani judgment.
  2. If arrested: Have counsel identify the exact provision and alleged offence, verify its bailability under the current law, review the stated grounds and supporting record, and establish the first-production and remand status.
  3. If summoned: Treat the summons as investigative process, not proof of arrest. Get advice based on its contents and the surrounding facts; neither the summons alone nor the tax-law label settles whether anticipatory bail is appropriate.
