Sometimes—but there is no single U.S. rule that makes every school audio recording legal or illegal. The answer depends on state recording law, who is recording, whether the conversation is private, the recording’s purpose, school policy, and what happens to the file afterward. FERPA may govern a school’s handling of a student-related recording, but it is not a general permission to record or a blanket recording ban.
What determines whether a school recording is allowed?
Several separate questions matter. A school’s authority to make a recording under state law is not the same as its obligations when it stores or shares a recording. Nor does a school rule necessarily settle whether a recording complies with state law.

- Where is the school? State recording and privacy laws differ. The examples below from Florida, Texas, and Washington do not establish the rule in other states.
- Who is recording? A school employee recording instruction, a student recording a conversation they join, and a parent leaving a device to capture conversations among other people raise different issues.
- What is being recorded? A classroom lesson, a private meeting in an office, and general surveillance may be treated differently. In Washington, for example, the statute concerns private communications.
- Why is it being recorded? Some state provisions are limited to recordings for regular classroom instruction; they should not be assumed to cover surveillance, documenting a meeting, or another purpose.
- What will the school do with the file? Notice, consent, access, retention, and sharing may be governed by school policy and privacy law, independently of whether making the recording was permitted.
What FERPA does—and does not—decide
The Family Educational Rights and Privacy Act (FERPA) applies to educational agencies and institutions that receive funds from programs administered by the U.S. Department of Education. Public schools, districts, and postsecondary institutions are included; private and parochial elementary and secondary schools generally are not subject to FERPA because they generally do not receive those funds. Other state privacy and recording laws can still apply.

When might a recording be an education record?
Its status depends on its content and context, whether it is directly related to a student, and whether the school or someone acting for it maintains it. Department of Education guidance on photos and videos gives examples in which a recording may be directly related to a student: surveillance footage used in a disciplinary decision about students fighting, or a classroom video in which a student’s seizure becomes the focus. Those examples concern visual recordings; an audio-only file should be assessed on its own content and context rather than automatically treated the same way.
Records created and maintained by a school law-enforcement unit for a law-enforcement purpose are excluded from FERPA’s definition of education records. A copy later maintained by another school component may qualify as an education record if it is directly related to a student and maintained by the school or on its behalf.

What happens if FERPA applies?
FERPA’s access and disclosure rules may apply if the recording is an education record. As a general rule, a school needs written consent to disclose personally identifiable information from an education record, subject to specified exceptions. One exception can cover certain school officials under conditions that limit their direct control and use of the information. FERPA also distinguishes information obtained from an education record from information a school official learned through personal observation; that distinction does not decide whether the recording itself was lawful to make.

These are examples, not a nationwide survey. Check the current law in the state where the recording occurs; do not transfer an exception or consent rule from one state to another.

How common recording situations should be assessed
A school records a lesson
First check the state statute and district policy. Florida and Texas have provisions concerning recordings for regular classroom instruction, but their wording and scope differ. Do not assume that an instructional exception covers recording for another purpose, or that it applies to every employee, contractor, classroom, or student.
A parent wants to leave a recorder at school
This is not necessarily equivalent to a parent recording a conversation they participate in: the device may capture conversations among other people. Check state law, school policy, and any consent or privacy requirements before placing a device in a classroom or office. If the school later maintains the file and it is directly related to a student, FERPA handling rules may also become relevant.

A student or parent records a meeting they attend
Do not assume that being a participant automatically makes recording lawful in every state or setting. Check the applicable consent law and the school’s rules. If the file is later given to or maintained by the school, its status and subsequent disclosure are separate questions from the recorder’s authority to make it.
A school installs a microphone for surveillance
Surveillance is not automatically covered by a rule limited to regular classroom instruction. Consider state recording law, whether conversations are private, who has access to the system, how long audio is retained, and whether the school uses a recording in a student-specific decision. If maintained and directly related to a student, the file may be subject to FERPA.

What to check before recording or sharing audio
- Identify the jurisdiction. Find the state law that applies to the place where the recording will be made. A state-specific answer may also depend on the district or institution.
- Identify the recorder and participants. Determine whether the recorder is a participant or is capturing other people’s conversation, and whether a school employee, contractor, student, or parent is involved.
- Define the setting and purpose. Distinguish regular instruction from a private office conversation, surveillance, or documentation of a meeting.
- Read the current statute and written school policy. Check for consent, notice, recording, access, retention, and sharing requirements.
- Ask how the school will handle a student-related file. If the school will maintain it or use it in a decision about a student, ask whether it is treated as an education record and how access and disclosure are managed.
- Review sharing separately. Permission to make a recording does not automatically authorize publishing or distributing it. Check applicable privacy and disclosure rules before sharing.
