The more precise term for the networks involved is the darknet. It is not synonymous with crime, but anonymity is not guaranteed, and official U.S. cases show that hidden marketplaces and their users can be investigated.
What the dark web is—and what it is not
The FBI describes the darknet as a subset of the deep web that requires unique software, configuration, or authorization to access. The deep web is broader: it includes ordinary pages that search engines do not index, as well as content available only after signing in. A private account page is not automatically part of the darknet. FBI background on the darknet.

Darknet technology can support legitimate privacy and access needs. At the same time, the FBI and the U.S. Department of Justice have described illicit marketplaces offering drugs, weapons, stolen or counterfeit goods, fraudulent identification, hacking services, and money-laundering services. The technology and the criminal activity are not the same thing.

Why an illicit-market purchase is a serious risk
There is no dependable anonymity guarantee
Using a hidden service does not establish that a buyer cannot be identified. The FBI describes investigations involving people suspected of buying illicit items, while the Justice Department has announced marketplace seizures and prosecutions. These cases demonstrate that enforcement occurs; they do not establish an individual buyer’s odds of detection.

For scale, DOJ said in 2022 that Hydra accounted for an estimated 80% of darknet-market cryptocurrency transactions in 2021 and had received approximately $5.2 billion in cryptocurrency since 2015. Both figures concern Hydra and the periods specified, not the current market as a whole. DOJ announced Hydra’s seizure in 2022. DOJ announcement on Hydra.
Payment may be difficult or impossible to recover
The FBI’s Internet Crime Complaint Center (IC3) warns that cryptocurrency transactions cannot be reversed and are permanently recorded on public blockchains. A payment sent to a fraudulent seller may therefore be difficult to recover, and public transaction records can also assist investigations. IC3 advises scam victims to submit a complaint and preserve transaction information. IC3 guidance on cryptocurrency.
A product may be counterfeit or dangerous
In a specific case described by the U.S. Attorney’s Office for the Southern District of New York in May 2024, undercover agents bought tablets represented as oxycodone on Incognito Market; testing found fentanyl pills. DOJ said the case involved more than $100 million in alleged narcotics sales from October 2020 through the market’s closure in March 2024. Those details describe that criminal case, not a prevalence estimate for all listings or markets. DOJ’s Incognito Market case announcement.

Beyond health dangers, an illicit listing may be fraudulent, counterfeit, stolen, or not delivered. A marketplace’s appearance or a seller’s claims cannot reliably establish a product’s legality, contents, or safety. No purchase method can remove these risks.

What enforcement cases tell you—and what they do not
Official cases show that darknet marketplaces can be seized and people connected to them investigated or prosecuted. They do not prove that every user will be identified, nor do they provide a reliable current estimate of market size or an individual’s risk. Deputy Attorney General Lisa O. Monaco said after the Hydra seizure: “The Department of Justice will not allow darknet markets and cryptocurrency to be a safe haven for money laundering and the sale of hacking tools and services.”
In the Incognito Market announcement, U.S. Attorney Damian Williams said: “The so-called ‘dark web’ is not a safe haven for those who seek to break the law.” Such statements reflect enforcement priorities; a person’s legal exposure depends on the conduct, item, and applicable jurisdiction.

Legal rules depend on where you are and what you do
The official sources cited here describe U.S. federal investigations and cases. They do not establish a universal rule about accessing a darknet, or whether a particular purchase is legal in every country or state. Laws can depend on the item and the conduct involved. For advice about your circumstances, consult official guidance for your jurisdiction or a qualified legal professional.
