Build Privacy Into Your App: 10 Principles for Developers

Privacy by design turns data minimization, restrained defaults, limited access, clear purposes, and ongoing review into engineering decisions made throughout a product’s life cycle.

Privacy by design means building safeguards into a product’s systems, settings, and development process from the start—not relying on a policy document or reacting only after a breach. For developers, it means deciding what data an app needs, who can access it, how long it stays, and how people can understand and manage its use.

“Privacy by design” and “data protection by design and by default” are closely related ideas. GDPR Article 25 sets a legal requirement for organizations and processing within its scope; the NIST Privacy Framework is a voluntary tool for managing privacy risk. The ten practices below are a developer-focused synthesis of official guidance, not an official regulator-issued list.

What does privacy by design mean for developers?

It means treating privacy as an engineering concern throughout a product’s life cycle. Data flows, defaults, access controls, retention logic, user-facing explanations, and review processes all affect privacy. A safeguard added during initial architecture or feature design can shape the system; a policy written after implementation cannot substitute for that work.

The European Commission says organizations should implement technical and organizational measures “at the earliest stages of the design of the processing operations” so privacy and data protection principles are safeguarded from the start. That guidance is about organizations’ obligations, not a claim that every developer everywhere is automatically subject to the GDPR.

Privacy is also broader than cybersecurity. Security helps prevent unauthorized access and other incidents, but people can face privacy risks from processing that works exactly as designed. For example, a system may expose information to a larger audience than a person expects without suffering a technical breach. NIST’s framework addresses risks people may experience from system, product, or service operations, including risks not caused by a cybersecurity incident.

How do the GDPR and NIST frameworks differ?

GDPR Article 25 and EDPB Guidelines 4/2019 EU legal context and regulator guidance on data protection by design and by default. The EDPB identifies the final Guidelines 4/2019 version as dated 20 October 2020. Help the organization understand obligations that may apply and use regulator guidance to inform design decisions. Whether the law applies depends on the organization and processing; this is not legal advice.
NIST Privacy Framework Voluntary, risk- and outcome-based framework. NIST describes it as broadly usable and technology-, sector-, and jurisdiction-agnostic. Structure privacy-risk discussions and choose activities suited to the organization’s context. The framework does not replace applicable law.

The European Commission’s overview of data protection by design and default is available at its data protection by design and default page. The EDPB’s final Guidelines 4/2019 are listed on the EDPB’s Article 25 guidelines page. NIST describes the framework as voluntary in its Privacy Framework overview and explains its risk-management approach in the framework description.

1. Anticipate privacy risks

During discovery and design, map how the product operates on data and ask how those operations could affect people. Consider not only unauthorized access, but also unexpected exposure, inferences, unwanted contact, or loss of control. Revisit assumptions when features, users, or contexts change. NIST frames privacy in terms of risks people may experience from system, product, or service operations.

2. Make privacy the default

Start with settings that expose or process the least personal data compatible with the intended function. A social profile, for example, should not be available to an indefinite audience by default. People can choose broader sharing where it is appropriate; the product should not quietly make that choice for them.

3. Build privacy requirements in early

Include privacy requirements in architecture, design reviews, and development work before implementation choices become difficult to change. The European Commission specifically describes taking technical and organizational measures at the earliest stages of processing design.

4. Minimize collection and processing

Request and process only the data needed for a defined product purpose. Avoid adding fields because they might be useful someday. Each additional data element creates work: it must be protected, access-controlled, explained, and eventually deleted or anonymized as appropriate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Tie each data use to a clear purpose

Record why each category of personal data is needed, and assess later uses against that purpose before adding them. This is a practical way to operationalize purpose and necessity guidance; it is not a complete account of every legal basis or obligation that may apply.

6. Set a retention limit

Define when data should be deleted or anonymized, then implement that rule in storage and job logic rather than leaving it as a policy aspiration. The European Commission gives keeping data for the shortest possible time as an example of protection by default.

  • Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft

7. Restrict access

Use need-to-know access, role controls, and suitable separation between users and internal services. Limit routine access to the people and services that need it. The Commission’s examples include restricting access to a small number of people on a need-to-know basis.

8. Protect data throughout its life cycle

Choose technical and organizational protections suited to the system and its threat model. The Commission names encryption and pseudonymization as design examples. Pseudonymization replaces identifying material with artificial identifiers; encryption encodes messages so only authorized people can read them. Neither control alone proves compliance or removes the need to assess the rest of the design.

9. Make practices visible and usable

Explain relevant processing in understandable terms, and provide workable controls for people. A notice that users cannot understand or a control that is difficult to find does little to support meaningful choice. The EDPB connects design and defaults with respecting individuals’ rights; foundational privacy-by-design principles also emphasize visibility, transparency, and user-centricity.

10. Review and improve continuously

Reassess privacy assumptions and safeguards during operation and after material changes to the product or its context. The EDPB describes data protection by design and default as a continuous process requiring regular checks. A one-time design review cannot account for every later feature, dependency, or use.

How can a development team put the principles into practice?

For each data element, maintain a concise record that connects the engineering decision to its purpose and ownership. This makes it easier to review whether the product still needs the data and whether controls match actual use.

  • Purpose: why the product needs the data.
  • Access: which users, roles, and services can reach it, and under what conditions.
  • Retention: when it is deleted or anonymized and what system logic enforces that limit.
  • Explanation: how the relevant processing is communicated to people.
  • Review owner: who checks the decision and when it should be revisited.

Then ask two different questions: what could go wrong if someone gains unauthorized access, and how could a person be affected if the system behaves as designed? The second question catches privacy risks that incident-focused security reviews can miss. NIST’s framework overview describes privacy risk as arising from product and service operations, not only security events.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Useful concrete checks include trying the product’s default settings as a new user, verifying that retention jobs actually remove or anonymize records, and confirming that access rules match the intended roles. These are implementation checks, not a guarantee of legal compliance; applicable obligations depend on the organization, processing, and jurisdiction.

What should developers remember?

  • Put privacy decisions into design and development, not only documentation or breach response.
  • Set restrained defaults for collection, retention, and access.
  • Treat privacy as a life-cycle process, with regular review.
  • Assess consequences of ordinary processing as well as cybersecurity incidents.
  • Use frameworks and safeguards in context; no single checklist or control guarantees compliance.
