Self-custody gives you control of the Bitcoin keys and makes you responsible for protecting and recovering them; third-party custody delegates key management to a provider and makes access depend on that provider. Neither option is universally safer or cheaper. The right comparison is who controls access, what can go wrong, and the full costs and recovery arrangements.
What Bitcoin custody means
A Bitcoin wallet does not contain Bitcoin in the way a physical wallet contains cash. It stores the private keys or passcodes used to access Bitcoin and authorize transactions. A private key can authorize a transaction; a public key can be used to verify transactions and receive assets, but cannot authorize a transaction. Losing the private key can mean permanently losing access, according to the SEC’s December 12, 2025 Investor Bulletin.

Self-custody
With self-custody, you control the private keys and are responsible for securing them and planning recovery. You do not depend on a custodian to authorize access, but mistakes, theft, device damage, or a lost recovery phrase can leave you unable to reach your Bitcoin.
Third-party custody
With third-party custody, an exchange or dedicated crypto custody provider manages and controls access to the keys. This delegates key management, but access then depends on the provider’s security, operations, terms, and ability to meet withdrawal requests.

Risks, control, and convenience compared
| Factor | Self-custody | Third-party custody |
|---|---|---|
| Who controls access? | You control the private keys. | The provider manages and controls access to the keys. |
| Main failure risks | Lost, stolen, or exposed keys or seed phrase; lost or damaged device; wallet compromise; user error. Some failures can mean permanent loss of access. | Provider hack, shutdown, bankruptcy, withdrawal restrictions, or unclear handling of customer assets can prevent access or recovery. |
| Security responsibilities | Set up and maintain the wallet, protect keys and recovery information, and plan how to restore access. | Assess provider security and custody practices, terms for provider failure, insurance terms, and whether customer assets are used or commingled. |
| Convenience | Hot wallets can make transactions convenient; cold wallets are generally less convenient to use. | Account access can simplify key management, but withdrawals and continued access depend on provider operations and terms. |
| Costs to check | Cold-wallet device cost, where applicable, and transaction fees. | Annual asset-based, transaction, transfer-out, setup, and account-closure fees. |
The SEC’s December 12, 2025 bulletin summarizes the self-custody tradeoff this way: “With self-custody, you control your crypto assets and are responsible for managing the private keys to any of your crypto wallets.” For third-party custody, it warns: “If the third-party custodian is hacked, shuts down, or goes bankrupt, you may lose access to your crypto assets.” These are statements in an educational staff bulletin, not rules or regulations; the bulletin says it has no legal force or effect.
Hot versus cold is a separate choice
Custody describes who controls the keys. Hot and cold describe how the wallet is connected and stored. They are separate dimensions: either self-custody or third-party custody can use hot storage, cold storage, or a combination.

Hot wallets
A hot wallet is connected to the internet. That can make transactions more convenient, but internet connectivity exposes it to cyberthreats.
Cold wallets
A cold wallet is typically an offline physical device. The SEC describes cold wallets as generally more secure from cyberthreats than hot wallets, but less convenient for transactions. An offline device is not risk-free: it can be lost, damaged, or stolen, potentially causing permanent loss of access.

Plan recovery before choosing self-custody
A seed phrase—also called a seed recovery phrase or mnemonic phrase—can restore a wallet if a key is lost or its hardware or software is damaged. The SEC advises storing it securely and never sharing it. A recovery plan therefore needs to cover both protecting the phrase from others and ensuring it remains accessible to you when needed. A backup does not remove the risk of theft, loss, or exposure.
If you are considering self-custody, ask yourself whether you are comfortable setting up and maintaining a wallet and taking sole responsibility for access. A hardware wallet is one category of cold-storage device, not a guarantee of safety; verify Bitcoin compatibility and security details for any specific device before relying on it.

Questions to ask a custodian
Before leaving Bitcoin with a provider, review its actual terms and investigate how it handles keys, customer assets, and failure. The SEC’s custody bulletin recommends looking into the provider’s background and regulation. Its March 23, 2023 Investor Alert warns that crypto-asset entities may not provide protections comparable to those available through registered securities intermediaries. Do not assume that an exchange or custodian offers insurance, asset segregation, or recovery in insolvency.
- Where and how are the keys stored, and who can access them?
- What happens to withdrawals and customer assets if the provider is hacked, shuts down, or becomes insolvent?
- Are customer assets lent, used as collateral, or otherwise reused?
- Are customer assets commingled with the provider’s assets or other customers’ assets?
- What does the insurance actually cover, and what exclusions or limits apply?
- How does the provider protect your personal information?
- What do the account agreement and local rules say about your rights to the assets and your ability to withdraw them?
Do not treat a proof-of-reserves statement by itself as proof that customer assets can be recovered in insolvency. The SEC’s March 23, 2023 alert says such a statement may be only a point-in-time snapshot, may not show liabilities or use of assets between snapshots, and is not as rigorous or comprehensive as an audit of financial statements. The protections that apply depend on your jurisdiction, the provider, the asset, and the account agreement.

Compare the full costs
Self-custody costs
The SEC says cold-wallet physical devices typically cost money, while hot wallets may initially be free. Wallet transactions typically involve fees. The SEC does not state a universal device price or transaction-fee amount, so compare the costs for the wallet and transaction pattern you expect rather than relying on a general average.
Third-party custody costs
Ask for the full fee schedule: annual asset-based fees, transaction fees, fees to transfer Bitcoin out, and setup and account-closure fees. Then compare it with how often you expect to transact or withdraw. The fee categories alone do not establish which model will cost less for you.
Spot Bitcoin ETPs are an adjacent option, not custody
If your goal is Bitcoin price exposure rather than holding Bitcoin directly, a spot Bitcoin exchange-traded product (ETP) is a different route—not a type of wallet custody. The SEC’s September 9, 2024 Investor Bulletin describes spot Bitcoin ETPs as exchange-traded commodity trusts that hold Bitcoin and seek to provide price exposure without direct investment in the underlying asset.

Spot Bitcoin ETPs generally charge a sponsor fee that direct holders do not pay; the fee covers operating expenses and reduces the Bitcoin represented by shares over time. Shares can also deviate from Bitcoin’s price. The SEC notes that spot Bitcoin ETPs are not registered as investment companies under the Investment Company Act of 1940, even when a product name or public discussion calls one an ETF. ETPs also retain Bitcoin market risk: the SEC described Bitcoin as highly speculative and volatile in its September 9, 2024 bulletin.
