What ATF has proposed
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) issued a notice of proposed rulemaking on May 8, 2026, under RIN 1140-AB05 and Docket ATF-2026-0266. It concerns “non-over-the-counter” (NOTC) transfers: a federally licensed firearms dealer (FFL) sells a firearm to a buyer who does not appear in person at the dealer’s premises.
ATF’s summary says, “Federal law permits federal firearms licensees (“FFLs”) to transfer firearms to a person residing in the same state but who does not appear in person.” The proposed changes would remove restrictions that limit NOTC sales to transfers exempt from background checks, and set out procedures for qualifying remote transfers with applicable checks, remote identity proofing, and electronic notices to chief law enforcement officers.
ATF’s page lists May 8 as the release and comment-start date and August 6, 2026, as the comment deadline. The agency materials described here identify the action as a proposed rule, not a final one. They do not establish whether the proposal has since been finalized.

Could guns be shipped directly to a buyer’s home?
The proposal concerns how certain same-state dealer-to-buyer transactions may be completed when the buyer is not physically at the dealer’s premises. It should not be read as a blanket authorization for unlicensed sellers to ship guns, for unrestricted home delivery, or for a dealer to send a firearm across state lines to a buyer. The buyer must reside in the same state as the FFL for the proposed NOTC process described here to apply.
Nor does “remote” mean “unchecked.” ATF’s proposal retains applicable background-check requirements and adds remote identity proofing and electronic notices to chief law enforcement officers. Those elements are part of a proposed process, not proof that every transaction would be approved or that all legal requirements would disappear.

Why Trump Jr.’s reported business ties matter—and what they do not prove
An October 2, 2026, article reports that Donald Trump Jr. is a shareholder and board member of GrabAGun, an online firearms retailer. It also reports that GrabAGun launched PEW Logistics in January 2026 to offer manufacturers white-label direct-to-consumer fulfillment, and that the company presented itself as positioned to benefit if remote transactions expand.

That reported overlap makes it reasonable to ask who could benefit from a change in remote-sale rules and whether decision-makers had relevant business interests in view. But a potential commercial alignment is not evidence that Trump Jr. shaped the proposal, received advance knowledge, or will realize a particular financial gain. ATF’s rule text does not establish those claims.
The same article reports that senators questioned whether Trump Jr.’s business interests affected the proposal; his spokesperson denied his involvement; and ATF Director Robert Cekada said the agency had no engagement with a retailer while developing the rule. These are reported statements and competing claims, not a finding of misconduct. The materials available here do not resolve whether anyone exerted influence.

What ATF says about costs and market effects
ATF’s analysis estimates 45,605 active Type 01 dealer FFLs as of December 23, 2025. It projects $236 million in annual deregulatory savings and $2.36 billion over ten years. These are agency estimates, not observed savings or a guarantee of what dealers or consumers would save.
The agency also says ultimate market effects are unknown. It recognizes that larger retailers could compete for customers of smaller regional and community-based dealers, while describing the proposed remote option as voluntary for FFLs. The projected savings and the possibility of competitive pressure are therefore different parts of ATF’s analysis, not settled outcomes.

What critics say about fewer face-to-face interactions
The October 2 article reports concerns from gun-violence-prevention advocates and the National Shooting Sports Foundation that fewer face-to-face interactions could make it harder to detect straw purchasing. A straw purchase is one in which a person buys a firearm on behalf of someone else who is the actual buyer.
Those concerns describe a potential risk, not a measured effect of this proposal. Because the rule is not identified as final in the ATF materials described here, there is no established outcome from its implementation to cite. The policy question is whether the proposed identity checks, background-check process, and law-enforcement notices would adequately address risks that critics associate with less in-person contact.
