The announced review is focused on ASU policies and prevention; the Mayich family says it should also examine who authorized and ran the workout and whether rules were violated. Those are separate questions, and neither the review nor the law-enforcement process had produced final findings in the reporting available as of the AP accounts.
What Bales’s review is supposed to examine
ASU selected Bales to review the university’s findings and material provided by the Mayich family’s attorneys, team members and law enforcement. James Rund, ASU’s senior vice president of educational outreach and student services, said Bales would make recommendations concerning planning, approval, staffing, policies and procedures for outdoor athletic activities, and review outside consultants in strength and conditioning. The Associated Press reported that ASU asked him to complete the review by early December 2026. AP’s report on Bales’s appointment
That is a forward-looking institutional mandate: it is intended to assess practices and identify changes that could help protect student-athletes. The announced scope does not establish that Bales will decide individual responsibility or determine whether a particular person violated a rule.
Why the Mayich family says the scope is too narrow
The family welcomed Bales’s selection but, through attorney Rob Carey, called for a more direct examination of the incident: why the workout was allowed, why it was not stopped when players appeared distressed, and which school, conference or NCAA rules may have been violated. Those are the family’s allegations and questions, not established findings. It also asked that Bales report to the Arizona Board of Regents rather than the university office conducting ASU’s review.

“Justice Bales is a respected choice and he will do an excellent job. But ASU hired him to review policies that may help prevent a tragedy like this in the future. That’s not what’s needed right now,” the family said in a statement reported by AP.
The family pointed to the 2018 death of University of Maryland football player Jordan McNair, saying Maryland used outside investigators and reported to its Board of Regents, which released findings publicly. That comparison reflects the family’s argument about oversight; it does not establish that the circumstances of the two cases are equivalent.

What ASU’s preliminary account says about the workout
AP’s account of ASU’s preliminary report says hockey coaches asked permission for Timothy Ziesel, a former Green Beret, to speak at a three-day team-building event. Staff did not submit a plan of training activities to ASU strength-and-conditioning coaches for review before the event. ASU said its initial review was focused on fact-finding about the workout and related university rules and protocols, and that it had limited medical information while respecting the family’s privacy. AP’s account of the preliminary report
According to that preliminary account, the workout began at 7 a.m. on August 20, 2026, at Sun Angel Stadium. Conditions were reported as 86 to 89 degrees Fahrenheit with 46% to 51% relative humidity. Participants did calisthenics and body-weight exercises, then received a water break about 20 minutes into the activity. Mayich collapsed during a wind-down run while carrying a 10-pound medicine ball. The report said trainers applied ice towels and poured water over him; after he quickly deteriorated, 911 was called. These details are from ASU’s preliminary report as relayed by AP, not independent verification.

Earlier AP reporting quoted Carey alleging that the outdoor workout lasted well over an hour, that some participants had no rest and only one water break, and that signs of trouble appeared before Mayich collapsed. The later preliminary-report account describes a water break about 20 minutes into the activity but does not establish the full session’s rest schedule. The available accounts do not resolve that difference.
How the university review differs from the police process
| Process | Reported purpose or status | What is not established |
|---|---|---|
| Bales’s review, commissioned by ASU | Examine ASU’s findings and other material, then recommend changes to planning, approval, staffing and policies for outdoor athletic activities. ASU set an early-December 2026 completion target, according to AP. | No final findings from Bales or public confirmation that his scope includes assigning personal responsibility. |
| Arizona State police investigation | AP reported that police were investigating the incident. | No completed police report or finding of responsibility was reported. |
| Maricopa County Attorney’s Office review | AP reported that a completed police report would go to the county attorney’s office for independent review. | No completed county review or conclusion was reported. |
AP also reported that hockey coach Greg Powers was placed on administrative leave while the investigation continued. Administrative leave is not a finding of wrongdoing. ASU Athletic Director Graham Rossini said the university’s focus remained on Mayich, his family and supporting student-athletes.

What is known about Mayich’s condition—and what remains unconfirmed
Mayich was 21, according to AP. Carey described his condition as exertional heat stroke that reduced oxygen flow to his brain and said he was unlikely to recover. That diagnosis and prognosis are the attorney’s account, not an independently confirmed public medical record; ASU said it had limited medical information and was respecting the family’s privacy.
What the available reporting does not answer
- Whether Bales’s mandate will expand to assess workout authorization or individual conduct.
- Whether his report will be delivered to the Arizona Board of Regents or released publicly.
- What police and the Maricopa County Attorney’s Office will conclude.
- Whether any ASU, conference or NCAA rule was violated.
Until those processes report findings, the preliminary account and the family’s allegations should not be treated as adjudicated conclusions. The reporting cited here describes investigations and a policy review that were still pending.
