Are You Liable for Unauthorized ATM Withdrawals? U.S. Rules Explained

For covered U.S. accounts, an unauthorized ATM withdrawal is not automatically your responsibility. Regulation E liability depends on the facts and how quickly you report it.

Usually, you are not automatically responsible just because an ATM withdrawal used your debit card or PIN. For U.S. consumer accounts covered by the Electronic Fund Transfer Act and Regulation E, potential liability depends on whether the withdrawal meets the legal definition of an unauthorized electronic fund transfer and how quickly you notify your financial institution. Report a suspected withdrawal immediately: the federal limit can be as low as $50, but delayed notice can increase exposure.

Am I responsible for an ATM withdrawal I didn’t make?

Not automatically. The federal baseline for covered U.S. consumer accounts comes from the Electronic Fund Transfer Act and Regulation E, which covers ATM transfers. A withdrawal is generally unauthorized when someone other than you initiates it without actual authority and you receive no benefit from it. The CFPB defines an unauthorized EFT as one initiated “by a person other than the consumer without actual authority to initiate the transfer and from which the consumer receives no benefit.” See the CFPB’s Regulation E resources.

Federal liability limits apply only if the financial institution provided the required disclosures. For a transfer involving an access device, such as a debit card, the device must be accepted and the institution must have provided a way to identify the consumer to whom it was issued. State law or your account agreement may set a lower liability amount. The federal rules are a baseline, not a promise that every claim will be reimbursed or that every bank must charge nothing.

How much could I owe, and how long do I have to report it?

The reporting clocks have different triggers. The two-business-day period starts when you learn that an access device was lost or stolen. The separate 60-day period starts when the institution sends the periodic statement showing the unauthorized transfer. The CFPB’s current text of 12 CFR § 1005.6 sets out these federal tiers:

When you notify the institution Potential federal liability What the rule requires
Within two business days after learning that a card or other access device was lost or stolen The lesser of $50 or the amount transferred before notice The day you learn of the loss is excluded when calculating the business-day period.
More than two business days after learning of the loss or theft, but within the statement-based 60-day period Up to $500 under a formula; $500 is not automatically owed The amount is capped at the lesser of $500 or up to $50 for transfers in the first two business days plus qualifying transfers afterward, before notice. For those later transfers, the institution must establish that timely notice would have prevented them.
After 60 days from the date the institution sent the statement showing the transfer Potential liability for certain transfers made after the 60-day period and before notice For a lost or stolen access device, later transfers can be subject to unlimited liability; earlier transfers remain subject to the first two tiers. For transfers without an access device, the first two tiers do not apply, but liability may extend to subsequent transfers after the 60-day period and before notice.

If an extenuating circumstance caused the delay, such as extended travel or hospitalization, the institution must extend the reporting periods for a reasonable time. The rule’s official interpretation appears with Regulation E’s § 1005.6 interpretation.

What if someone stole my debit card and took cash?

A withdrawal made with a lost or stolen card can qualify as unauthorized. Tell your institution as soon as you learn of the loss or theft: the two-business-day limit is measured from that discovery, not from the date you later find a withdrawal on a statement. If you report within two business days, the federal cap is the lesser of $50 or the amount transferred before you gave notice. If you report later, the higher tier may apply, subject to its formula and the institution’s obligation to establish that timely notice would have prevented qualifying later transfers.

Some situations count as unauthorized even if the transaction was not a typical stolen-card withdrawal. Regulation E treats a consumer’s ATM withdrawal induced by force as unauthorized. A transfer made by someone who obtained the access device through fraud or robbery can also qualify. The CFPB discusses these cases in its Electronic Fund Transfers FAQ.

Can the bank deny my claim because I shared my PIN?

Negligence by itself cannot increase the liability limit under Regulation E. The CFPB’s official interpretation states: “Negligence by the consumer cannot be used as the basis for imposing greater liability than is permissible under Regulation E.” It specifically says that writing a PIN on a card or on paper kept with the card does not raise the permitted ceiling.

But whether a transfer was unauthorized can depend on whether you gave another person permission. If you gave someone your access device and authority to make transfers, that person’s transactions are generally not unauthorized until you tell the institution that their authority has ended. Fraudulently induced sharing of account information is treated differently from knowingly giving someone a device and permission. The definition also excludes transfers initiated with fraudulent intent by you or someone acting in concert with you; institution- or employee-initiated errors are handled separately.

What should I do if I spot an unauthorized ATM withdrawal?

  1. Contact the account-holding institution immediately. Give notice in person, by phone, or in writing through a reasonable channel. Identify the account and disputed withdrawal as clearly as you can.
  2. Describe the transaction and when you learned of the problem. Include the amount, date, time, ATM location if known, and the date you discovered a lost or stolen card. Keep a record of when and how you notified the institution. Notice is effective when you take reasonable steps to provide pertinent information; you do not always need to know the card or account number if the institution can otherwise identify the account.
  3. Ask the institution to block or replace a compromised card. This is a practical security step, not a condition of Regulation E protection. Ask for the dispute case number and the institution’s process for following up.
  4. Check statements and recent account activity. Keep the statement showing the transaction and note when the institution sent it, because the 60-day reporting period runs from that date.
  5. Keep records as the claim proceeds. Save messages, statements, case numbers, and transaction details. Do not wait for a police report or contact with the ATM operator before notifying the institution.

After receiving oral or written notice of an error, the institution generally must promptly investigate, finish within Regulation E’s applicable time limits, report its findings within three business days after completing the investigation, and correct an error within one business day after determining that one occurred. It must reasonably review relevant information in its own records. The CFPB says the institution may not postpone starting or completing its investigation while waiting for a police report, other documents, or prior contact with a merchant; see its error-resolution FAQ.

What if my bank says the ATM withdrawal was authorized?

Ask the institution to explain the basis for its decision and how it applied the unauthorized-transfer definition and reporting deadlines to your facts. Provide any relevant details you have, such as when the card went missing, when you discovered the withdrawal, whether you gave anyone permission to use the card, and when you reported it. Keep copies of your communications and the institution’s response. Regulation E requires a reasonable review of relevant information in the institution’s records, but the outcome of an individual dispute depends on its facts. If the dispute remains unresolved, consider seeking state-specific legal assistance.
