Are These NFTs Illegal? What the U.S. Sanctions Action Actually Means in 2026

No. The United States did not make NFTs illegal as a category. The headline referred to a November 2021 sanctions action against Latvian cryptocurrency exchange Chatex and specified digital-art assets and blockchain addresses associated with it. For people subject to U.S. sanctions law, dealing with a blocked person or blocked property can be prohibited without authorization. That is targeted sanctions enforcement, not a blanket ban on NFTs or NFT technology.

Whether a particular NFT can lawfully be bought or sold now depends on its sanctions status, how it is marketed and used, the transaction venue, and tax and securities rules. The following explains what the 2021 action covered and how the legal analysis has changed since then.

What the 2021 “illegal NFTs” headline actually covered

On November 11, 2021, Futurism reported that the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) had sanctioned Chatex, a Latvian crypto exchange, along with associated digital-asset addresses. The action also reached dozens of specified digital-art assets, including assets listed on OpenSea.

OFAC sanctions generally block U.S. persons from dealing with a designated person or property in which that person has an interest, unless an authorization or applicable license allows the transaction. Depending on the listing, that can affect buying, selling, transferring, holding, or providing services connected with the blocked property.

OpenSea said at the time that it automatically blocked addresses on the U.S. sanctions list from buying, selling, or transferring on its platform and removed affected items and accounts from visibility. A marketplace block is evidence of the platform’s compliance controls; it is not a declaration that every NFT is unlawful.

What was not banned

  • NFTs as a technology were not outlawed.
  • Digital collectibles unrelated to Chatex or another designated person were not automatically prohibited.
  • An NFT being displayed on a marketplace did not, by itself, establish that it was sanctioned or illegal.

Can you buy an NFT that is on a sanctions list?

If an NFT, wallet address, seller, or other property is covered by an OFAC designation, a person subject to U.S. jurisdiction should not assume that a marketplace listing makes the purchase permissible. Sanctions can apply even when the asset is marketed as art, a collectible, or a token rather than as money.

There is no permanent, universal list of “banned NFTs.” Designations can change, and the practical status of a token may depend on the specific address, owner, intermediary, and transaction. The available government and industry material does not provide a complete live token-ID list for all currently blocked NFTs.

Checks to make before a purchase

  1. Check the people and addresses. Compare the seller, creator, collection-related wallets, and payment addresses with OFAC’s current sanctions information.
  2. Check the marketplace’s current notice. Platforms may restrict buying, selling, transfers, or visibility when their systems identify a sanctioned address or related property.
  3. Check the transaction path. A compliant marketplace does not necessarily make a separate wallet-to-wallet transfer or third-party service permissible.
  4. Keep the evidence. Save the token identifier, contract address, seller address, date, price, marketplace records, and screening result.

Because designations and platform controls can change, verify the live OFAC list and the marketplace’s current notices immediately before a transaction. If a potential match appears, stop and obtain advice from a sanctions lawyer rather than trying to route around a block.

Are NFTs securities or collectibles under current U.S. guidance?

The SEC and CFTC’s 2026 interpretation uses a functional taxonomy that distinguishes digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. The interpretation, issued by the SEC on March 17, 2026 and published jointly in the Federal Register on March 23, 2026, says that digital collectibles generally are not securities by themselves.

The agencies describe digital collectibles as assets with artistic, entertainment, social, cultural, or similar value or utility. A non-security token can nevertheless be offered or sold through an investment contract. In that situation, the transaction—not merely the token’s label—can trigger securities-law requirements.

Features that warrant closer securities analysis

  • Marketing that emphasizes expected profit or price appreciation.
  • Promises that a promoter or development team will create value for purchasers.
  • A transaction structure in which buyers rely on the efforts of others rather than using the token primarily as a collectible or tool.
  • Fractional, pooled, or bundled arrangements that change the economic substance of the purchase.

Calling an asset an “NFT,” “membership,” or “collectible” does not settle the question. Review the token’s characteristics, the promotional material, and the exact way it is offered and resold. Conversely, a collectible classification does not override sanctions rules: a collectible can still be blocked property if it is tied to a designated person.

What risks did the Treasury identify?

In an assessment published May 29, 2024, the Treasury Department said NFTs are highly susceptible to fraud and scams and vulnerable to theft and money laundering. It recommended stronger industry awareness, continued enforcement of existing laws and regulations, and consideration of further regulation.

Those findings describe risk exposure, not a finding that all NFT projects are criminal. They are a reason to examine custody, authentication, wallet security, counterparty controls, and the platform’s compliance process before relying on a collection’s claims.

Do NFT sales have to be reported to the IRS?

Yes, NFTs are included in the IRS’s digital-asset framework. An IRS definition update dated December 15, 2025 treats cryptographically secured assets as digital assets, including NFTs that do not function as a medium of exchange.

That classification is a tax-reporting rule; it does not decide whether a token is sanctioned or whether an offering is a security. Tax consequences depend on what happened in the transaction, the taxpayer’s basis and records, and the applicable reporting rules. Keep purchase and sale dates, prices, fees, wallet records, and any related income documentation, and consult a tax professional when the activity is substantial, cross-border, or business-related.

A practical framework for evaluating an NFT project

What this means for common questions

“Are NFTs illegal in the United States?”

No. Some transactions involving particular sanctioned persons or property may be prohibited, and some offerings may raise securities-law issues. Those targeted rules do not ban NFTs generally.

“Which NFTs did the U.S. government ban?”

The 2021 action identified Chatex and specified associated addresses and digital-art assets. It did not create a broad government list covering every NFT. Current status must be checked against live sanctions information and the relevant platform’s controls.

“Are all NFT collectibles exempt from securities laws?”

No. The 2026 SEC/CFTC interpretation says digital collectibles generally are not securities themselves, but the way a token is offered or sold can constitute an investment contract.
