Sometimes—but open weights alone do not make a model safe, unrestricted, or approved for commercial use. A business must check the exact model version and terms, test it for its intended product, secure the deployment, and determine which legal obligations apply to its role and markets. Permission to use a model commercially and evidence that it is suitable for a particular product are separate questions.
What “open-weight” does—and does not—tell you
An open-weight model makes its trained parameters available. That availability is not, by itself, a commercial license or a promise that every part of the model package is open under the same terms. The license, acceptable-use rules, and conditions can vary by provider and version.

Nor does a license certify that the model will produce accurate, safe, private, or legally appropriate results in your product. The National Institute of Standards and Technology (NIST) notes that AI systems face familiar software security risks as well as machine-learning-specific attack concerns. Treat model selection, integration, deployment, and ongoing operation as separate parts of a product risk review.

- Terms: Check the exact release’s license and acceptable-use policy for commercial use, modification and fine-tuning, redistribution, attribution, output use, and restricted applications. Review the model files and dependencies you plan to distribute or operate, not just a product summary.
- Task fit: Test representative product workflows, including difficult and edge cases. Assess errors and limitations that matter to your use, and decide what should happen when the model is uncertain or fails.
- Security and misuse: Review how users can access the model, what tools and integrations it can reach, how model files and configuration are protected, and how you will detect and respond to abuse or incidents.
- Data handling: Map what information is sent to the model, where it is processed, who operates the infrastructure, and what access controls apply. Self-hosting may give the operator more control over processing location, but also leaves the operator responsible for securing and maintaining the deployment.
- Legal scope: Identify the markets and sectors involved, and whether your company is acting as a model provider, a downstream AI-system provider, or in another role. The obligations can differ by role and jurisdiction.
How the terms differ: gpt-oss and Llama examples
These provider-specific examples illustrate why a team should verify the exact model and release terms. They are not a general rule for all open-weight models.
| Model family | What the provider says | What to verify |
|---|---|---|
| OpenAI gpt-oss | OpenAI says gpt-oss is licensed under Apache 2.0, which permits broad use, modification, and redistribution, including commercial use, subject to the gpt-oss usage policy. OpenAI says the weights can run on infrastructure controlled by the user or through hosting providers. | Read the current license and usage policy for the specific release, and check the terms for the full package and deployment arrangement. |
| Meta Llama | Meta describes Llama as subject to a bespoke Llama Community License and Acceptable Use Policy. Meta’s FAQ says restrictions on using model parts, including outputs, to train another AI model apply to Llama 2 and Llama 3; it says Llama 3.1 and later allow that use with required attribution. | Confirm the exact generation’s license and policy before relying on the summary; terms differ by release. |
Meta’s Llama 3.2 model card says the model is intended for commercial and research use subject to its license and acceptable-use policy. It also advises deploying language models as part of an overall AI system with additional safeguards as needed. Commercial permission therefore does not remove the need to assess the surrounding product.
Does self-hosting make a model safer or more private?
Self-hosting changes who operates the infrastructure and can give a company greater control over where data is processed. It does not automatically make the system secure or private: the operator must manage access, protect model files and configuration, secure integrations, monitor use, and handle abuse.

OpenAI says it does not receive data sent to gpt-oss models running on infrastructure controlled by the user unless the user shares that data or uses a managed hosting partner. This statement is specific to the deployment OpenAI describes; it should not be generalized to other models, hosts, or configurations. For any deployment, establish what data leaves your environment and which party operates each security control.
What security framework can help organize the review?
NIST’s AI Risk Management Framework (AI RMF) is a voluntary way to organize trustworthiness considerations across AI design, development, use, evaluation, and testing. It can help teams structure reviews over the system lifecycle; it is not a certification and does not replace binding legal duties.
NIST’s security and resilience guidance identifies model weights and configuration settings as AI components for implementation-focused security work. That makes the review broader than checking a model download: consider how components are sourced, changed, deployed, accessed, and monitored alongside ordinary software and infrastructure risks.

What EU AI Act duties may apply?
The European Commission’s guidance describes obligations for providers of general-purpose AI (GPAI) models, including technical documentation, a copyright-compliance policy, and a public summary of training content. It says these GPAI obligations began applying on 2 August 2025; consult current Commission guidance for enforcement timing and transitional rules.
The Commission describes a conditional exemption from certain documentation obligations for providers releasing qualifying models under a free and open-source license, when specified transparency conditions are met. That exemption does not apply to GPAI models with systemic risk. The Commission identifies additional systemic-risk obligations, including assessment and mitigation, incident reporting, and cybersecurity protections.
This is a high-level EU overview, not a determination for an individual company. Whether a model qualifies as GPAI, whether systemic risk applies, who places it on the market, and the company’s role in the value chain all matter. Downstream product companies do not automatically have the same role or obligations as model providers, and other jurisdictions or sector rules may add requirements.

Can you fine-tune an open-weight model?
That depends on the exact model’s license and policies. Check whether modification or fine-tuning is permitted, whether distributing a modified model triggers conditions such as attribution, and whether the intended data or use conflicts with the acceptable-use rules. For Llama, Meta’s version-specific terms also matter if you plan to use outputs to train another model.
Are these models “free”?
Not necessarily in every relevant sense. A model may be available to download and still carry license conditions or usage restrictions; operating it may also require infrastructure and ongoing security work. Read the exact model terms rather than treating “open-weight” as synonymous with unrestricted use.
A practical go/no-go review
- Pin down the candidate: Record the provider, exact model release, license, acceptable-use policy, and the components you intend to use.
- Review the planned use: Confirm that commercial use, the product’s intended purpose, fine-tuning, and any redistribution or output use fit the applicable terms.
- Test the product workflow: Evaluate representative tasks and failure cases, then decide what safeguards, limits, or human review the product needs.
- Map the deployment: Document where data is processed, which providers or hosts can access it, how tools and integrations are constrained, and who is responsible for security operations.
- Check obligations by role and market: Determine whether provider-specific, jurisdictional, or sector requirements apply before launch, and revisit the assessment when the model or deployment changes.
Proceed only when the intended use fits the terms, testing supports the product’s requirements, operational controls are in place, and applicable legal duties have been assessed. If any of those checks is unresolved, the model is not yet cleared for that product.
