Are Lyft Drivers Employees or Independent Contractors? What Classification Means

Lyft’s contractor label does not settle a driver’s legal status. The relevant test depends on the law, location and date of the work—with California’s Proposition 22 creating a distinct rule for qualifying app-based drivers since December 16, 2020.

Lyft describes drivers on its platform as independent contractors, but that label does not decide their legal status. The answer depends on the law being applied, the place and date of the work, and sometimes the actual conditions of the working relationship. California is a notable example: qualifying app-based drivers have been covered by Proposition 22 since December 16, 2020, while a proposed 2026 settlement concerns alleged violations during an earlier period.

What does driver classification mean?

Worker classification is the legal decision about whether a person is an employee or an independent contractor under a particular law. It can determine which protections or obligations apply—for example, wage-and-hour rules, unemployment insurance, workers’ compensation, or tax treatment. Those questions do not necessarily use the same test or produce the same answer.

A company’s contract, the name it gives a worker, or a Form 1099 is not conclusive. California’s Labor Commissioner’s Office says the applicable legal test controls; the U.S. Department of Labor (DOL) likewise says a worker’s label and 1099 do not determine status under the Fair Labor Standards Act (FLSA).

Are Lyft drivers employees in every state?

There is no single classification answer for all Lyft drivers across the United States. Federal, state, and local laws can apply different tests, and a result under one law does not automatically decide rights under another. The DOL describes the FLSA as distinct from other legal standards, while California has its own rules. Lyft has also reported classification challenges and proceedings at federal, state, and municipal levels.

The evidence summarized here does not establish the current rules for every state or city. Drivers outside California need to check the labor rules that apply where they work and the particular legal right at issue.

How does California classify Lyft drivers?

Work before Proposition 22 took effect

California’s ABC test generally presumes employee status unless the hiring entity proves all three parts:

  1. A — Freedom from control: The worker is free from the company’s control and direction in performing the work, both under the contract and in practice.
  2. B — Work outside the usual business: The work is outside the usual course of the company’s business.
  3. C — Independent occupation: The worker is customarily engaged in an independently established business or occupation of the same nature.

Under this test, failing any one part generally defeats independent-contractor status unless a statutory exception calls for another test. Owning a vehicle or choosing when to log in does not, by itself, resolve all three parts. California’s ABC test followed the state Supreme Court’s 2018 Dynamex decision and was codified in AB 5.

Qualifying app-based work from December 16, 2020

Proposition 22, codified at California Business and Professions Code section 7451, provides a different rule for qualifying app-based transportation and delivery drivers. Under the Labor Commissioner’s Office guidance, a driver is an independent contractor under this provision if the network company does not:

Rank #3
Rideshare Safety Kit - Recommended for all rideshare, car service, and taxi drivers to help keep occupants safe and healthy, with a fluid spill cleanup kit and PPE for sick drivers or passengers.
  • This kit was designed with rideshare and car services in mind, with items to help in case of an automotive or medical emergency.
  • The PPE and BBP kit helps operators deal with unwell or sick passengers, to help safely clean up any messes as well.
  • A window breaker and seatbelt cutter is a must have for all drivers to quickly and safely escape their vehicle in an emergency.
  • The LED Flare and Class 2 safety vest help the operator stay visible in case of emergency when on the side of the road.
  • Set mandatory days, times, or minimum hours for the driver to work.
  • Require the driver to accept particular service requests.
  • Restrict the driver from working for other platforms outside engaged time.
  • Restrict the driver from pursuing another lawful occupation or business.

The rule has statutory conditions and possible complications. Its date and scope matter: it applies to qualifying work from December 16, 2020, not retroactively to the earlier period discussed in the 2026 settlement.

What is the federal FLSA test?

For federal minimum-wage and overtime questions under the FLSA, the DOL’s March 2024 Fact Sheet 13 describes an “economic realities” analysis. It asks whether the worker is economically dependent on the employer for work or is in business for themself. The DOL lists six considerations:

  • Opportunity for profit or loss depending on managerial skill.
  • Investments by the worker and the employer.
  • Permanence of the working relationship.
  • Nature and degree of control.
  • Whether the work is integral to the employer’s business.
  • Skill and initiative.

No single consideration decides the result; the relationship as a whole matters. This federal analysis is not a substitute for California’s ABC test or for rules governing other benefits and legal claims.

On February 26, 2026, the DOL announced a proposed rulemaking to revise its independent-contractor framework. A proposal is not a final rule. Fact Sheet 13 says the 2024 rule remains in effect for private litigation and points to separate guidance on the Wage and Hour Division’s enforcement position.

What does the 2026 California Lyft settlement cover?

On October 1, 2026, California’s Labor Commissioner’s Office announced a proposed settlement in which Lyft would pay $272.5 million plus accrued interest to resolve allegations about driver classification and denied workplace protections. The allegations included minimum wage, overtime, rest-break premiums, expense reimbursement, wage statements, timely wages, and paid sick leave. This is a proposed settlement, not a court ruling that every Lyft driver is an employee in every place or period.

The Attorney General’s announcement says the agreement is subject to court approval. The Labor Commissioner’s Office describes alleged violations from April 6, 2016 through December 15, 2020; the Attorney General’s release describes driver hours and miles beginning April 5, 2016 and ending December 15, 2020. The releases therefore differ by one day on the stated start date, and both place the end before Proposition 22 took effect.

The two official announcements describe driver funds differently: the Labor Commissioner’s Office says 87% of the total is to go directly to drivers, while the Attorney General says at least $237,075,000 is reserved for drivers who worked during the covered period. The Labor Commissioner’s Office also says more than 1,600 drivers who filed wage claims through its administrative process will receive additional funds after the office redirects its share of penalties.

The Labor Commissioner’s Office says the agreement does not require Lyft to reclassify drivers going forward and does not provide relief for work after the covered period. According to California officials, eligible drivers will be contacted by an administrator after court approval and fund payment. The administrator’s identity, claims website, detailed eligibility process, and timetable have not yet been announced in the releases described here; no individual driver’s eligibility or payout can be inferred from the headline settlement figures.

What should a Lyft driver do with this information?

  • Identify the question: A wage claim, tax issue, unemployment claim, or workers’ compensation matter may involve different legal standards.
  • Pin down the place and dates: In California, work before December 16, 2020 falls in a different period from qualifying app-based work under Proposition 22 afterward.
  • Check the applicable official guidance: Use the labor agency or other relevant government office for the state and legal issue involved. California’s rules should not be assumed to apply elsewhere.
  • For the settlement, wait for official notices: California officials say details for eligible drivers will follow the approval process. Until then, there is no verified claims link or deadline in the announcements described here.
