In the United States, downloading or sharing a copyrighted game ROM without the copyright owner’s authorization can infringe copyright. Owning the cartridge or disc does not, by itself, authorize downloading a copy from a third-party site. U.S. law does recognize a limited archival-copy rule for certain computer programs, but that is not a general permission to download ROMs. The rules also differ by country, and this overview is general information, not legal advice for an individual situation.
Is it illegal to download ROMs?
A ROM is a digital copy of game software. Making one can implicate the copyright owner’s right to reproduce the work; distributing or making it available can implicate distribution rights as well. The U.S. Copyright Office says that downloading or uploading a copyrighted work without the owner’s authority infringes the owner’s reproduction and/or distribution rights. It advises that most works should be treated as protected unless there is clear information otherwise.
That makes the ROM’s source important. A download from a third-party ROM site or a peer-to-peer network is not automatically authorized just because the game is old, out of print, or difficult to buy. The Copyright Office says authorization is a factual question, so the relevant question is whether the rights holder permitted that copy or distribution—not simply whether a file is available online.
For context on enforcement, a WIPO paper describes a 2021 decision involving Nintendo ROM files in which the operators were found liable for direct, contributory, and vicarious infringement tied to uploading and making the files available. That example concerns distribution operations; it does not establish that every individual downloader has been adjudicated in the same way.

The Copyright Office’s current FAQ describes possible statutory damages of up to $30,000 per infringed work, or up to $150,000 per work if willful infringement is proven, as well as possible attorney’s fees. These are statutory maximums, not automatic fines or predictions of what a particular person would owe.
Is downloading a ROM legal if I own the game?
Not automatically. Owning a physical copy does not itself authorize a separate copy made by someone else and offered for download. The U.S. Copyright Office describes a narrower rule under Section 117: the legal owner of a copy of a computer program, or someone the owner authorizes, may make a copy solely for archival purposes. If the original is sold, given away, or otherwise transferred, the archival copy must also be destroyed or transferred with it.
The Office advises checking the original software’s sale terms or license agreement for conditions that may affect a backup. Its archival-copy guidance does not establish that every console extraction method is lawful, nor does it grant a third party permission to distribute a ROM. Bypassing access controls can raise a separate question under the DMCA.

Can I make a backup of my game cartridge?
Section 117’s archival-copy rule is the relevant U.S. Copyright Office guidance for a lawful owner making a backup of a computer program. Its conditions are limited: the copy must be solely archival, the person making it must be the legal owner of the program copy, and the archival copy must be destroyed or transferred with the original when the original changes hands. The game’s license terms may also matter.

How does the DMCA apply to game ROMs?
Copyright infringement and anti-circumvention are separate issues. Section 1201 of the DMCA generally restricts circumventing technological measures used to control access to copyrighted works, including video games and computer programs. Congress provides a rulemaking process for limited, temporary exemptions; those exemptions apply only under their stated conditions. The U.S. Copyright Office’s ninth triennial proceeding issued its final rule on October 28, 2024.

Restoring certain games that depend on authentication servers
A current exemption covers specified copying or modification of certain lawfully acquired, complete games that require an external authentication server to enable gameplay, when the copyright owner or its representative has ceased to provide access. The purpose is to restore local gameplay on a personal computer or console. The regulation defines ceased support as an affirmative statement that support has ended and is unavailable, or support being discontinued for at least six months without restoration.
What the exemptions do not mean
These provisions are not a general personal-use ROM exemption, a blanket right to download unavailable games, or permission to share preservation copies. The applicable exemption depends on the game, the user, the purpose, and the conditions in the regulation.
Can libraries preserve old games?
U.S. rules provide specific preservation exemptions for eligible libraries, archives, and museums. Depending on the provision, an institution may be able to preserve certain complete games that are no longer reasonably available commercially, or carry out qualifying preservation activity for games affected by discontinued authentication-server support.

The institutional provisions are conditional. Requirements include a lawfully acquired collection, a public-service mission, trained staff or volunteers, reasonable digital security, and no direct or indirect commercial advantage. For the relevant game-preservation provisions, the institution may not distribute the game outside its physical premises. These limited institutional permissions should not be treated as consumer permission to download or share a preservation copy.

Emulator software and the game files run through it are different questions. The rules discussed above address copyrighted copies and access-control circumvention; they do not establish a comprehensive answer for every emulator’s implementation or use. Firmware or system software can raise its own issues. The facts, the source of each file, and the law where you live all matter, so it is not accurate to say that every emulator is legal or that every emulator is illegal.
What facts matter in a particular ROM situation?
A useful starting point is to separate the acts and circumstances instead of treating “using a ROM” as one legal question. Consider:

- Source: Was the copy supplied by the rights holder, made by the owner, or obtained from a third-party site or peer-to-peer network?
- Conduct: Are you making an archival copy, downloading, uploading, hosting, or bypassing an access control?
- User and purpose: Is this individual local play, or preservation by an institution that may qualify for a specific exemption?
- Game and service status: Does gameplay require an external authentication server, has its support ended under the regulation’s definition, and is the game reasonably available commercially where that condition applies?
- License and territory: What terms came with the lawfully acquired copy, and which country’s copyright and anti-circumvention rules apply?
Do ROM laws differ outside the United States?
Yes. Copyright and anti-circumvention rules vary by jurisdiction, so the U.S. explanations above should not be assumed to apply elsewhere. WIPO’s enforcement paper provides comparative context and explains that unauthorized ROM duplication will implicate copyright in most jurisdictions, but it is not a country-by-country legal guide.
Nintendo UK’s online-piracy guidance is specifically for the UK and Ireland, not a statement of U.S. law or a universal rule for every publisher. Nintendo says its authentic games can be purchased for download online through the Nintendo eShop or Nintendo website only, and describes uploading and downloading pirate copies of its games as illegal. For a specific country, check that jurisdiction’s law and the relevant publisher’s terms.
