Alternatives to AI Tools for Employee Performance Reviews and Discipline

A structured human-led process can evaluate performance and handle discipline without relying on AI scores: set clear job-related standards, use relevant evidence, invite employee input, and consider accommodations.

Employers can evaluate performance and handle discipline without letting software make the judgment: set job-related expectations in advance, use accurate evidence, give employees a chance to respond, apply standards consistently, and keep an accountable manager responsible for decisions. A structured human process can be systematic without relying on an AI score.

What are alternatives to AI performance reviews?

The alternative is not an informal or inconsistent review. It is a human-led process built around clear expectations and evidence tied to the work. The U.S. Equal Employment Opportunity Commission (EEOC) says explicit expectations, clear performance standards, accurate measures, reliable feedback, and consistent application help reduce the chances of discriminatory ratings. Its technical assistance was issued September 3, 2008, and is guidance—not a document with the force and effect of law. Read the EEOC guidance.

Set expectations before the review period

Describe the responsibilities and standards employees are expected to meet before evaluating them. Connect each standard to the job rather than relying on vague impressions such as “not a team player.” Explain what satisfactory work looks like and how it will be assessed.

Use evidence that reflects the duties

Choose information that directly relates to the work being evaluated, and explain how it was gathered or measured. A manager should be able to connect an assessment to observable work, not simply repeat an unexplained software score or a subjective label.

Give feedback reliably and invite context

Discuss performance regularly and close to the work, rather than leaving employees to encounter significant concerns for the first time in a formal review. Let the employee respond, clarify circumstances, and add relevant information before a conclusion is finalized.

Apply standards consistently

Use the same job-related standards across employees in comparable circumstances. Consistency does not mean ignoring disability-related needs: reasonable accommodation may affect how an employee performs a task or participates in a review, and must be considered where required.

How can managers evaluate employee performance without AI?

  1. Define the role and review period. Identify the duties being assessed, the period covered, and the standards that were communicated to the employee.
  2. Gather relevant evidence. Use records and observations that directly reflect those duties. Note how measures were produced and distinguish documented facts from interpretation.
  3. Compare evidence with the stated standards. Explain where the work met expectations and where it did not, using specific examples rather than general characterizations.
  4. Discuss the assessment with the employee. Share the evidence, invite a response, and consider context or corrections before recording a final assessment.
  5. Document the reasoning. Record the standard applied, the evidence considered, the employee’s relevant response, and the manager’s conclusion in understandable terms.
  6. Agree on follow-up. Where improvement is needed, identify the expected change, support or accommodation to consider, and how progress will be reviewed.

This sequence is a practical way to implement the EEOC’s principles; it is not a prescribed legal form or a guarantee against disputes.

How can employers discipline employees fairly without automated tools?

Discipline should be based on established conduct or performance expectations and evidence relevant to the issue. An accountable manager should review the underlying facts, hear the employee’s explanation, and document why the evidence supports the outcome. Avoid treating a numerical rating, monitoring alert, or automated flag as proof by itself.

For employees with disabilities, the EEOC guidance says standards for qualified employees must be job-related and consistent with business necessity, and that reasonable accommodation can matter when disability contributes to a performance issue. It also explains that an employer may need to provide an accommodation so an employee can participate meaningfully in a performance review or misconduct investigation. For example, its guidance describes providing a blind employee who requests one with a Braille or accessible electronic review copy she can read independently, absent undue hardship.

The 2008 guidance states that ADA Title I covers private, state, and local government employers with 15 or more employees, while Section 501 of the Rehabilitation Act covers federal agencies. It is nonbinding technical assistance, not a substitute for statutory text or current legal advice.

What safeguards should employers use if they use AI to monitor employee performance?

Keeping software in the process does not remove the need for human judgment or legal safeguards. A 2022 EEOC and Department of Justice announcement warned that employment software used to monitor performance or inform pay and promotion decisions may disadvantage workers with disabilities. The agencies highlighted risks including screening out qualified people, disability-related inquiries or medical exams, and the need for accommodation processes. Read the EEOC and DOJ announcement.

ADA.gov advises employers to consider effects across different disabilities and examine employment technologies before and during use for disability screening. It also says its guidance is informal and does not have legally binding effect beyond existing law. Read ADA.gov’s guidance on AI and the ADA.

  • Check whether the tool or its outputs disadvantage employees with disabilities, including through screening or inaccessible participation.
  • Make accommodation procedures clear and usable for employees affected by the technology or review process.
  • Verify what the score or alert measures, what evidence supports it, and whether a manager can explain and challenge the result.
  • Give the employee a meaningful way to understand and respond to the evidence before a review or discipline decision is made.
  • Keep the final assessment and any discipline decision with an accountable manager rather than treating an automated output as self-justifying.

These are practical safeguards drawn from the agencies’ guidance and warnings; they are not a formal agency scoring framework.

When do background-check rules matter?

If an employer uses a third-party consumer report as part of an employment decision, federal nondiscrimination rules still apply and procedures under the Fair Credit Reporting Act may also apply. State and municipal requirements can matter too. This is a specific issue about consumer reports, not a general rule governing every performance review or AI tool. The EEOC and Federal Trade Commission explain the background-check rules here: What employers need to know about background checks.

What the sources establish—and what they do not

The cited materials are U.S. federal agency sources. The EEOC’s 2008 technical assistance supports structured, consistent, job-related evaluation and explains disability-related accommodation considerations. The 2022 EEOC/DOJ announcement and ADA.gov guidance warn about disability risks from employment technologies. They do not establish the current requirements of any particular state, city, or non-U.S. jurisdiction. Employers should verify applicable law for the locations where they operate.
