Alito Recuses From Key Climate Case Before Arguments, Leaving Questions About Timing

Justice Samuel Alito recused himself from Suncor v. Boulder shortly before the Supreme Court’s arguments were scheduled to begin on October 5, 2026. The Court clerk’s brief notice, as described in an October 1 report, gave no reason. The move keeps Alito out of the upcoming proceedings, but it leaves questions about his earlier participation in the decision to hear the case and about how justices’ investments intersect with climate litigation.

What is Suncor v. Boulder about?

Boulder, Colorado, sued ExxonMobil and Suncor over climate-related costs and damage. The companies asked the Supreme Court to stop the case from proceeding in state court, arguing that federal law preempts state and local climate-damage claims against oil companies. The legal question is consequential beyond Boulder: as of the October 1 report, 11 related state cases had been stayed pending the Supreme Court case.

The Court’s argument was scheduled for October 5, 2026. As of October 3, it had not taken place, and no ruling had been issued. The report does not establish what the justices will decide or what would happen to each stayed case if the companies prevail.

Why did Alito recuse himself?

The notice reported by The College Voter, republishing an Inside Climate News report dated October 1, 2026, said Alito would no longer participate but did not explain why. The report says he did not own stock in ExxonMobil or Suncor, the two companies named in the dispute. It also says his latest financial disclosure, released in August 2026, listed stock in more than 25 corporations, including seven in the fossil-fuel industry, and an Oklahoma mineral interest valued at up to $250,000. The report said these holdings were unchanged from the previous year; the disclosure itself was not independently reviewed for this account.

That distinction matters. A financial interest in a party before the Court is different from an investment in another company that could be affected indirectly by a ruling. The report raises the broader possibility that a decision in climate litigation could have consequences for other companies, but it does not establish that any particular holding would benefit from a ruling or that Alito’s investments influenced him.

What remains unresolved about the timing?

His earlier role in taking the case

The Court had agreed to hear the case in February, and the report says Alito took part in the conference at which the justices considered whether to grant review. The conference deliberations are secret. Under the longstanding practice described in the report, at least four justices must agree to hear a case. The available account does not show whether Alito’s vote was decisive or establish that his participation changed the result; the timing leaves that as an unanswered question.

Earlier petitions on the same legal issue

Between 2023 and 2025, the Court denied petitions in nine cases raising essentially the same preemption issue, according to the report. Alito recused himself from the conferences in all but one of them. Exxon’s 2022 filing called Boulder an “ideal vehicle” and said it involved fewer defendants and was “less likely to present recusal issues.” Those descriptions are reported from the filing; they do not prove why the Court chose this case or why Alito later recused.

What does the Supreme Court’s ethics code say about recusal?

The Supreme Court adopted its first code of conduct in 2023. The report says the code identifies circumstances for recusal, including a justice’s financial interest in a party appearing before the Court. The immediate named parties here were ExxonMobil and Suncor, and the report says Alito held no stock in either. The dispute over what the code or broader ethical expectations require in cases involving investments in other potentially affected companies is not resolved by the recusal notice, which offered no explanation.

Why is the broader ethics debate still open?

Legal and ethics experts quoted in the report disagree in emphasis. Stetson University law professor Louis Virelli argued that the question should be what is right, not only what is required. Arthur Hellman, a University of Pittsburgh professor emeritus and legal ethics expert, questioned why Alito continues to own individual corporate stocks and said this late recusal did not address institutional concerns he had raised earlier.

Alito had argued in a 2023 memorandum that repeated recusals could leave the Court without a full bench and disrupt its work. He wrote: “If we recused in such cases, we would regularly have less than a full bench, and the Court’s work would be substantially disrupted and distorted.” That concern points to a real institutional trade-off: recusals can limit a justice’s involvement, while frequent recusals can leave fewer justices to decide cases. It does not answer whether individual stock ownership is appropriate or whether a particular justice should recuse in a particular case.

Consumer Watchdog organizing director Alexandra Nagy, also quoted in the report, said: “The public should not have to wonder whether a justice’s personal investments could benefit from a ruling that shields the fossil-fuel industry from liability.” That is an attributed concern about public confidence, not evidence that a ruling would benefit Alito personally or that his conduct was improper.

What the recusal does—and does not—settle

  • Settled for the upcoming proceedings: the clerk’s reported notice says Alito will not participate further in Suncor v. Boulder.
  • Not explained: the notice, as reported, did not say why he recused.
  • Still uncertain: the report does not establish whether his February participation affected the vote to hear the case.
  • Still debated: the broader question of individual stock ownership by justices, including holdings in companies that could be affected indirectly by litigation, goes beyond the facts of this one recusal.
