AI Regulation vs. AI Safety Standards: What’s the Difference?

AI laws create binding duties, while standards and risk frameworks help organizations manage AI practices. The EU AI Act gives some harmonised standards a limited, conditional conformity role.

AI regulation is binding law; AI standards and risk frameworks are practical methods for managing AI-related responsibilities. A standard can help an organization build processes and, in specific legal schemes, support a conformity claim. It does not become law merely because it is widely used or certified against. Under the EU AI Act, a harmonised standard has a defined legal effect only when its reference is published in the Official Journal, and only for the requirements it covers.

Regulation and standards have different legal force

A regulation or statute sets legal duties within the jurisdiction that enacted it. It can specify who must do what, when obligations apply, and how authorities may enforce them. The EU AI Act, Regulation (EU) 2024/1689, establishes rules for placing AI systems on the EU market, putting them into service and using them. Its provisions include prohibited practices, obligations for high-risk AI systems and their operators, transparency requirements for certain systems, obligations for general-purpose AI models, and monitoring and enforcement. The applicable duties depend on the Act’s scope and the role and circumstances involved; consult the consolidated legal text dated 27 July 2026 for specific requirements and dates.

A standard documents agreed requirements, guidance or methods for particular technical or organizational practices. A risk framework organizes ways to identify and manage risks. These instruments can help translate broad responsibilities into repeatable work, but they are not statutes or regulations simply by virtue of being published by a standards body or government agency.

How the EU AI Act gives some standards a legal role

The Act creates a conditional bridge between law and standards. Under Article 40, conformity with a harmonised standard can create a presumption of conformity for the AI Act requirements or obligations that the standard covers, when the standard’s reference is published in the Official Journal of the European Union. That presumption is limited: it is not a blanket exemption from the Act, and it applies only to the covered requirements or obligations.

The European Commission says it requested CEN and CENELEC to develop standards addressing topics such as risk management, data governance and dataset quality, logging, transparency, human oversight, accuracy, robustness, cybersecurity, provider quality management, post-market monitoring and conformity assessment. If a harmonised standard is referenced in the Official Journal, it is accompanied by an annex mapping relevant legal requirements to clauses in the standard. See the Commission’s explanation of AI Act standardisation.

The Commission FAQ dated 10 March 2026 said the first harmonised standards were expected from CEN and CENELEC in 2026, after which the Commission would review them before deciding whether to submit references for Official Journal publication. That was a forecast, not confirmation that a particular standard has since been referenced. Before relying on a standard for a presumption of conformity, check the current Official Journal entry and the scope of the reference.

How the main instruments compare

Instrument What it is Who or what it addresses Legal effect
EU AI Act EU regulation establishing rules for covered AI systems and models Relevant providers, deployers and other actors, according to the Act’s scope and provisions Binding law in its applicable scope; enforcement provisions apply
EU harmonised AI standards Standards developed for topics relevant to the Act Technical and organizational practices relevant to covered requirements A presumption of conformity is available only for covered requirements when the reference is published in the Official Journal
ISO/IEC 42001:2023 AI management-system standard for organizations Organizational policies, objectives and processes for AI development, provision or use Not itself an AI law or proof of compliance with the EU AI Act

What ISO/IEC 42001 and the NIST AI RMF do

ISO/IEC 42001:2023 organizes an AI management system

ISO/IEC 42001:2023 specifies requirements and guidance for establishing, implementing, maintaining and continually improving an AI management system within an organization. It covers policies, objectives and processes related to responsible AI development, provision or use, and follows a Plan-Do-Check-Act approach. Its focus is organizational management, not a substitute for determining which laws apply to a particular system.

The Commission specifically cautions that ISO/IEC 42001:2023’s goals and definitions are not aligned with the quality management system required under the AI Act. So adopting the standard, or holding a certificate against it, does not by itself establish compliance with the Act or satisfy all of its obligations.

The NIST AI RMF supports risk management

NIST describes its AI Risk Management Framework as a resource for people and organizations designing, developing, deploying or using AI to manage risks and promote trustworthy and responsible AI development and use. NIST also describes work aligning the framework with international standards and publishing crosswalks. That can help teams relate risk-management practices to other instruments, but it does not turn the framework into law. See NIST’s AI standards and framework information.

How to choose what to use

  1. Identify the applicable law first. Determine the jurisdictions, sectors and roles relevant to the system. The EU AI Act is EU law; it does not establish the rules that apply in every country or industry.
  2. Map the legal duties to the system and its lifecycle. Work out which provisions apply to the system and the organization’s role, rather than assuming that one general AI checklist covers every obligation.
  3. Select standards and frameworks to operationalize the work. Use an organizational management-system standard such as ISO/IEC 42001 for management processes, or a risk framework such as the NIST AI RMF to structure risk work, where appropriate to the organization’s needs.
  4. Verify any claimed legal effect. For an EU AI Act presumption of conformity, confirm that the relevant harmonised standard’s reference is in the Official Journal and that the reference covers the requirements at issue. Do not infer that effect from a draft, a standard’s publication, a crosswalk or a certificate alone.

Common misunderstandings

  • “A standard is the same as a law.” No. A standard or framework generally describes practices; legal duties come from applicable law.
  • “Every AI standard is a safety standard.” No. ISO/IEC 42001 is specifically an AI management-system standard, while the NIST AI RMF is a risk-management framework.
  • “Using ISO/IEC 42001 means the organization complies with the AI Act.” Not on its own. The Commission notes that the standard’s goals and definitions are not aligned with the quality management system required under the Act.
  • “Any harmonised standard automatically creates a presumption.” No. The legal effect depends on Official Journal publication of the reference and is confined to the requirements it covers.
