Malaysian businesses should separate voluntary AI governance guidance from legal duties that apply to a particular use case. The National Guidelines on AI Governance and Ethics (AIGE) and the AI Code of Ethics (AICE) offer ways to govern AI, but they do not replace laws such as the Personal Data Protection Act 2010 (PDPA) when its conditions apply.
Is AI regulated in Malaysia?
There is no single compliance answer for every AI system. A business needs to assess the laws and sector requirements that apply to its activities, data, and use case, alongside voluntary AI governance guidance.

The National AI Office FAQ states that Malaysia does not have a dedicated AI law and refers to a proposed AI Governance Bill. That policy status can change; check the latest government, parliamentary, and Gazette materials before relying on it. The absence of a dedicated AI statute would not remove obligations under other laws.

Are Malaysia’s AI guidelines legally binding?
AIGE, launched by the Ministry of Science, Technology and Innovation (MOSTI) in September 2024, is voluntary guidance. It sets out seven principles: fairness; reliability, safety and control; privacy and security; inclusiveness; transparency; accountability; and human benefit and happiness.
#1 Best Overall
AICE is also described as voluntary and non-binding. It helps organisations put the principles into practice, but does not replace applicable law. Its acknowledgement states: “I remain responsible for ensuring compliance with all applicable laws, regulations and other legally binding requirements.” Treat AIGE and AICE as governance tools, not as a legal safe harbour.
Does the PDPA apply when a business uses AI?
It may. The PDPA 2010 (Act 709) regulates processing of personal data in connection with commercial transactions within its statutory scope. Whether it applies depends on the facts, including the organisation’s role, the processing, jurisdictional rules, and exclusions. AI use alone does not automatically bring every activity within the Act.
Rank #2
For each AI workflow, map the personal data involved, why it is processed, who determines the purpose, who handles the data on the organisation’s behalf, what the provider does with it, and what notices and security measures apply. Check the current Act, its 2024 amendment, regulator materials, and any relevant sector rules.
What do the PDPA amendments mean for DPOs and breach notification?
The Personal Data Protection (Amendment) Act 2024 includes provisions concerning data protection officer (DPO) appointments and personal-data breach notification. The amendment provides for commencement dates to be appointed by ministerial Gazette notification, which may differ by provision. Do not assume that every provision commenced on enactment.
Rank #3
The regulator lists 2025 circulars and guidance on DPOs and breach notification. A business should consult the active documents and applicable commencement notices to determine its specific duties. The available information does not establish a universal rule that every business using AI must appoint a DPO.
Can a business send personal data to an overseas AI provider?
Overseas hosting, model processing, or a provider’s subprocessors may involve a cross-border transfer of personal data. The regulator’s materials identify PDPA section 129 as governing such transfers and explain that statutory conditions apply; the answer depends on the destination and transfer arrangement.
Rank #4
Before enabling an AI service, trace where data is stored and accessed, identify the provider and any subprocessors, and assess the applicable transfer basis against current official guidance. Review what the provider retains, whether it uses inputs for other purposes, and what contractual and security controls are in place.
