AI Agent Vendor: Require Proof Beyond the Demo

A practical procurement process for testing an AI agent vendor, checking its data and delegated permissions, assessing supplier risk, and negotiating terms before signing.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before signing with an AI agent vendor, verify that the system can handle your specific workflow, that its data and permissions are appropriately bounded, and that the vendor will make key safeguards contractually accountable. Start with your requirements, test the proposed system under controlled conditions, and make the decision against consistent evidence—not a polished demo.

1. Define the job before evaluating vendors

Describe the business process you want to improve before issuing a request for proposals or sitting through demos. This keeps the evaluation focused on the problem rather than on whichever product looks most impressive. The U.S. General Services Administration (GSA) advises buyers to focus on mission requirements rather than particular technologies or vendors; its guidance is written for federal agencies, though the approach can help other organizations too (GSA Buy AI).

Write down the following for the intended use:

  • Task and boundaries: What should the agent do, and what must it not do? Note which steps are advisory and which involve actions such as changing a record or sending a message.
  • Users and systems: Who will use it, and which applications, accounts, or data sources would it need?
  • Acceptable outcomes: Define what a successful result looks like, how errors will be handled, and how much human review is acceptable.
  • Risk of failure: Identify the consequences of a wrong, incomplete, delayed, or unauthorized action. Set stricter review and approval requirements where those consequences are higher.
  • Value and alternatives: State the expected operational benefit and consider whether a less autonomous tool or a process change would meet the need.

Turn these into pass/fail criteria before the vendor evaluation begins. For example, a pilot might need to complete a defined set of representative tasks, flag uncertain cases for review, and avoid taking specified actions without approval. The thresholds should reflect your use case; there is no universal accuracy target that fits every workflow.

2. Run a controlled pilot, not just a demo

Ask shortlisted vendors to work through the same representative tasks under comparable conditions. GSA recommends using testbeds, sandboxes, or pilot programs before a large purchase (GSA Buy AI). Keep the test bounded: use a small group of users, limit access to the systems and data in scope, and avoid live consequential actions unless your organization has explicitly approved them.

Build a test set around real work

  • Include routine cases, incomplete or ambiguous requests, and examples where the correct response is to ask a person for clarification.
  • Test relevant edge cases, such as unavailable source data, a failed integration, or an instruction that falls outside the agent’s assigned task.
  • Use the same inputs and evaluation conditions for each vendor. Record the system configuration and any vendor assistance so differences are interpretable.

Record more than whether the answer looks right

For each task, capture whether the agent completed it correctly, where it failed, whether it made an unauthorized or unsupported assumption, and whether it escalated appropriately. Record how much human checking or correction was needed. If the agent can take actions, note what it attempted, what actually happened, and whether the action can be traced in a log.

Compare these results with the acceptance criteria you set in advance. A strong demo does not establish that the system is reliable enough for production, and a pilot result applies only to the tested configuration and tasks. GSA’s guidance supports testing before a large purchase; the specific test design and evidence log are practical ways to make that testing useful.

3. Trace data through the agent and its providers

Ask the vendor for a clear account of how information moves through the service. An agent may interact with a model, connected applications, logging systems, and other providers; you need to understand the full route, not only the interface your staff sees. GSA advises buyers to ask what data can be shared, how it is protected, where it is stored, and which data types are allowed. NIST’s Generative AI Profile also identifies privacy, security, intellectual-property, and third-party risks as due-diligence concerns (NIST Generative AI Profile).

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Request answers, preferably with a data-flow diagram, for these questions:

  • What information is processed: prompts, uploaded files, retrieved records, agent outputs, logs, and data returned by connected systems?
  • Which locations, services, model providers, subprocessors, or other third parties handle or can access each type of information?
  • Where is information stored, for how long, and what deletion or export process applies when the service ends?
  • What protections apply in transit and at rest, and which vendor personnel or customer roles can access data?
  • Can customer content be used to train, improve, or otherwise develop services? Can that use be disabled, and what terms govern it?
  • What data types are prohibited or require additional approval? How will you be notified of changes to data handling or subprocessors?

Check the answers against your own data classification rules, privacy obligations, and intellectual-property concerns. Do not assume that a general assurance about “secure” processing answers questions about storage, retention, training use, or third-party access.

4. Assess the vendor as part of a supply chain

The supplier’s assurances matter, but so do the services and organizations on which it depends. Request current evidence that is relevant to the scope of your proposed use, and ask how the vendor manages material changes, vulnerabilities, incidents, and continuity. A certification logo or a general security statement is not, by itself, evidence that the particular service configuration meets your requirements.

NIST SP 1326, published July 8, 2026, organizes ICT supplier due diligence around five areas: foreign ownership, control, or influence; provenance; resilience; foundational cyber practices; and supply-chain tiers (NIST SP 1326). Use those areas to structure questions proportionate to your risk:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Provenance and dependencies: Which key components and third parties support the service, and how does the vendor track them?
  • Security practices: What evidence can the vendor provide about its relevant security controls, vulnerability handling, and incident processes?
  • Resilience: How does the service respond to outages or provider changes, and what continuity arrangements are available?
  • Change management: Which changes to models, integrations, subprocessors, or service behavior trigger customer notice or review?
  • Supplier exposure: What ownership, control, or jurisdictional considerations are material to your organization’s risk assessment?

NIST’s Generative AI Profile also recommends risk assessment and monitoring of third parties. The appropriate depth of inquiry depends on the sensitivity of the data and the consequences of service failure; a supplier framework is a way to organize diligence, not a certification of any vendor.

5. Verify the agent’s identity, permissions, and oversight

An agent that can invoke tools or connect to accounts may do more than generate text. If it can update records, send communications, or initiate other actions, evaluate its delegated authority as carefully as its output quality. NIST’s National Cybersecurity Center of Excellence highlights identity, authorization, and governance as important considerations for agents capable of autonomous tasks (NIST NCCoE Agentic AI Identity and Authorization).

Ask your security and application owners to verify:

  • What identity does the agent use in each connected system, and can its activity be distinguished from a human user?
  • Can access be limited to the specific accounts, records, actions, and time period needed for the task?
  • Which actions require human approval, and can approvals be configured around the consequences of an action?
  • What is recorded about requests, tool calls, approvals, errors, and completed actions, and who can review those records?
  • How quickly can access be suspended or revoked, including when a user leaves or an integration is compromised?

During the pilot, test the approval and escalation paths, including when the agent encounters an unexpected instruction or an unavailable integration. Confirm that your team—not only the vendor—knows how to stop the agent and investigate its actions.

6. Make the contract match the evaluated system

Translate the agreed data flow, safeguards, and evaluation expectations into terms that can be checked after signing. Depending on the use case and jurisdiction, discuss data use and deletion, security responsibilities, incident communications, material service changes, access to evaluation evidence, and exit arrangements with counsel and procurement stakeholders.

NIST’s Generative AI Profile recommends contract clauses that allow an organization to evaluate third-party GAI processes and standards. UK government AI procurement guidance likewise recommends defining whether and how data will be shared and carrying relevant requirements into contract terms (NIST Generative AI Profile; UK AI procurement guidance).

Where relevant, make sure the agreement addresses:

  • Which service configuration, integrations, and use case the vendor is providing, and how changes are communicated.
  • What data the vendor and its subprocessors may process, for what purposes, and under what retention and deletion terms.
  • What evidence or cooperation the vendor will provide for your assessments, audits, and incident response.
  • How the vendor will notify you of incidents or changes that could affect your risk assessment.
  • How you can export needed records, revoke access, and end the service without leaving data or integrations unmanaged.

Do not rely on a sales presentation or a pilot configuration as a substitute for contract language. Requirements vary by jurisdiction, sector, data, and intended use, so have qualified counsel adapt the terms to the deal.

7. Bound usage costs and assign ongoing ownership

Estimate costs using expected pilot consumption and plausible production volumes, then agree on a budget and review process before rollout. GSA notes that AI services are commonly billed in a SaaS-like way and recommends usage limits and regular consumption reviews (GSA Buy AI). Ask the vendor how usage is measured, what events generate charges, how you can monitor consumption, and whether limits or alerts are available.

Assign named internal ownership for monitoring performance and incidents, reviewing consumption, reassessing risk, approving new use cases, and evaluating vendor or service changes. An agent that performed acceptably in one workflow should not automatically receive new data access or authority for a different task.

8. Compare finalists on the same evidence

If more than one vendor remains, use the same test conditions and evidence requests for each. Weight the criteria according to the consequences of failure in your planned use, rather than treating every dimension as equally important. The comparison below is a practical synthesis of procurement and risk guidance, not a published ranking or a claim that any vendor has passed these checks.

Evaluation area Evidence to compare Decision question
Workflow performance Results on the same representative pilot tasks; errors, escalations, and review effort Does it meet the acceptance criteria for this use case?
Data handling Data-flow description, access, storage, retention, deletion, and third-party processing Does the handling fit your data rules and obligations?
Supplier and service resilience Relevant security evidence, dependencies, vulnerability and incident handling, continuity, and change notice Can you understand and manage the supplier and service risks?
Agent authority Identity, permission scope, approval behavior, logs, and revocation Can the agent act only within acceptable bounds, with sufficient oversight?
Contract and exit Commitments on data, evidence, changes, incidents, and service termination Are important safeguards verifiable and workable after signing?
Integration and operating cost Integration effort, consumption measurement, budgets, alerts, and usage controls Can the organization operate the service sustainably?

For each area, record the evidence received, unanswered questions, internal owner, and the consequence of any unresolved issue. Treat a missing answer as an open diligence item rather than silently assuming the vendor meets the requirement. If a critical criterion cannot be satisfied or verified, pause, narrow the use case, add controls, or choose not to proceed.

What the guidance can—and cannot—establish

GSA’s procurement advice is aimed at U.S. federal agencies, and UK guidance applies in its procurement context; their practical methods can inform other buyers but are not automatically private-sector requirements. NIST’s AI Risk Management Framework materials are voluntary guidance. None of these sources verifies a particular vendor’s claims or replaces legal, privacy, security, or procurement review for your organization. Use them to structure questions and evidence requests, then make the decision against your own obligations and risk tolerance.
