As of October 3, 2026, the reported federal restriction on intoxicating hemp-derived THC products was scheduled to take effect December 11, after a funding measure delayed the earlier November 12 date. Hemp businesses and their allies are pressing for alternatives; the $28.3 billion at stake is a projection of threatened retail revenue, not money already lost.
What the reported federal change would do
The Associated Press reported on October 3, 2026, that a federal change to the definition of hemp could sharply restrict intoxicating products made from hemp. Under the 2018 Farm Bill definition described by AP, hemp was distinguished by a delta-9 THC concentration below 0.3% by dry weight. AP says that test allowed some products to contain intoxicating amounts of THC while still meeting the percentage threshold.
AP describes the later federal change as setting a limit of 0.4 milligrams of THC per container. A September 2026 analysis by Cannabis.Inc says the revised definition also counts total THC, including THCA. The exact statutory text has not been independently examined here, so those details are best understood as descriptions in reporting, not a product-by-product legal determination.
A limit per container is not the same as a limit per serving. As described by AP, 0.4 milligrams applies to the container; it should not be mistaken for an allowance of 0.4 milligrams in each gummy or drink serving. The reported threshold is low enough that AP says many intoxicating hemp-derived products could be eliminated from the market, but the reporting does not establish the legal status of every formulation or product.

How large is the projected economic exposure?
Whitney Economics estimated that the restriction could threaten $28.3 billion in retail revenue, displace 225,000 jobs, and reduce potential state sales-tax revenue by $2.1 billion. AP reported those projections from a Whitney Economics report released the prior month. They are forecast impacts, not observed losses or a directly measured census of intoxicating hemp THC sales.
Whitney Economics’ pressroom lists its September 2026 U.S. Hemp Cannabinoid Report, establishing the report’s publisher and release timing; the pressroom listing does not expose the methodology or full calculations. The estimates therefore describe the report’s projected exposure, not a settled prediction of what will happen if the restriction takes effect.

Why businesses are fighting it
Small producers are weighing whether to keep going
AP reported that Nicholas Hohns, who runs Deutermann Farms in Clayton, North Carolina, makes THC and CBD gummies. He said he entered the business expecting a limited window and kept investment low because he feared a shutdown. He had considered making creatine gummies instead. Those comments describe his plans at the time of AP’s reporting, not a confirmed later change in the farm’s business.
AP also reported that Drinkin’ Buds, a beverage company in Sheboygan, Wisconsin, had mothballed production and that co-founder Matt Swanson had removed himself from payroll. These are snapshots from the October 3 report, not confirmation of the company’s current operating status.

A larger hemp company is proposing a compromise
Cornbread Hemp’s owners, Eric Zipperle and Jim Higdon, told AP they would consider a five-milligram product cap to win support, while arguing that the reported 0.4-milligram container cap would destroy their business. The five-milligram figure is their proposed compromise, not an adopted federal standard.
AP reported the company had 105 employees, sold hemp beverages in 18 states, and expected $65 million in revenue in 2026. Those are company figures or AP-reported expectations, not independently audited outcomes. Zipperle told AP: “If it goes through in December, this place is toast — it’s gone.”

What alternatives are being discussed?
Industry advocates and some lawmakers have discussed ways to regulate intoxicating products rather than impose the broad restriction AP describes. The options reported are not one settled industry plan, and the available reporting does not provide bill-by-bill text or a complete comparison of their requirements.
| Approach | What the reporting says | What is not established |
|---|---|---|
| Reported federal restriction | AP describes a 0.4-milligram THC limit per container. | The exact statutory construction and product-by-product application are not independently verified here. |
| Age restriction | Some advocates and lawmakers have proposed limiting access to people 21 and older. | The reporting does not specify a single adopted enforcement or retail framework. |
| Package-dose cap | Some advocates and lawmakers have proposed a per-package limit; Cornbread Hemp’s owners said they would consider five milligrams. | The five-milligram figure is a company owners’ possible compromise, not a settled proposal or enacted limit. |
| Imported-compound ban | A ban on imported cannabis compounds is among proposals mentioned by AP. | The reporting does not establish the precise compounds or legal mechanism such a proposal would cover. |
These approaches raise different regulatory questions: which products and compounds are covered, whether a limit applies per serving or package, what testing and labeling are required, and whether interstate sales are allowed. The reporting does not supply enough detail to judge how a complete alternative framework would work or how its economic effects would compare.

Who supports the restriction, and why?
Public-health opponents
Kevin Sabet, CEO of Smart Approaches to Marijuana, told AP: “I have sympathy for people losing their jobs, but I also have sympathy for the many, many more people whose lives are affected by this.” His organization opposes the hemp THC market. The quoted position conveys concern about public effects; it is not, by itself, evidence that every product caused a particular harm.
State-legal cannabis operators
AP reported that regulated cannabis operators support the restriction and see hemp THC sellers as unfair competition. Cory Harris, a lobbyist for state-legal cannabis operators, argued that projected damage could be overstated if products can still be sold in legal in-state markets under state rules. That is a stakeholder argument, not an independently validated forecast or a guarantee that products could transition into those markets.
Retail allies
AP identified alcohol retailer Total Wine & More among allies of the hemp THC industry, reporting that cannabis seltzer sales helped offset falling alcohol sales. The report does not establish how much of the retailer’s sales or revenue those products represented.
What happens next?
The December 11, 2026, effective date was the date reported by AP on October 3, after a short-term funding measure moved it from November 12. Congress could still consider alternatives, so the schedule and policy remained subject to change at the time of publication. This is a developing federal policy issue; the reporting does not establish what later legislative or enforcement action will occur.
