In practical use, “leak” often highlights information escaping to an unauthorized audience—sometimes by accident—while “breach” is the broader incident label. To understand what happened, look past the label: identify who could access the information, whether access was authorized, how the exposure occurred, and whether anyone actually accessed it.
What is the difference between a data breach and a data leak?
“Data breach” is commonly used for an incident in which information is accessed, acquired, disclosed, or otherwise placed beyond authorized control. A “data leak” often emphasizes the exposure or release of information to people who should not have it, including when that exposure is accidental. These are useful descriptive tendencies, not a universal technical or legal boundary.
The overlap is explicit in authoritative terminology. NIST’s glossary definition of a breach includes unauthorized disclosure, and CISA’s NICCS glossary lists “data leakage” as a synonym for “data breach.” NIST also notes that glossary terms can vary by source document and context; its definitions should be read in the context of the source cited on the glossary entry.
Authorization is the key question in either case. NIST’s breach definition encompasses loss of control, compromise, unauthorized disclosure or acquisition, and actual or potential access by an unauthorized person. It also includes an authorized user accessing information for an unauthorized purpose. So an incident need not involve an outside hacker—or even confirmed viewing—to warrant careful investigation.

How to describe an exposure accurately
Instead of treating “breach” and “leak” as competing verdicts, describe the facts along these dimensions. They help clarify what happened; they do not replace the legal test that may apply.
- What happened to the information? Was it disclosed or acquired, or was it only at risk of exposure?
- Who could access it? Was the recipient authorized to see the information, and did an authorized user access it for a legitimate purpose?
- How did the exposure occur? Was it deliberate, such as theft by a hacker or insider, or accidental, such as a website configuration that made information publicly accessible?
- Is access confirmed or only possible? A system may have exposed information without evidence that anyone viewed or copied it. State that distinction rather than assuming either outcome.
- What information and whose information were involved? Identify the data types, approximate scope, and people affected as the facts become known.
NIST defines inadvertent disclosure as a type of incident involving accidental exposure of information to an individual not authorized to access it. That definition makes clear why “leak” is not limited to malicious releases: accidental exposure can still put information in front of an unauthorized person.

Examples: the cause does not decide the label
The Federal Trade Commission’s business guidance discusses incidents involving hacker theft, insider theft, and inadvertent exposure through a website. Each may be described as a breach, a leak, or both, depending on the speaker and context. The underlying facts matter more than choosing one word.
- Stolen credentials or a cyberattack: An unauthorized person accesses or copies data. This is commonly called a data breach; it may also be called a leak when the emphasis is on information escaping to an unauthorized audience.
- An employee shares a file with the wrong recipient: The disclosure may be accidental, but the recipient was not authorized. “Leak” can convey the way the information escaped; “breach” may describe the incident more broadly.
- A public-facing system exposes private records: A configuration error can make information available to unauthorized visitors even without evidence of malicious action. Say whether exposure was possible and whether access was confirmed.
- An authorized user accesses records for an unauthorized purpose: The person may have valid system credentials, but the purpose or use is not authorized. Access permissions alone do not settle whether the incident is a breach.
What should an organization do if information may have been exposed?
The FTC’s guidance for businesses says response steps depend on the incident and the organization. Its general approach is to contain the issue, establish what happened, and notify appropriate parties without making misleading statements or releasing details that could increase consumer risk.

- Secure operations and address the vulnerability. Stop ongoing exposure where possible, preserve the ability to investigate, and fix the weakness that allowed the incident.
- Bring together appropriate expertise. Depending on the circumstances, the response team may include IT and security staff, legal counsel, communications staff, and independent forensic investigators.
- Determine what information and people are affected. Establish what data was involved, who could access it, whether access or acquisition is confirmed, and which individuals or organizations may be affected.
- Notify appropriate parties. The FTC identifies law enforcement, affected businesses, and affected individuals as possible recipients of notification, as appropriate to the incident.
- Communicate carefully. Be accurate about what is known and what remains uncertain. Avoid misleading claims and avoid publishing details that could make it easier for someone to exploit the exposure.
For technical teams, NIST SP 1800-29 is an organizational guide focused on detecting, responding to, and recovering from data breaches; its final publication date is February 2024. It is a deeper technical resource, rather than a substitute for an organization’s incident-specific legal and operational decisions.

Do not infer legal obligations from whether an incident is called a breach or a leak. The terminology alone does not establish a notification deadline or a reporting duty. Requirements can depend on jurisdiction, industry, the type of information, and the incident’s facts. The FTC’s business guide offers general U.S. federal response guidance, not a complete account of every jurisdiction’s current legal duties. Organizations should assess the rules that apply to their circumstances with qualified legal counsel.
