This guide uses the U.S. federal Fair Labor Standards Act (FLSA) as its baseline. It is not a universal rulebook: state and local laws may provide stronger protections, and the answer in an individual case can depend on location, job coverage, worker classification, and the actual work arrangement. The U.S. Department of Labor (DOL) provides the federal guidance discussed here; check current DOL and state labor agency information for a specific dispute.
What counts as work time under federal law?
Under the FLSA’s “suffer or permit to work” principle, time an employer allows an employee to work generally counts as work time, even if the employer did not specifically request it. Whether particular waiting, travel, training, or other time is compensable depends on the circumstances.

Does work before or after my scheduled shift count?
It can. Job-related work an employer allows before or after a scheduled shift generally must be counted. A scheduled shift does not necessarily mark the beginning and end of the workday.

When does the workday begin and end?
DOL guidance describes the workday as beginning with the employee’s first principal activity and ending with the last. As a result, the workday can be longer than the posted shift when work activities occur outside it.

Is waiting at work for an assignment paid?
Generally, an employee who is on duty and waiting for an assignment is “engaged to wait,” so the time counts as work time.
Is time spent waiting for broken equipment to be repaired paid?
It generally counts when the employee remains on duty waiting for the equipment to be repaired. The circumstances matter, including whether the employee was actually relieved from duty.
Is a break unpaid if I am free to use it for personal purposes?
A period may be nonworking time when the employee is fully relieved for a sufficient period and can use the time effectively for personal purposes. Merely having no task at that moment does not by itself establish that the employee was off duty.
Does at-home on-call time count as work?
It depends on the restrictions the employer imposes and whether the employee can use the time effectively for personal purposes. The label “on call” alone does not determine whether all or part of the time is compensable.
Is time spent responding to an on-call call paid?
Time spent responding to calls is work time. Other on-call hours depend on the restrictions and circumstances of the arrangement.
Does my ordinary commute count as work time?
Travel from home to an employee’s regular worksite and back is generally ordinary commuting, not work time under the federal baseline.
Is travel between job sites during the day paid?
Travel between job sites during the workday generally counts as work time. This is different from an ordinary commute to or from the regular worksite.

Does travel for a one-day assignment count as work?
Special one-day assignments have distinct travel rules. The general commute rule is not enough to determine the answer; consult the DOL’s hours-worked guidance and the applicable state or local rules for the details.
Does overnight business travel count as work time?
Overnight travel has separate rules, so it should not be treated automatically as either all paid or all unpaid. The result depends on the travel circumstances and applicable rules; DOL’s hours-worked guidance addresses these situations.
Is job training always unpaid?
No. Training may be excluded from work time only when applicable criteria are met; the fact that an activity is called “training” does not settle the question.
When can a lecture or meeting be excluded from work time?
DOL guidance considers whether the activity is outside normal hours, voluntary, not job-related, and does not involve concurrent work. If those criteria are not met, the time may need to count as work.

Work the employer suffers or permits generally must be counted even if the employee was not asked to perform it. An employer’s timekeeping or approval policy does not by itself answer whether work actually allowed must be counted.
Does federal law require my employer to provide a lunch break?
The FLSA generally does not require meal breaks for most workers. State or local law may impose a meal-period requirement.
Does federal law require rest breaks?
The FLSA generally does not require rest breaks for most workers. Check the rules where you work because state or local requirements may differ.

When an employer provides short rest breaks, those breaks are generally paid and counted as work time. DOL’s breaks guidance describes short breaks as usually 5 to 20 minutes.
When can a meal period be unpaid?
A bona fide meal period is generally unpaid only when the employee is completely relieved from duty. DOL describes a typical meal period as at least 30 minutes; the length alone does not make a break unpaid.
Does answering a work call during lunch make the time paid?
It can. An employee who must answer calls or perform other tasks during a meal period may not be completely relieved from duty, which is a key condition for treating the period as unpaid.
Can my state require breaks even if federal law does not?
Yes. State and local laws can require meal or rest periods even where the federal FLSA does not. The applicable location matters.
What break rules apply when an employee needs to express breast milk?
The general meal- and rest-break rules do not cover the full set of protections for nursing employees. DOL directs workers to separate federal guidance on expressing breast milk; check that current guidance and applicable state law for the rules that apply.
Who is entitled to federal overtime?
The general FLSA overtime rule applies to covered, nonexempt employees. Coverage and exemption status matter; a job title or salary alone does not establish that an employee is exempt.
How many hours can I work before federal overtime is due?
For covered, nonexempt employees, the federal threshold is more than 40 hours worked in a workweek. Special rules and state law can affect the result.
How much is federal overtime pay?
The FLSA requires at least one and one-half times the employee’s regular rate for covered, nonexempt hours over the federal threshold. The regular rate is the relevant basis, not simply a comparison with the employee’s stated salary.
Can my employer average two workweeks to avoid overtime?
No. Federal overtime is calculated by workweek, not by averaging hours across multiple weeks. A workweek is a fixed, regularly recurring period of seven consecutive 24-hour days.

No. Under the federal baseline, the day of the week does not by itself trigger overtime; the relevant question is whether the employee worked beyond the applicable threshold in the workweek.
Does working on a holiday automatically mean overtime?
No. The FLSA does not require premium pay just because work occurs on a holiday. Overtime may still be due if the employee works beyond the applicable workweek threshold.
Is work on my scheduled day off automatically overtime?
No. A scheduled day off alone does not determine federal overtime eligibility; total hours worked in the workweek and any more protective applicable rule are what matter.
Does being paid a salary mean I am not owed overtime?
No. Salary alone does not eliminate overtime eligibility. Whether an employee is exempt depends on the applicable classification rules and the actual circumstances, not just the pay format.

Yes. DOL identifies exceptions to the ordinary overtime rule for some public agency police and fire employees. The exception is not a blanket rule for every public safety job; the specific employment arrangement matters.

DOL identifies certain hospital and nursing-home employees among the situations with special overtime rules. Whether an exception applies depends on the employee and work arrangement.
What if state overtime law is more generous than federal law?
When both federal and state overtime laws apply, DOL says the employee receives the standard that gives the higher pay. The applicable state rule must be checked for the worker’s location and situation.
Can an employer require an adult to work long hours?
The FLSA generally does not cap the daily or weekly hours that employees aged 16 or older may be required to work. Other laws, agreements, or occupation-specific rules may impose limits.
Are there different work-hour limits for minors?
Yes. Youth employment restrictions apply to minors, so the general rule for employees aged 16 or older should not be applied to younger workers. The relevant age and work circumstances determine which restrictions apply.
Does federal law define full-time employment?
No. The DOL’s FLSA FAQ states: “The FLSA does not define full-time employment or part-time employment.”
Does federal law define part-time employment?
No. For general employment purposes, federal law does not supply a universal full-time or part-time definition. An employer generally determines these labels, subject to applicable agreements or other laws.
Can my employer change my schedule without notice?
As a federal baseline, the FLSA generally has no ordinary scheduling or advance-notice provisions, apart from some child-labor provisions. Other applicable rules or agreements may change the answer.

Can a contract or workplace agreement limit schedule changes?
Yes. Contractual terms and other applicable laws can matter even where the FLSA itself does not generally regulate ordinary scheduling or advance notice.
What time and pay records must an employer keep?
DOL guidance says employers must keep employee time and pay records. Recordkeeping requirements apply to the employer; a worker’s personal log is not a substitute for the employer’s records.
Should call-center work before or after a shift be recorded?
DOL specifically describes recording call-center workers’ daily and weekly hours, including job-related activities before and after the shift. The scheduled shift is not necessarily the full span of work performed.
Should I keep my own record of shifts and breaks?
A personal notebook or spreadsheet can help organize notes about hours and breaks. It is optional and does not replace the employer’s required records or, by itself, establish that the employer complied with the law.
Is there a free app to track work hours?
DOL describes its free DOL-Timesheet App as a way for workers to track regular work hours, breaks, and overtime.
Where can I report a possible federal overtime or minimum-wage violation?
Workers can contact the DOL Wage and Hour Division about potential federal minimum-wage or overtime violations. The agency is the federal contact for these FLSA concerns.
Does the federal Wage and Hour Division handle every workplace pay dispute?
No. Federal enforcement does not cover every disagreement about promised wages, leave, breaks, or final pay after termination. Depending on the issue, a state labor agency or another authority may be the appropriate contact.
