Can an Indian radio station play copyrighted music on YouTube Live? Only if it has the necessary rights for that YouTube livestream; a terrestrial radio licence should not be assumed to cover it. The station may need permission covering both the musical composition and the particular sound recording, the intended territories and any archived replay. Even with permission, YouTube may interrupt a stream if the rights owner has not allowlisted the channel. Whether India’s section 31D statutory broadcasting licence applies to a YouTube simulcast is not settled by the sources cited here, so stations should confirm the position with the relevant rights holders and Indian copyright counsel before going live.
What YouTube requires of a radio station
YouTube’s livestream terms require the provider to represent that it has the rights needed to exploit the live content on Google services worldwide, including music licensing rights from artists, record labels, publishers and other royalty participants. This is a platform requirement; it does not determine who controls a particular Indian song or settle which Indian legal licensing route applies. Read the YouTube livestream terms and conditions.
YouTube scans live streams for third-party content. When it detects material, it may show a placeholder and warning; if the material remains, it may interrupt or terminate the stream. A licence by itself may not prevent an interruption if the relevant owner has not added the exact channel to its Content ID allowlist. Which music rights need checking?
A song in a radio playlist can involve separate rights in the underlying musical work and lyrics, and in the sound recording being played. The Government of India’s Copyright Office handbook explains that use of a sound recording may involve licences for both the public performance of the music and the recording, where the relevant societies represent those works. The exact rights holders and repertoire vary; neither a society’s licence nor a station’s existing permission should be presumed to cover every track or use. IPRS describes licensing for musical-work rights in its repertoire and says platforms using music, including radio and online streaming services, need to secure a licence for that repertoire or pay the author’s royalty share for its author members. Its guidance distinguishes those rights from sound-recording rights, which may be obtained from owners or administrators such as PPL, Novex or RMPL. PPL India describes licences for sound recordings in its repertoire and lists annual background and event public-performance licence types. These organizations’ descriptions do not establish that a particular licence clears a YouTube simulcast. Check the authority and scope track by track with the relevant owner or administrator. Does an Indian radio licence or section 31D cover YouTube Live?
Do not assume that a terrestrial broadcast permission automatically clears a YouTube livestream. The Copyright Act, 1957 defines “broadcast” to include communication to the public by wireless diffusion or by wire, and defines “communication to the public” broadly to include making works available for the public to hear or otherwise enjoy. Those definitions are relevant to online availability, but they do not, on their own, determine which licensing route covers a radio station’s YouTube simulcast. The relevant provisions appear in the Act’s Chapter I, Chapter III and Chapter VI.

Section 31D provides a statutory licence framework for broadcasting certain already-published literary and musical works and sound recordings, subject to the section’s requirements. Rule 29 of the Copyright Rules, 2013, Chapter VIII describes notice and royalty steps. The material cited here does not establish that section 31D clears a YouTube livestream. A music-industry submission to TRAI dated 29 October 2024 argues that the statutory regime is limited to radio and television broadcasting; that is a stakeholder’s position, not a controlling court ruling. The sources cited here do not establish a current controlling judicial decision on the specific YouTube-simulcast question. Do not treat section 31D as definitely applicable or definitely inapplicable without current, case-specific legal advice.
Before going live: a rights and platform checklist
- Inventory the music. Identify each composition and recording in the planned rotation, then establish who controls or administers the relevant rights. Do not infer control of all repertoire from a society’s general description of its work.
- Get written confirmation for the exact use. Ask each relevant rights holder or authorized administrator whether its permission covers a YouTube livestream or simulcast, the station’s channel, the intended territories, the relevant repertoire and any archived replay. A terrestrial-broadcast-only permission is not an answer to those separate questions.
- Resolve the section 31D question for your circumstances. Have Indian copyright counsel assess the Act, Rule 29, current case law and the station’s particular use before relying on a statutory route. Confirm any applicable notice, reporting and royalty obligations rather than assuming they are satisfied by another licence.
- Arrange allowlisting before the broadcast. Ask the relevant owner to add the exact YouTube channel to its Content ID allowlist where available, and retain written confirmation. YouTube warns that a licensed stream can still be interrupted if the channel is not allowlisted.
- Choose what happens to the replay. Confirm that the archive and on-demand viewing are covered. If they are not, disable the archive or otherwise avoid making an uncleared copy available.
- Keep an evidence file. Retain the licences, track or repertoire scope, territory and platform terms, allowlist confirmation, notices and royalty records relevant to the broadcast.
Music that is labelled “free” is not automatically cleared
YouTube recommends using music that is in the public domain or used with the copyright owner’s permission. It cautions that a “free” label does not prevent Content ID detection. YouTube’s Creator Music guidance describes tracks as restricted to long-form videos rather than livestreams, so a Creator Music listing should not be treated as livestream permission. What to do if YouTube warns, interrupts or claims the stream
- Warning or placeholder during the live broadcast: YouTube may have detected third-party content. Check the stream status in YouTube Studio and follow the platform’s notice; do not assume that a licence will prevent interruption.
- The station has permission but the stream is interrupted: Confirm with the relevant rights owner that the exact channel was allowlisted. Preserve the owner’s response and permission documents.
- Claim on the archived livestream: Check whether the permission covers the saved copy and on-demand playback. If it does not, disable or remove the archive as appropriate to the rights obtained, and contact the claimant or rights holder to clarify the claim.
- A track was described as free or appeared in Creator Music: Recheck the terms for that specific track and use. A free label is not a Content ID exemption, and Creator Music tracks described in YouTube’s guidance are not licensed for livestreams.
For unresolved claims, use YouTube’s available claim or dispute process only when the station can support its position with the relevant rights documentation. A platform claim process does not replace obtaining the underlying permissions.
