There is no evidence-based yes-or-no answer to whether families should keep an AI version of someone who has died. The most responsible answer starts with the represented person’s wishes and the family’s boundaries: what material may be used, what the system can say or do, who can access it, and how it can be stopped. If you are deciding for yourself, make those choices explicit while you can. If you are deciding for a loved one, possession of their recordings or messages is not proof that they wanted an interactive simulation.
First, decide what “an AI version” means
Posthumous AI services are not all doing the same thing. In a 2024 article in Philosophy & Technology, researchers use “deadbot” for an AI-enabled digital representation of a deceased person created by a re-creation service. That broad term can obscure an important difference: some systems retrieve recordings, while others generate new responses.

These examples describe formats reported by AP in June 2024, not a current endorsement or guarantee of any provider’s features. A particular service’s controls and policies can change; check its current terms rather than assuming that a format answers questions about consent, privacy or access.

Whose wishes and boundaries count?
The represented person and the people who interact with a simulation are different stakeholders. The 2024 Philosophy & Technology article examines the interests of data donors, people who hold or supply data, and people who use the resulting systems. Its ethical analysis is a way to identify questions, not a measurement of how often harms occur.

A relative may hold someone’s messages, photographs or voice recordings, but that does not establish that the person wanted those materials used to build an interactive likeness. Nor does one family member’s wish to speak with a simulation settle whether other relatives want it in their lives. Consent should cover both the material used and the kind of experience created, rather than being inferred from access to a device or account.
- The person represented: Did they agree to any simulation? Which materials and subjects did they allow or exclude? Did they want recorded answers replayed, or newly generated speech or text?
- The people who may interact: Who wants access, who does not, and can a person decline without being pressured by other relatives?
- The person managing the files or service: Who controls access and can pause or end it? Do they have authority to make those choices under the relevant service terms and applicable local law?
If the person never agreed, the family faces a real ethical uncertainty even if it has access to the data. Whether particular files, likenesses or accounts may legally be used depends on jurisdiction and circumstances; the sources discussed here do not establish one legal rule that applies everywhere.

What evidence can—and cannot—say about grief
It would be misleading to promise that talking to an AI version of a loved one will heal grief, make it worse or replace grieving. AP’s June 2024 report quoted Cambridge researcher Katarzyna Nowaczyk-Basinska describing the field as “a vast techno-cultural experiment.” She and Tomasz Hollanek also said, “These are very complicated questions. And we don’t have good answers yet.” Their comments reflect uncertainty, not a clinical verdict about what any one family will experience.

The 2024 ethics article discusses risks such as privacy loss, damage to dignity, misrepresentation of identity, intrusive interaction and unwanted continuing contact. It uses scenarios, including reminders from a deadbot, to explore potential design problems; those scenarios do not show how often such events happen. The available evidence does not establish the effects of using these systems at scale.
If you are planning your own digital legacy
Write down choices in plain language and tell the people who may eventually manage your files. These are practical prompts drawn from scholarship on consent, transparency and stakeholder interests—not a clinical protocol or a substitute for legal advice.

- Choose the kind of legacy: Would you allow only a static archive, an interface that retrieves recordings, or a system that generates new words in your voice? You can also say you want no posthumous simulation.
- Set boundaries on material: Identify which recordings, messages, photographs or stories may be used, and which should stay private. State whether material from other people may be included.
- Name the audience: Specify who may access the system and whether anyone else can invite additional users.
- Require clear disclosure: Decide whether every interaction must make clear that it is a simulation and distinguish recorded answers from generated responses.
- Set contact rules: Decide whether the system may initiate messages, notifications or reminders. Identify how an individual can opt out of those contacts.
- Decide who can stop it: Name who may pause or end access, and record what should happen to the underlying data if the service closes or the family no longer wants to use it.
A service’s design may not support every preference. For example, Afterlife AI’s official FAQ describes a model in which living adults prepare their own digital legacy and the company says it does not reconstruct deceased people from data supplied after death. That is the provider’s description of its own policy, not independent verification or a rule that applies to other services.

If your family is considering one now
Before creating or using a simulation, discuss the decision without assuming that everyone will want the same thing. A short family agreement can clarify expectations, even though it cannot resolve every legal or emotional question.

- What did the person say or document about posthumous AI, and what remains unknown?
- Are family members comfortable with the source material being used, not just with having access to it?
- Will the system retrieve something the person actually recorded, or generate new responses? Can users tell which is happening?
- Who will be allowed to interact with it, and can relatives refuse access or opt out of notifications?
- Who can pause or retire the system, and what happens to its data and access if the service ends?
If the person’s wishes are unknown or relatives disagree, choosing a non-interactive archive—or waiting rather than creating a simulation—avoids making an irreversible assumption about what the person would have wanted. A family can still preserve recordings and stories without presenting generated conversation as the person’s own words.
