In the United States, a work-zone speed limit is enforceable when the state or local road authority posts it as a regulatory limit or activates an authorized variable-speed display. There is no single national work-zone speed, fine, rule that the limit ends whenever workers leave, or requirement that every penalty be doubled. The controlling details come from the agency with jurisdiction over that road, the signs and displays in place, and that state’s current law.
Who sets a work-zone speed limit?
The Federal Highway Administration (FHWA) summarizes the division of authority this way: “The Federal Government does NOT set or enforce speed limits; this authority belongs to the State and local agencies that have jurisdiction over the road.” A state transportation department, county, city, or another legally authorized road agency therefore decides how a particular work zone is regulated. Police and courts enforce the applicable state or local law; FHWA does not issue a nationwide ticket schedule.

FHWA guidance treats the reduced speed as part of the project’s traffic-control plan. Engineers select a limit after considering the road’s normal posted speed, how close workers are to moving traffic, the type of traffic control being used, and the complexity of the work area. A lane shift, narrowed lane, temporary barrier, unusual merge, or poor sight distance can justify a different limit from a straightforward shoulder repair on the same route.
Because the decision is local, two projects in different states—or two phases of one project—can use different limits and enforcement arrangements. The number on the sign in front of you, not a general rule you remember from another state, controls your driving.

Which signs actually establish the limit?
Regulatory speed-limit signs
A regulatory sign gives notice of a traffic law or regulation. A posted speed-limit sign is the clearest example: it states the maximum lawful speed for the road section covered by that sign, subject to the jurisdiction’s rules. If a work-zone speed-limit sign lowers the normal limit, treat the lower number as the enforceable limit once you enter the section it governs.
Warning signs
Orange work-zone signs warn about conditions such as workers, lane closures, shifting lanes, or a detour. They are important instructions about what you are about to encounter, but an orange warning sign by itself does not necessarily create a new numerical speed limit. Look for the separate regulatory speed-limit sign or an active regulatory display.
Changeable-message and variable-speed displays
Changeable-message signs communicate information that can change frequently or apply only to a short-term or current condition. Where an agency is authorized to use a variable speed-limit system, the number shown on the active regulatory display is the condition-dependent limit. FHWA identifies work zones, congestion, incidents, and weather as situations in which variable limits can manage changing risk, smooth speed differences, and warn drivers about slowed or stopped traffic ahead.

How agencies choose the number
A work-zone limit is not selected from one national table. The traffic-control plan for the project evaluates the existing posted limit and the hazards created by construction. FHWA lists four central considerations:
- Existing speed: The normal regulatory limit on the road before work begins.
- Worker exposure: Where employees are positioned in relation to live traffic and how much protection separates them from vehicles.
- Traffic-control method: Barriers, cones, flaggers, lane closures, alternating traffic, and other controls expose drivers and workers to different risks.
- Geometric and operational complexity: Lane shifts, narrowed lanes, temporary alignments, ramps, merges, limited sight distance, and changing traffic patterns can require more speed reduction.
The resulting limit can be lower than the normal road speed, but it is still tied to the specific section and work arrangement described in the plan. A project may use one limit through a lane shift and another after traffic returns to its ordinary alignment.
Where does the reduced limit apply?
FHWA’s work-zone handbook says speed-limit signs should be erected only for the section where a reduction is necessary for safe traffic operation and protection of construction personnel. That means the limit is normally bounded by the signs that introduce, continue, and end or replace it. It is not automatically a blanket reduction for every mile of a highway project.

As you drive, identify the first regulatory work-zone speed sign or active display, then watch for later signs that change the number or end the restriction. Continue obeying the applicable limit until an ending sign, a new regulatory limit, or another legally controlling instruction takes effect. If signs are missing, obscured, contradictory, or apparently out of sequence, slow down, follow the most protective clearly visible instruction, and report the condition to the road agency when it is safe to do so.

Does the limit apply when workers are not visible?
There is no nationwide answer that a posted work-zone speed limit expires whenever workers are not visible or have left for the day. The existence of a regulatory sign and the conditions for a special penalty are separate questions. A road can remain under a posted construction limit while equipment, barriers, temporary geometry, or an unfinished surface still creates the hazard the plan addressed.
Some laws or enforcement programs may attach an enhanced penalty or camera activation to workers being present. Those conditions must be checked in the state statute or official program rules; they should not be generalized to every work zone. Visibility is also an unreliable test: workers may be behind a barrier, around a curve, in another part of the project, or temporarily away while the altered roadway remains in place.
Washington illustrates the distinction. In a 2026 notice titled “Speed camera fines to increase in work zones beginning July 1,” the Washington State Department of Transportation (WSDOT) said its cameras record speeding vehicles only when work crews are present at the job site. That is an operating condition for that camera program. It is not evidence that every posted work-zone limit in Washington—or anywhere else—ceases to apply when workers cannot be seen.

Not automatically across the United States. The reviewed federal guidance does not establish one national fine, one universal doubling rule, or one nationwide definition of when an enhancement applies. State legislatures set penalties, and local authorities may have additional procedures within their legal authority. The amount can depend on the state, the road type, the recorded speed, the presence of workers, the type of enforcement, and whether the violation is handled as a moving citation or under a camera statute.

FHWA’s North Carolina best-practice archive describes a state program with an increased work-zone fine that required State Traffic Engineer approval. That example shows how a state can create a special process; it is a historical program example, not a current national rule or a reliable statement of today’s North Carolina amount.
For a real ticket, use the jurisdiction printed on the citation and consult the current statute, transportation-department guidance, or court information for that location. Do not rely on a social-media claim that every work-zone ticket is doubled, or that a worker-presence exception applies everywhere.

FHWA identifies several approaches that agencies can combine. They are implementation choices, not options available in every state:
- Police enforcement: Law-enforcement officers observe speeds and issue citations under the state’s ordinary traffic law and any work-zone enhancement.
- Automated enforcement: A statutory camera system records a vehicle and the alleged violation. Such systems commonly require advance warning signs and have their own notice, evidence, review, and payment or contest procedures.
- Speed-advisory systems: Electronic signs provide current guidance or warnings, sometimes alongside a separate regulatory limit.
- Variable speed limits: An agency changes the displayed regulatory number as traffic, weather, incidents, or work activity changes.
WSDOT says its work-zone camera system provides advance warning signs and captures vehicle and violation details when a vehicle exceeds the posted limit. Its 2026 announcement supplies the crews-present condition but does not, in the available material, establish a reliable exact fine schedule. Check the current WSDOT program page and controlling Washington law before relying on any dollar figure.

Static signs, variable displays, and enforcement: what differs?
| Control or practice | What the driver receives | Important limitation |
|---|---|---|
| Static regulatory speed sign | A posted numerical limit for the road section covered by the sign | The state or local road authority determines the number and legal effect |
| Variable speed-limit display | An active numerical limit that can change with work, congestion, incidents, or weather | Only applies as authorized and while the displayed condition is in operation |
| Law-enforcement officer | Direct observation and a citation under applicable law | Enforcement and any enhancement depend on the jurisdiction |
| Automated work-zone camera | Recorded vehicle and violation details, generally with advance warning signs | Activation, worker-presence rules, notice, and fines are program-specific |
A practical driving procedure
- Scan early. Look well ahead for lane-closure, merge, worker, and speed-limit signs. Construction vehicles and barriers can block a sign if you wait until the last moment.
- Separate warning from regulation. Treat orange warnings as hazard information, then locate the numerical regulatory sign or active speed display.
- Reduce before the work area. Reach the posted limit before entering the narrowed lane, shift, or queue. Braking late can create a larger collision risk.
- Hold the applicable number. Keep your speed at or below the regulatory limit for the section, allowing extra margin for wet pavement, queues, workers, or limited sight distance.
- Recheck every change. Temporary alignments can contain a second limit, a flashing condition, or a variable display. Apply the newest clearly applicable regulatory instruction.
- Exit only on an authorized change. Do not accelerate merely because cones end or workers are out of sight. Continue until an end sign, a replacement limit, or another controlling instruction appears.
- Handle ambiguity safely. If a sign is covered, damaged, or contradictory, slow down, avoid abrupt maneuvers, and contact the road agency later with the route, direction, approximate location, and time.
What to do if you receive a work-zone speeding ticket
- Record the state, county or city, route, direction of travel, and the exact location shown on the citation.
- Note whether the ticket came from an officer or an automated system, and preserve any notice, photograph, or mailed instructions.
- Find the current statute or official transportation/law-enforcement page for that jurisdiction. Check the posted limit, any work-zone enhancement, worker-presence requirement, camera activation rule, deadlines, and payment or contest process.
- Do not assume a camera notice has the same procedures or consequences as an officer-issued moving violation; the governing law may treat them differently.
- Meet the response deadline printed on the citation. If the facts or signage are disputed, obtain qualified local legal advice rather than relying on a nationwide rule.
Common mistakes that create risk
“The orange signs are only suggestions.”
Warning signs may not set a number, but a separate regulatory speed sign or active display can create an enforceable limit. Ignoring the numerical sign because it is inside a construction area is not a safe assumption.
“No workers means no work-zone rule.”
Worker visibility is not a universal expiration test. The altered roadway, barriers, equipment, or unfinished surface can remain the reason for the posted limit, while worker presence may matter only to a particular camera or penalty provision.
“Every work-zone fine is doubled.”
Penalty enhancements vary by state and sometimes by program. Verify the law for the road where the citation was issued.
“The project has one speed from start to finish.”
Traffic-control plans can change by section and phase. A new sign or active display can replace the previous limit, so keep scanning after the first set of cones.
The bottom line for U.S. drivers
Obey the lowest applicable regulatory speed shown for the section you are driving, including an active variable display, and continue until an authorized sign or display changes it. A work-zone limit is planned locally around worker exposure and roadway conditions; it is not created by orange warning signs alone. Whether a fine is enhanced, doubled, or issued by camera—and whether worker presence matters—depends on the state or local authority. For an exact penalty or exception, identify the jurisdiction first and verify its current law and official transportation guidance.
