Not yet. As of October 4, 2026, a proposal to remove GST arrest provisions was reported as being under consideration, not as a change in law. The GST Council was expected to take it up at its October 7 meeting; if the Council advances it, legislative amendments would still be needed.
What is proposed, and what is its status?
The Indian Express reported on October 4, 2026, that the GST Council was expected to consider decriminalising offences under the indirect tax regime, including removing GST arrest provisions. The report was based on people familiar with the matter and unnamed sources. No Council decision or bill text was available as of that date, so the proposal’s scope and outcome were not confirmed. The report said concerns about possible enforcement overreach and its effect on business and investor sentiment were part of the rationale. That is the report’s account of the motivation, not proof that the arrest provisions caused a particular economic effect. Even if the Council backs a change, legislation would be required before the law changed.

Can GST officers arrest a taxpayer under the current law?
The report describes Section 69 of the Central Goods and Services Tax Act, 2017 as allowing a Commissioner to authorise a central tax officer to arrest a person suspected of specified offences, after recording “reasons to believe.” Fake invoices and fraudulent input-tax-credit claims are among the examples cited. The report says those reasons must rest on credible material, not mere suspicion; this does not mean every tax dispute or ordinary compliance failure permits arrest. The Indian Express report
Ordinary non-compliance can instead involve tax recovery, interest under Section 50 and penalties under Section 122. Deliberate evasion offences may attract arrest and prosecution under the Act. The precise offence definitions and thresholds are technical; this summary is not legal advice, and taxpayers facing a case should consult a qualified Indian tax-law professional and the current statutory text.
How many GST arrests were reported?
The Indian Express reported 72,393 GST offence cases and 887 arrests by central GST formations from FY 2021–22 through FY 2024–25. It noted that arrests by state authorities were additional, so 887 is not an all-India arrest total. The Indian Express report

What guidance existed before this proposal?
The Karnataka GST Department’s instruction index lists Central Instruction 01/2025-GST, dated January 13, 2025, titled “Guidelines for Arrest and Bail in Relation to Offences Punishable under the CGST Act, 2017.” The index confirms that official guidance existed; its title alone does not establish the detailed safeguards or how they apply in an individual case. The October 7, 2026 Council meeting was the next reported decision point. To know whether arrest powers have actually changed, look for an official Council announcement and then the relevant enacted legislative amendments. Until those steps are confirmed, the reported proposal should not be treated as a removal of existing powers. Any later change’s offence scope, effective date and treatment of pending cases would depend on the final legal text.
