Will Gold Imports by Nominated Agencies Come Under GST? What the Council Is Weighing

Possibly—but no 2026 GST Council decision or implementing notification confirming a change was identified as of October 7, 2026. Reports say the Council may consider bringing government agencies such as MMTC and the State Trading Corporation of India into the GST framework for precious-metal imports. That is a reported proposal, not a rule currently shown to have taken effect.

What is being considered?

The Economic Times reported on October 6, 2026 that the GST Council was expected to discuss whether government agencies including MMTC and the State Trading Corporation of India should be brought within the GST regime for precious-metal imports. The report described a broader aim of aligning tax treatment across banks, nominated agencies and exchanges, and reducing classification and valuation disputes. Those are reported policy aims; no quantified price or working-capital effect is established.

Reports do not establish that the Council has approved the proposal, what entities or transactions it would cover, or when any change would begin. The expected meeting date is also uncertain: an October 6 Times of India report pointed to October 8, while an October 4 Economic Times/PTI report anticipated October 7. Neither date, on its own, confirms an official meeting schedule or outcome.

What is the current exemption framework?

The existing import-side treatment is not a blanket exemption for every organization called a nominated agency. Historical GST Council records describe an exemption proposal approved in 2017 in the context of supplying gold to exporters, including concern about paying IGST at import before making a downstream supply. The 52nd GST Council meeting agenda later described IGST exemption for imports of gold, silver or platinum by specified banks and other listed entities, with eligibility linked to the relevant list and Foreign Trade Policy. An individual importer’s treatment therefore depends on the applicable notification and whether it qualifies.

  • ✔️Each coin contains 1/10 oz of gold.
  • ✔️Obverse: Lady Liberty holding a torch with an olive branch.
  • ✔️Reverse: The Type 1 reverse, used from 1986-2021, shows a male bald eagle in flight carrying an olive branch to his nest, where a female awaits with her young. The Type 2 reverse, introduced in 2021, shows a bold close-up portrait of an eagle.
  • ✔️Each Gold Eagle is a sovereign monetized bullion coin fully guaranteed by the U.S. Mint.

The Council’s notification records also include an exemption for the supply of gold by nominated agencies to registered persons. That downstream supply treatment is legally distinct from the tax treatment when gold is imported; one should not be taken as proof of the other.

Import IGST, later GST and customs duty are different

  • Import IGST: CBIC’s sectoral FAQs explain that bringing goods into India is an import for IGST purposes and discuss gold and silver imported by banks on consignment. This is general guidance, not a ruling on the reported proposal or every type of agency or exchange. See CBIC’s sectoral FAQs.
  • GST on a later supply: A separate exemption may apply to a specified downstream supply, such as a nominated agency’s supply of gold to a registered person. It does not by itself settle import-side liability.
  • Customs import duty: This is separate from GST. The World Gold Council reported that India’s gold import duty rose from 6% to 15% in May 2026. That 15% figure is a customs-duty rate, not an IGST rate or the proposed GST change. See the World Gold Council’s 2026 analysis.

The Economic Times report described banks and certain nominated agencies as currently paying 3% GST on precious-metal imports. Treat that as the report’s description, not a universal rule: official material refers to specified entities and notification-based eligibility, so an importer’s actual position must be checked against the operative instrument.

What would matter if the Council changes the rules?

A Council discussion alone would not establish the final legal treatment. The relevant decision and implementing notification would need to show which importers and transactions are covered and from what date. For banks, agencies and exchanges, the practical comparison would turn on:

  • whether the importer appears on the operative eligible list;
  • whether tax is due at import or on a subsequent supply;
  • how consignment imports and ownership are treated;
  • how input-tax credit and the timing of payment affect working capital; and
  • the effective date, transition arrangements and required documentation.

The available reports and official background material do not settle those proposed terms. Nor do they establish how much a change would affect bullion prices or importers’ working capital.

What to watch for next

For a confirmed answer, look for a GST Council decision followed by the relevant notification or other implementing instrument from the tax authorities. Check the exact entity list, goods and transaction covered, effective date, and whether the rule addresses import and later supply separately. Until then, the reported tax-parity discussion should not be read as withdrawal of an exemption.
