Will Australia’s Under-16 Social Media Rules Affect Tourists? What Travelers Need to Know

Usually not, if the child is genuinely visiting. Australia’s Social Media Minimum Age rules target under-16 users who are ordinarily resident in Australia, not every child who briefly enters the country. eSafety guidance says platforms are not expected to act against temporary visitors who are not ordinarily resident. However, there is no fixed tourist exemption measured in days, and platforms may still flag an account when location, network, device or account signals suggest Australian residence.

This answer reflects the rules and guidance available on August 18, 2026. The platform list and implementing rules can change.

What Australia introduced

The measure took effect on December 10, 2025, through amendments to the Online Safety Act 2021. It requires covered social-media platforms to take reasonable steps to stop under-16 users who are ordinarily resident in Australia from creating or keeping accounts. The latest legislative version listed by the Federal Register is F2026C00329, dated March 26, 2026 (Federal Register of Legislation).

This is often called a social-media ban, but it is an obligation on platforms rather than a criminal prohibition on children. Under-16 users and their parents or carers do not receive government fines or criminal charges merely for holding or accessing an account. eSafety describes the framework and its terminology at Social media age restrictions.

Does the rule apply to tourists?

Nationality is not the deciding test. The key question is whether the under-16 user is ordinarily resident in Australia. eSafety’s regulatory guidance says providers would not be expected to take action against people who are temporarily visiting and are not ordinarily resident there (Regulatory Guidance).

That makes a normal overseas holidaymaker generally outside the intended target. It is not, however, an unconditional guarantee of uninterrupted access: the law provides no stated number of days after which a visitor becomes covered, and each platform operates its own age- and residency-assurance systems.

Traveler scenarios

Traveler Likely position
Adult tourist Not affected by this under-16 restriction.
Under-16 child on a short overseas holiday Generally not intended to be restricted, although a platform may still request checks or make an incorrect assessment.
Under-16 international student living in Australia Potentially within scope and more likely to have an account flagged, deactivated or removed.
Under-16 child moving to Australia More likely to be covered once the child becomes ordinarily resident, regardless of citizenship.
Australian under-16 traveling abroad Leaving Australia does not automatically end the issue; ordinary residence and the platform’s assessment remain relevant.

eSafety’s FAQ confirms that there is no simple time threshold. A stay of several months, Australian school enrollment, a local phone service or other evidence of an intended move can make the residency question more ambiguous than a short holiday.

Which services are covered?

eSafety’s latest published list includes these principal age-restricted services:

  • Facebook
  • Instagram
  • Kick
  • Reddit
  • Snapchat
  • Threads
  • TikTok
  • Twitch
  • X
  • YouTube

The list is not permanent. Services can be reassessed as their purpose and features change.

Services currently outside the age-restricted category

eSafety currently lists Discord, GitHub, Google Classroom, LEGO Play, Messenger, Pinterest, Roblox, Steam and Steam Chat, WhatsApp and YouTube Kids as outside the category. That status is not a permanent workaround: a service may be reassessed if social-media-style features become a primary or significant part of its purpose, and every service still has its own terms and age rules.

Separate age policies

Some services impose higher or separate limits. Match dating services and Yubo continue to require users to be 18. BlueSky, Lemon8 and Wizz have indicated that they apply a 16 minimum for Australian account holders. Check the service’s current terms rather than treating the government list as a universal age policy.

Why a tourist account might still be flagged

Platforms may combine signals rather than rely on a single connection. Possible indicators include:

  • An Australian SIM, telephone number or mobile-network provider
  • An Australian IP address, Wi-Fi connection or GPS location
  • Device information, location history or long-term activity patterns
  • An Australian app-store country, account setting, address or payment profile
  • Signals that the user intends to live, study or work in Australia

An Australian SIM or hotel Wi-Fi connection is not, by itself, proof of ordinary residence. The guidance describes a combination of indicators, so families should not assume that landing in Australia automatically triggers a ban—or that changing one signal guarantees access.

Age assurance is not the same as identity or residency verification

Age assurance estimates or confirms age. Identity verification proves who someone is. Residency assessment considers where the person ordinarily lives. They are related but distinct processes, and the framework does not require every tourist to upload a passport or government ID. Platforms and third-party age-assurance providers must follow privacy protections overseen with the Office of the Australian Information Commissioner (OAIC guidance).

Can children still use social media while visiting?

  • People aged 16 or older are not affected by this under-16 restriction.
  • An under-16 tourist may keep using an existing account if the platform treats the person as a temporary visitor.
  • A platform may request age or residency information even when the traveler believes the account is outside the rule.
  • Public posts, videos and other content may remain viewable without logging in where the service permits anonymous access. The Australian Government youth guidance discusses this distinction.

No platform can be promised to work continuously for every visitor, device or length of stay.

What to do if an account is blocked or checked

  1. Read the notice. Identify whether the platform is asking about age, location, ordinary residence or account verification.
  2. Use the official appeal or review channel. eSafety says platforms should provide mechanisms for mistaken flags, removals and deactivations, including cases where age or ordinary residence has changed.
  3. Explain the relevant facts. If accurate, state that the user is temporarily visiting and ordinarily lives overseas.
  4. Provide only reasonable evidence. Keep proof of temporary travel available if requested, but avoid disclosing more personal information than necessary.
  5. Ignore payment demands. Under-16 users and families are not fined under this scheme. Anyone demanding money while claiming to be the Australian government or eSafety is running a scam.

Appeal through the platform rather than trying to defeat its checks. eSafety’s guidance does not treat a VPN as a legal exemption: disguising location may violate platform terms, trigger security or fraud checks, and fail to change an account’s residency history (Regulatory Guidance).

What the rules do not mean

  • They do not create a border checkpoint that automatically blocks every under-16 visitor.
  • They do not make every social-media view illegal; the account restriction is the central issue.
  • They do not impose a universal passport-upload requirement.
  • They do not fine children, parents or tourists.
  • They do not cover every messaging, gaming or school service permanently.
  • They do not establish a 30-, 60- or 90-day tourist rule.

Bottom line for families traveling to Australia

A short-term overseas tourist under 16 is generally not the person Australia’s rules are designed to restrict, because the test is ordinary residence rather than nationality or simply being physically present. Still, the absence of a fixed tourist-duration exemption leaves platforms room to make individual assessments. Keep account-recovery details current, expect that an age or residency check is possible, and use the platform’s appeal process if a temporary visitor is wrongly classified.
