Paying for a digital item does not tell you, by itself, what you own or what you can do with it. The transaction may give you a personal content licence, an account-based entitlement, a claim against a custodian, or control of a token through private keys. Each arrangement has different rules for access, resale, inheritance and recovery.
The practical test is to separate three questions: what legal right did you acquire, who controls the technical means of access, and what contract and law govern the relationship? A valid login can disappear, a token can be frozen, and a fiduciary may be unable to obtain an account even when a statute gives that fiduciary some authority.

“Owned” can describe several different rights
Digital marketplaces often use purchase language for arrangements that are not equivalent to owning an unrestricted copy of a physical object. A transaction can create one or more of the following:

| Content licence | Permission to view, use or display content under stated terms | Account suspension, compatible devices, service availability or content removal | Contractual bans on selling, renting, assigning or sublicensing |
| Platform account entitlement | A contractual relationship with a service provider | Login recovery, provider shutdown, region restrictions or loss of a provider’s licence | Terms that prohibit account sharing or transfer |
| Custodied cryptoasset | A claim or position recorded by an intermediary | Intermediary controls, insolvency, freezes, compliance reviews or lost credentials | Provider approval, technical controls or legal restrictions |
| Self-custodied token | Control of signing credentials that can move the token | Lost, destroyed or exposed keys; incompatible software; network failure | Token rules, smart-contract controls, sanctions or rights that exist only off-chain |
| Off-chain digital right | A contractual or statutory right represented by a digital record | Counterparty refusal, identity checks, evidence problems or governing-law limits | Assignment clauses, approval requirements or non-assignability under law |
These categories can overlap. A token may prove control of a blockchain entry while a separate contract determines whether that entry conveys copyright, access to a service, a royalty or nothing beyond the token itself. The label “asset” does not resolve that distinction.

Read the transaction terms, not just the storefront label
The first question is what the seller promised in the specific transaction and region. Look for clauses headed licence, limitations, assignment, suspension, termination, redownload, account closure and survival. Save the version in force when you bought the item; online terms can change and regional editions can differ.
Kindle illustrates a personal-use licence
Amazon’s Kindle Store Terms of Use describe a non-exclusive, personal-use right to view, use and display Kindle Content within the service’s stated limits. In the section titled “Limitations,” the terms state: “Unless specifically indicated otherwise, you may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign any rights to the Kindle Content or any portion of it to any third party.” That is a vendor contract, not a universal rule for every ebook or jurisdiction. It shows why a receipt or a “buy” button does not automatically create a transferable copy.
The same terms tie use to the Kindle service and supported devices, and describe circumstances in which access can be terminated or revoked. You may be able to read a title for years while still lacking the right to give the licence to another person.

Subscriptions and licences are different from perpetual copies
A subscription normally grants access while the subscription and service continue. A licence may continue longer but still restrict copying, public performance, resale or assignment. A download can be a cached use of a service rather than an independently transferable file. Check whether the file is usable outside the provider’s application, whether another person can authenticate it, and whether the terms permit those actions.
Account access is a route to a service, not proof of every underlying right
A working username and password establish that the provider currently accepts your authentication. They do not prove that every purchase is downloadable, usable on every device, or transferable to another account. Access can depend on a provider’s contracts with publishers, geographic licensing, encryption systems, device support and fraud controls.

Content can disappear even after a purchase
Apple’s Media Services Terms say purchased content will generally remain available, but also warn: “Content also may be removed from our Services at any time (for instance, because Apple loses its right from the Content provider to make it available), after which it cannot be downloaded, redownloaded, or otherwise accessed from Apple.” This describes Apple’s terms in the relevant regional edition; it is not a general legal rule. It demonstrates the practical difference between having paid and having a continuing technical path to the content.
Questions to ask about any account-based asset
- Can you export a standard file, or only view the item inside the provider’s application?
- Can the licence be assigned to a named person, or is it expressly personal?
- What happens if the account is suspended, the service closes, or the provider loses a third-party licence?
- Is redownload available after a device failure, region change or account deactivation?
- Does the provider have a process for death, incapacity, bankruptcy or a court order?
Do not infer an answer from the ability to make a backup. A backup may preserve data while the encryption key, authentication or contractual permission remains controlled by the platform.
Crypto custody turns on who can cause a transfer
For a cryptoasset, identify the person or system that controls enough key material to sign a transaction or otherwise cause the benefit to move. The UK Financial Conduct Authority’s PERG 18 guidance frames custody control functionally: a provider may have control “through any means,” including possession of private keys or arrangements involving key shards, if it can bring about a transfer.
Custodied assets
When an exchange, wallet service or other intermediary holds the keys, the customer may have a contractual claim or account balance while the intermediary controls movement on the network. A withdrawal can therefore depend on identity checks, a compliance review, an outage, a freeze or the intermediary’s solvency. The blockchain may continue operating while the customer cannot instruct a transaction.
Self-custody is a technical condition, not a marketing word
The FCA says a provider is not safeguarding cryptoassets in a self-custody arrangement when the customer controls the asset and the provider has no means to bring about a transfer. A contract saying “you control the keys” is not conclusive if the provider’s software, recovery system or administrator can override the customer’s authority. Ask whether the provider can initiate, approve, delay, reverse or block a transfer without your independent signature.

- Products quantity: you will receive a 2-in-1 set of steel bitcoin wallets with matching lock screws, and 1 piece of metal plate marking pen, which is a matching set to help you protect your codes, passwords, and further importantly, your cryptocurrency
- Functions: with these steel crypto wallets you can record information such as fieldworks passphrase in tandem with the BIP39 word list, and they are also compatible with 12 or 24-word seed in most languages, suitable to store your private cryptocurrency information or for many instances where you may need a private cold storage system
- Suitable size: the cold wallet backups are compatible with BIP39 wallets, can work with most hardware wallets, supports up to 24 mnemonics seed phrases, convenient for you to use in coordination with other crypto seed storage devices and wallets
- Multiple ways of locking: you can use the matching screws to lock up the steel bitcoin wallets; You can also lock them up and hide them in other places if you still feel unsafe; The hole on the bitcoin wallet measures 6 mm/ 0.24 inch in diameter, suitable for hanging
Holding your own key does not guarantee recovery. A lost seed phrase, damaged device, exposed backup or incompatible wallet can make the token practically inaccessible. A hardware wallet can protect key material, but it does not establish that you own intellectual-property rights associated with a token, compel a platform to honour an access promise, or solve inheritance on its own.

A token can be technically movable without the rights it represents being legally assignable. Conversely, a right can be assigned by contract or law even when the token itself is locked on-chain. The FCA’s guidance recognises that a cryptoasset may be transferable through rights capable of assignment off-chain, even if the token cannot move on the blockchain.
Controls that do not settle transferability by themselves
Lockups, whitelists, know-your-customer checks, approval gates and freeze functions can make a transaction conditional or delayed. None automatically proves that transfer is impossible. Examine the token’s code, the issuer’s contract, the platform rules and the governing law together. Determine whether an administrator can change balances, whether a court or trustee can assign the associated claim, and whether the recipient must meet eligibility requirements.
What a recipient may actually receive
- A blockchain entry with no promised entitlement beyond use of the network.
- A licence to use software, media or a virtual item.
- A contractual claim against an issuer or custodian.
- A right to royalties, redemption or access subject to conditions.
- A security or other regulated instrument whose transfer follows financial-law rules.
Read the white paper, token terms, smart-contract documentation and offering materials. Keep copies in a durable location because a website or hosted document can change after the transaction.

Death does not automatically turn a private licence or an account into transferable property. The result can depend on the user agreement, privacy law, estate law, the custodian’s procedures and whether the provider can technically comply.

Florida example
Florida Statutes, Chapter 740, section 740.05 (2026), gives a fiduciary authority framework for digital assets, but makes that authority subject to terms of service and other applicable law. A personal representative may therefore have statutory standing while still facing a contract that limits disclosure or transfer. This is a Florida-specific example, not a rule for every U.S. state or country.
Delaware example
Delaware’s Title 12, Chapter 50 provides documented request routes for fiduciaries seeking control or access to digital assets and accounts. It also recognises limits, including technological impracticability. A provider may be unable to produce content or credentials in the requested form even when the fiduciary has supplied the required documentation. Delaware’s procedure should not be generalized to another jurisdiction.
Plan for both legal authority and technical recovery
An executor may be entitled to request records but unable to decrypt a device. Conversely, a person with a password may gain practical entry without having legal authority to use or distribute the content. Estate planning should address the two layers separately: appoint the right fiduciary and document where recovery instructions, devices, contracts and purchase records are stored. Never place an unprotected seed phrase or master password in an ordinary will or send it through an insecure channel.
What regulators say about token uncertainty
The U.S. Commodity Futures Trading Commission’s customer advisory, “Use Caution When Buying Digital Coins or Tokens,” recommends identifying the rights a token conveys and preserving the offering materials. It flags technology changes, liquidity, theft and uncertainty about future uses as risks. The advisory is consumer education, not individual legal or investment advice, and it does not establish that every token is property that can be recovered.

That liability is not a general promise that a digital asset will be recoverable, nor does it eliminate the need to establish what the customer was legally entitled to receive.
A due-diligence process before you rely on an asset
- Classify the right. Write down whether the transaction created a licence, subscription, custodial claim, token, copyright interest or another assignable right.
- Capture the governing documents. Save the receipt, terms, privacy notice, token documentation and any side agreement, with the purchase date and region.
- Map technical control. For an account, identify login, recovery and multifactor dependencies. For crypto, identify who controls every key or key shard needed to sign or authorise a transfer.
- Test a small recovery action. Confirm that a backup device, recovery code or alternate signer works before an emergency. Do not test by exposing a valuable private key on an untrusted device.
- Check transfer mechanics. Look for assignment bans, recipient eligibility, whitelists, lockups, approval rights, freezes and jurisdiction-specific reporting or tax obligations.
- Read failure clauses. Find the rules for suspension, provider shutdown, content removal, insolvency, death, incapacity and loss of a third-party licence.
- Prepare fiduciary instructions. Tell a trusted fiduciary where records and recovery instructions are held, while keeping passwords and seed phrases protected.
- Get local advice for high-value cases. Estate, insolvency, tax and regulated-asset questions can turn on facts that a general checklist cannot resolve.
Common assumptions that fail
- “I paid, so I own a copy.” Payment proves a transaction occurred; the terms determine whether the result is a copy, licence or service entitlement.
- “I can log in, so I can transfer it.” Authentication may permit personal use while prohibiting assignment or export.
- “It is on a blockchain, so nobody can stop it.” Custodians, administrators, smart contracts, sanctions and off-chain rights can restrict practical or legal movement.
- “Self-custody guarantees control.” It helps only when you truly control the signing authority and can recover it safely.
- “My executor can access everything.” Fiduciary powers vary by jurisdiction and remain subject to contracts, privacy rules and technical feasibility.
The reliable way to assess a digital asset is to document the right you bought, the system that can actually deliver it and the law that governs the relationship. Those three layers—not a storefront label, account balance or token symbol—determine whether access and transfer survive a shutdown, dispute, incapacity or change of owner.
