U.S. export controls apply to defined advanced-computing chips, systems, end uses and end users, with the result depending on the item’s technical specifications, classification, destination, customer and intended use. China, Hong Kong and Macau are covered, and an entity’s headquarters or ultimate parent can matter even when the shipment is going somewhere else. On January 13, 2026, the Bureau of Industry and Security (BIS) announced conditional, case-by-case review for Nvidia H200, AMD MI325X and similar chips; review is not a guarantee of approval.
What the China restrictions actually do
The shorthand question—“Why are Nvidia AI chips banned in China?”—is understandable but too absolute. The rules do not prohibit every Nvidia GPU or every export to a Chinese customer. They establish licensing requirements and prohibitions for specified advanced-computing capabilities, related systems and certain uses. Whether a transaction can proceed depends on the exact product, its Export Administration Regulations (EAR) classification and technical parameters, the destination, the customer and ownership structure, and the proposed end use.

That distinction matters because two products sold under the same broad “AI accelerator” description can receive different treatment. A model name alone is not a legal determination. An exporter must identify the item’s characteristics, classify it under the EAR, screen the parties, examine where the item is going and determine whether a license, license exception or a published review policy applies.

Why BIS says it imposed the controls
BIS presents the controls as national-security measures. Its advanced-computing rules identify concerns that high-performance computing could support China’s military modernization, advanced weapons and weapons-of-mass-destruction programs, supercomputing and advanced artificial-intelligence capabilities. A 2024 clarification described possible military applications including decision-making, electronic warfare, radar, signals intelligence, jamming and surveillance.

- AI Performance: 767 AI TOPS
- OC mode: 2632 MHz (OC mode)/ 2602 MHz (Default mode)
- Powered by the NVIDIA Blackwell architecture and DLSS 4
- Axial-tech fan design features a smaller fan hub that facilitates longer blades and a barrier ring that increases downward air pressure
- A 2.5-slot design maximizes compatibility and cooling efficiency for superior performance in small chassis
Those are risks identified by the U.S. government, not proof that every controlled chip will be used for a military or surveillance purpose. The policy treats access to large amounts of fast, efficient computation as strategically significant because the same hardware can train sophisticated AI models, run simulations, process sensor data or accelerate other workloads. Export controls therefore target capabilities and transaction circumstances rather than relying only on the customer’s marketing description.
“Export controls should evolve with changes in technology, while protecting national security.”

Which products and activities the rules cover
Advanced-computing integrated circuits
The foundational rule covers certain advanced-computing integrated circuits. Technical thresholds and definitions in the EAR determine whether a particular chip falls within the controlled category. The relevant analysis can include performance, interconnect or other parameters specified by the regulation; a generic label such as GPU, accelerator or AI chip is not enough to decide.
Computers and systems containing controlled chips
Controls can also reach computer commodities and systems that contain covered integrated circuits. A server, workstation or other assembled product may therefore require analysis even when the customer is not purchasing a loose chip. The system’s configuration and the characteristics of the components can affect the classification and licensing result.

Supercomputer end uses
Separate end-use provisions address supercomputer-related activity. The legal question is not only what is being exported, but how the recipient intends to deploy it. An otherwise permissible item can become restricted when the exporter knows, has reason to know, or is notified that it will support a controlled supercomputing end use.
Semiconductor-manufacturing items and activities
Related rules address semiconductor-manufacturing equipment, software, technology and associated end uses. Those provisions are distinct from the advanced-computing-chip controls but can affect the same transaction or corporate group. A shipment involving fabrication, packaging or process-development capabilities needs a separate review under the applicable EAR provisions.

BIS applies a combination of item, destination, end-user and end-use controls. A practical assessment should answer these questions in order:
| Decision axis | What to establish | Why it changes the result |
|---|---|---|
| Item and technical parameters | Exact part or system, configuration, performance characteristics and EAR classification | Only defined categories and thresholds are covered; branding alone is not determinative. |
| Destination | Where the goods, software or technology will be exported, reexported or transferred | China, Hong Kong and Macau have specific treatment, and an apparent third-country shipment may still involve a covered entity. |
| Customer and ownership | Legal name, screening results, headquarters and ultimate-parent location | Entity-based restrictions and the May 2026 guidance can apply based on headquarters or parent location, not just physical delivery. |
| End use | What the recipient will build, train, operate or support | Supercomputer and other specified end uses can trigger requirements even when the item itself is not categorically prohibited. |
| Authorization path | License requirement, available exception and any current BIS review policy | Some transactions require a license; a review policy sets how BIS may evaluate an application but does not promise approval. |
Why China, Hong Kong and Macau are treated together
BIS’s January 2023 FAQ states that the relevant China restrictions also apply to Hong Kong and, beginning January 17, 2023, Macau. An exporter cannot avoid the rules simply by routing a transaction through one of those jurisdictions or by describing the customer as Hong Kong- or Macau-based rather than China-based.
The rules can also follow the customer’s corporate location. In guidance dated May 31, 2026, BIS clarified that license requirements continue for specified advanced-computing items exported to entities headquartered in Country Group D:5 or Macau, or to entities whose ultimate parent is headquartered there, even when the operating entity is physically located elsewhere. Consequently, a company receiving a shipment in another country may still require analysis of its headquarters and ultimate parent.

What changed with the January 2026 licensing policy
On January 13, 2026, BIS said it would review applications for Nvidia H200, AMD MI325X and similar chips on a case-by-case basis when stated security conditions are met. The announcement identified three kinds of evidence BIS would expect:
- Evidence that the proposed exports would not reduce semiconductor capacity available to customers in the United States.
- Customer export-compliance procedures, including screening controls.
- Independent third-party testing conducted in the United States.
“Case by case” means BIS may consider an application under those conditions. It does not create an automatic license, a guaranteed approval rate or a permanent entitlement to ship. Because licensing policy can change, an application prepared under the January 2026 approach must be checked against the policy in force when the transaction is submitted and reviewed.
How an exporter should evaluate a proposed shipment
The following workflow is designed to prevent the most common error: deciding that a transaction is allowed or forbidden from the chip’s marketing name alone.
- Freeze the exact configuration. Record the part number, board or server configuration, memory and interconnect details, quantities, software and technology supplied with it. A later hardware substitution can change the classification.
- Classify the item under the EAR. Determine the applicable Export Control Classification Number and compare the item’s technical parameters with the current advanced-computing provisions. If classification is uncertain, stop the shipment rather than relying on a sales description.
- Map every movement. Identify the export location, transit points, final destination, reexport or transfer plans and any cloud or remote-access arrangement. The physical delivery address is not always the only relevant location.
- Verify the customer and ownership chain. Screen the legal entity, directors or other relevant parties as required by the compliance program. Document headquarters and the ultimate parent, including whether either is in Country Group D:5 or Macau.
- Obtain a specific end-use statement. Ask what will be trained, simulated, manufactured or operated, who will access the system and whether it will support a supercomputer or a restricted semiconductor activity. Vague statements such as “research” are not enough for a high-risk transaction.
- Check authorization options. Determine whether the transaction is prohibited, requires a BIS license, qualifies for a license exception or falls under a current review policy. Do not treat a submitted application as permission to ship.
- Preserve evidence and controls. Keep classification work, screening results, ownership records, end-use certifications, testing reports and shipment documentation. Apply contractual controls and monitor for diversion or unauthorized reexport.
Common misconceptions—and the accurate version
“Every Nvidia AI chip is banned in China.”
Incorrect. The rules cover defined advanced-computing categories and circumstances. Some items may be outside the relevant thresholds, while others may require a license or be subject to a prohibition. The answer must be tied to the item’s classification and parameters.
“A chip is legal if it is delivered outside China.”
Not necessarily. Headquarters and ultimate-parent location can matter, and reexport, transfer and end-use rules can reach a transaction involving a third-country facility. The May 31, 2026 guidance makes that indirect reach explicit for specified items and entities.

“A customer’s civilian status removes the risk.”
No. BIS rules examine end use and the capabilities being supplied. A civilian company can operate a supercomputer, provide services to a restricted user or participate in semiconductor manufacturing. Screening must cover the transaction’s actual use, not only the customer’s industry label.
“Case-by-case review means approval is likely.”
No. The January 2026 announcement establishes a way for BIS to evaluate qualifying applications. It does not waive the license requirement or compel BIS to grant a license.
How the policy developed
| Date | Development | Practical significance |
|---|---|---|
| January 2023 | BIS FAQ addressed China restrictions, Hong Kong and Macau; Macau treatment began January 17, 2023. | Exporters had to include both jurisdictions in geographic screening. |
| 2024 | BIS clarification discussed military decision-making, electronic warfare, radar, signals intelligence, jamming and surveillance applications. | The government’s stated rationale covered more than traditional supercomputing. |
| January 13, 2026 | BIS announced case-by-case review for H200, MI325X and similar chips under specified conditions. | Some applications could be considered, but no approval was automatic. |
| May 31, 2026 | BIS clarified treatment of specified items exported to D:5- or Macau-headquartered entities and entities with an ultimate parent there. | Corporate headquarters and ownership became an essential part of third-country transaction checks. |
What the rules mean for buyers, sellers and technical teams
For an exporter, the main obligation is transaction-specific diligence. Product, customer, ownership, destination and end use must be evaluated together, and records should show how the conclusion was reached. Sales teams should avoid promising delivery dates before classification and licensing are complete.
For a buyer, a purchase order or a non-Chinese delivery address does not override U.S. controls. The buyer may need to provide ownership information, an end-use statement, screening cooperation and evidence about security procedures. Contract terms should address reexport, transfers, access by affiliates and compliance with license conditions.

Adding controlled accelerators to a larger system, enabling remote access or moving workloads between facilities can create a new transaction or end-use question. Compliance review should therefore include the deployed system and access model, not only the original hardware invoice.
What remains uncertain in any individual case
BIS documents establish the government’s rationale and regulatory position, but they do not decide every shipment in advance. The answer for a particular transaction depends on the current EAR text, the item’s technical data, the parties and ownership chain, the intended use and any notice or policy applicable at the time. The January 2026 review policy is especially time-sensitive.
The safest conclusion is therefore precise rather than categorical: Nvidia AI chip exports to China are restricted when they fall within defined advanced-computing or related controls, involve covered destinations or entities, or support specified end uses. Some applications may be reviewed under current policy, but only BIS can determine whether a license is issued for the transaction presented.
