Nintendo says it protects its characters and other intellectual property for two connected reasons: enforcement defends the creative investment behind its games and the sales that fund future development, while careful licensing and character management preserve the identity and emotional attachment players have built over decades. Its public policies describe a deliberate system—not a claim that every fan use is automatically unlawful.
What Nintendo says it is protecting
Nintendo uses “intellectual property” as an umbrella term for several legal rights. Its Intellectual Property & Piracy FAQ identifies copyrights, trademarks, patents and design rights as separate tools that protect different interests. Treating all of them as interchangeable “copyright” makes Nintendo’s enforcement strategy harder to understand.

| Right | What it can cover in Nintendo’s products | What that protection is designed to do |
|---|---|---|
| Copyright | Expressive material such as game characters, visual assets, music, software, packaging, manuals and artwork. | Controls copying and other uses of original creative expression. |
| Trademark | Names, symbols and designs that identify Nintendo or a particular product source. | Helps consumers distinguish genuine products from goods or services that only appear affiliated. |
| Patent | Inventions and technical solutions. | Protects qualifying inventions rather than the character artwork or story itself. |
| Design right | The appearance of products, including shapes of accessories. | Protects qualifying visual design features of physical products. |
Nintendo says its IP-enforcement programs operate in more than 40 countries, using legal enforcement, consumer awareness, technology and efforts to improve intellectual-property legislation. The company does not publish a numerical estimate of piracy losses or a typical game-development budget in the FAQ, so the rationale is stated as policy rather than quantified as a return-on-investment calculation. Why enforcement matters commercially
Protecting years of creative work
Nintendo’s FAQ says its games involve substantial creative work. Unauthorized copies, altered versions, counterfeit products and devices or software that circumvent protection can let someone distribute or use that work without Nintendo’s authorization. Enforcement is therefore presented as a way to protect the contribution of designers, programmers, artists, musicians, writers and other creators whose work is embodied in a game.

Preserving legitimate sales
The same FAQ links enforcement to legitimate game sales. A copied game, counterfeit accessory or unauthorized distribution channel can compete with an authorized product while avoiding the costs Nintendo associates with development, testing, manufacturing, support and distribution. Nintendo’s stated concern is not only ownership in the abstract; it is maintaining a market in which authorized releases can generate revenue.
Keeping the development cycle viable
Nintendo says game development can take several years and involve substantial costs. It does not give a universal dollar figure, because projects differ by scope and platform. Its argument is that legitimate sales help sustain the industry’s ability to invest in new games. That is Nintendo’s explanation for why it treats copying, circumvention and counterfeiting as threats to future production rather than as isolated transactions.
What this rationale does not establish
A company’s policy statement does not by itself prove that every individual enforcement action was necessary or that every use of a character infringes a right. Whether a particular use is lawful can depend on facts, jurisdiction, the right being asserted, authorization, exceptions and other defenses. Nintendo’s FAQ explains its objectives; it is not a court ruling on every dispute.

Why characters receive special treatment
Characters are more than visual assets in Nintendo’s business. Nintendo’s September 16, 2020 “Nintendo IP Expansion Philosophy” presentation says its properties are grounded in interactive game experiences and in the personal attachment players develop to characters. A character can therefore carry expectations about personality, tone, world and relationships that extend beyond a single game.

Preserving audience attachment
Nintendo says expansion should fit each property’s individual appeal and avoid damaging the image or attachment consumers have formed. In the presentation, the company states: “That’s why we will always expand our properties in ways that fit the individual appeal of each character, taking great care not to damage the image or attachment consumers have for them.” The statement is Nintendo’s own explanation; the published excerpt does not identify an individual speaker.
Quality over exposure
The 2020 philosophy says Nintendo prioritizes quality rather than exposure for its own sake. A character appearing everywhere may increase visibility, but Nintendo’s stated concern is whether an appearance is consistent with the property and valuable to audiences. This helps explain why the company can decline or tightly control proposed uses even when a project might create short-term publicity.
Avoiding traits that limit future games
Nintendo also says expansion should avoid introducing unintended character traits that could constrain future game development. A portrayal in a film, advertisement, product or online project can become part of the public’s expectations. Nintendo’s policy is to manage those expectations so that future creators retain room to develop the character in new games.

The presentation identifies a larger business goal: expanding characters and worlds in ways that encourage interest in Nintendo’s games and dedicated platforms. Under this model, a film, licensed product or other appearance is not an independent substitute for the games. It is meant to deepen awareness and attachment while directing audiences toward the interactive experiences where the properties originated. How the different rights affect a character use
A single project can implicate more than one right. For example, drawing a character may involve copyrighted artwork; using the character’s name or logo in a way that suggests sponsorship may raise trademark questions; reproducing a distinctive controller shape may involve design rights; and a technical feature may involve patents. The relevant analysis is fact-specific, so “I changed the picture” or “I am not selling it” is not a universal answer.
- Copying expression: Reproducing game art, music, code, animation or other expressive material is principally a copyright issue.
- Suggesting source or sponsorship: A name, logo or visual mark used in a commercial context can raise trademark concerns, especially if people could think Nintendo approved or supplied the product.
- Reproducing product appearance: A replica accessory or device may implicate design rights in addition to trademarks or copyright.
- Bypassing technical controls: Devices or software intended to circumvent technological protection are specifically included in Nintendo’s enforcement FAQ.
These categories overlap, but they are not interchangeable. A person considering a project needs to identify what is being copied, how it will be distributed, whether it implies endorsement and which country’s law applies.
What Nintendo’s online video and image policy permits
Nintendo’s “Game Content Guidelines for Online Video & Image Sharing Platforms,” updated September 2, 2024, create a limited policy for qualifying individual consumers. They are not a blanket license to use Nintendo characters in any medium.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsUses covered by the guidelines
The policy allows individual consumers to post gameplay footage and screenshots from games Nintendo owns, provided they follow the rules. Nintendo says it welcomes creative input and commentary. Eligible material is limited to officially released game content or official promotional material, and monetization is allowed only through methods Nintendo separately specifies.

Important limits
- The policy applies to individual consumers; corporate entities are outside its stated scope.
- Content must use officially released game content or official promotional material, not unreleased or independently obtained material.
- Creative input and commentary are contemplated, but simply uploading Nintendo material without the required original contribution may not satisfy the policy.
- Only the monetization methods Nintendo specifies are permitted. Other commercial monetization of Nintendo’s IP is not authorized by these guidelines.
- The policy concerns online videos and images. It does not automatically authorize fan art, character merchandise, games, books, advertisements, public performances or other formats.
Nintendo’s opening message recognizes fans’ desire to create: “We are humbled every day by your loyalty and passion for Nintendo’s games, characters and worlds, and respect that you want to be able to express yourself creatively by sharing your own original videos and images using content from our games.” That permission remains conditional. For a use outside the policy, Nintendo directs people to applicable law and their own legal counsel rather than promising that the use is allowed. (
