Clearstone Energy Limited’s appeal to build a 150 MW battery energy storage system near Axminster, Devon, was dismissed on 13 August 2026. Reporting on the decision says the inspector was not satisfied that the proposed explosion-mitigation measures and fire-water containment had been shown to protect groundwater adequately. The appeal also raised concerns about the development’s effect on the rural landscape.
Which energy storage appeal was dismissed?
The decision concerns Clearstone Energy Limited’s proposal for a battery energy storage system at land just south of Hazlehurst, Raymonds Hill, near Axminster in Devon. The Planning Inspectorate’s official record identifies East Devon District Council as the local planning authority and lists the inquiry appeal, reference APP/U1105/W/25/3369854, as dismissed on 13 August 2026. ESS News identifies the project as the Axminster Energy Hub and reports a proposed capacity of 150 MW. It says East Devon District Council refused the planning application in May 2025 and Clearstone appealed; the council later withdrew its opposition during the appeal, while local groups continued to oppose the scheme. The reported central concern was whether a fire or explosion could be managed without polluting aquifers or degrading groundwater quality, with particular regard to residents’ health and safety. The inspector’s reported reasoning focused on the evidence for explosion mitigation and on whether fire water could be contained if an incident occurred.

- 1.8 Hr Solar Recharging: Go fully off‑grid with sustainable power for tiny homes, camping RV off‑grid setups, and remote locations. Plug in 600W (60V max) of solar and recharge in just 1.8 hours.
According to ESS News, the inspector wrote: “I am not persuaded that there is sufficient robust evidence to demonstrate that the deflagration/explosion mitigation strategies would work effectively and that explosion hazards would be satisfactorily controlled for cabinets 10cm apart.” The publication also reports that the inspector considered fire safety to weigh very heavily against the proposal, and said that uncertainty about fire safety meant they could not be confident that measures such as the fire-water retention blanket would prevent aquifer pollution or control groundwater quality. Those statements are reported as the inspector’s conclusions, but the full decision document linked on the Planning Inspectorate case record is the source for the complete findings and planning balance.
What battery system was proposed?
ESS News reports that the scheme included 52 Wärtsilä Quantum 1 units, described as lithium iron phosphate batteries, for a proposed 150 MW project. The cabinet spacing discussed in the inspector’s reported explosion-mitigation reasoning was 10 cm. These are details of this specific proposal, not guidance for other battery sites. ESS News report

Its luggage-style design with wheels and a telescopic handle allows effortless rolling from kitchen to garage or beyond.
The report also describes evidence about the system’s deployment and safety testing. That evidence should not be read as establishing that site-specific hazards were adequately controlled: the reported decision turned on whether the mitigation and containment case for this proposal was sufficiently robust.
How did landscape concerns figure in the case?
The appeal also concerned the development’s effect on the character and appearance of the area, including the Dorset National Landscape. ESS News reports that the scheme’s industrial appearance in a rural setting was a concern. The official case record confirms the outcome, but the detailed landscape findings and the inspector’s full balance of planning considerations are in the decision document linked from the case record.

ESS News attributes an estimate of approximately 10% probability of at least one fire over the proposed project’s 40-year lifetime to Jeremy Ramsden, an expert for the opposing Rule 6 Party. The estimate was reported as based on standard calculations using 2025 failure rates. It is a case-specific expert estimate, not an independently established general fire rate for battery energy storage systems.

The same report attributes inspection figures to Clean Energy Associates: 26% of BESS units inspected had defects in fire suppression systems, 18% had thermal management system defects, and system-level defects accounted for nearly 50% of quality-assurance findings. These figures describe that organization’s inspection findings; they do not measure conditions at Axminster or establish rates across all battery storage installations. ESS News report

What does this decision mean for other battery projects?
The dismissal is the outcome of one planning appeal involving a particular site, design and evidential record. It does not establish that all battery energy storage systems are unsafe, nor that following a specific guideline guarantees planning permission. For another proposal, relevant questions may include how explosion hazards are modelled and mitigated, how fire water would be retained, the route by which contaminants could reach groundwater, emergency response arrangements, consultation evidence and landscape effects.
Clearstone’s response, as quoted by ESS News, was that the decision was concerning for UK BESS projects and government plans. That is the appellant’s view; it is distinct from the inspector’s findings. ESS News report
