Why Bay Head Voters Received Domicile Questionnaires—and Why the ACLU Says the Challenge Is Illegal

Ocean County election officials sent Bay Head voters domicile questionnaires after a local Republican leader reportedly flagged residents whose property-tax bills went to addresses outside the borough. The ACLU of New Jersey says the list selectively targeted Democrats and unaffiliated voters and violated voting-rights protections; Ocean County Board of Elections chairman George Gilmore says the board was responding to a voter challenge through a longstanding information-gathering practice. The dispute remained unresolved in the latest reports reviewed, published September 29 and 30, 2026.

Why Bay Head voters received questionnaires

According to the ACLU-NJ’s September 29, 2026 letter, Dennis Shaning—then both Bay Head Borough Council president and Bay Head Republican Party president—reviewed tax records and sent a list to Ocean County officials on August 21. The ACLU says it identified registered Democrats and unaffiliated voters whose tax bills were mailed outside Bay Head, while leaving off registered Republicans in the same situation. That claimed partisan selectivity is an allegation, not an independently established finding.

The letter says Gilmore sent domicile questionnaires to the listed voters on September 15, requested supporting documents, and warned that their voting rights could be challenged if they did not respond. It also described an October 13 board meeting to review the submissions and voter eligibility. The New Jersey Monitor reported that Gilmore said the four-member board, with two Democrats and two Republicans, unanimously agreed to investigate the voters Shaning reported. He said he did not personally review the list before questionnaires went out.

What the election board says it is doing

Gilmore told the New Jersey Monitor that the board was responding to a challenge submitted to it, rather than searching for voters on its own. He described the practice as one the board had followed for more than 30 years; that history is his account, not an independently verified finding. He also said voters whose information verifies they are domiciled in Bay Head will be allowed to vote.

In the Monitor’s account, Gilmore said: “The only thing we’ve done is ask for information from certain voters in regard to a letter that was submitted to the board. This has been our practice for over 30 years, and it’ll continue to be our practice until a court tells us we cannot do it. We don’t go out looking for people. We react to challenges that come into the board.”

Why the ACLU says the process is unlawful

In its demand letter, ACLU-NJ argues that targeting Democrats and unaffiliated voters while excluding similarly situated Republicans burdens political association and treats voters unequally. It invokes the National Voter Registration Act’s uniformity requirement and 90-day quiet period, constitutional protections, and New Jersey’s John R. Lewis Voter Empowerment Act. These are the ACLU’s legal arguments, not a court’s ruling on this dispute.

The ACLU also disputes what tax records can establish. It argues that a tax-bill mailing address is not direct evidence of a person’s voting domicile: the address could belong to a relative, a second home, or an accountant. In its letter, the organization states, “The mailing address on a tax bill provides no direct evidence of domicile.”

The letter cites Worden v. Mercer County Board of Elections, a 1972 New Jersey Supreme Court case concerning students and residence, for the principle that officials cannot apply extra scrutiny to a class of voters. That case supplies legal context cited by the ACLU; it does not decide the present Bay Head dispute.

What New Jersey’s voter guidance says about challenges

The New Jersey Division of Elections’ 2026 Voters’ Bill of Rights says a challenger may challenge a voter believed not to be qualified. It lists the relevant qualifications as citizenship, registration, being at least 18, and county residence for at least 30 days before the election. The poster says challengers may not challenge someone because of how they think that person will vote or because the voter lives in a particular ward, housing complex, or section of a municipality or county. It also says only district-board workers may question a challenged voter directly.

This is general guidance for challenges at polling places. It does not, by itself, resolve whether Ocean County’s pre-election questionnaire process or the way voters were selected complies with state or federal law. Nor does an outside tax-bill address alone establish that someone is ineligible to vote in Bay Head.

What the ACLU demanded—and what remains unknown

ACLU-NJ’s September 29 letter asked the board to cancel the October 13 meeting insofar as it concerned the listed voters, confirm by October 2 that it would take no adverse action based on their tax-bill mailing addresses, and send corrective letters by October 5. The proposed letters would tell voters their registrations remained active and they did not need to answer the questionnaires. The ACLU warned it was prepared to seek relief in court.

The reviewed reports and materials do not establish whether the board met the October 2 deadline, canceled the meeting, sent corrective letters, or faced litigation. They also do not establish a court ruling on the merits. A claim that a voter “should not be voting” in Bay Head is Shaning’s reported position, not an established conclusion.

How many voters were affected?

The available accounts give different figures, and neither establishes a final official tally:

  • The New Jersey Monitor reported ACLU-NJ attorney Liza Weisberg’s estimate of 39 voters; Gilmore could not confirm that count.
  • The Jersey Vindicator reported Gilmore’s account of about 37 letters and about 13 returned questionnaires.

These figures describe attributed estimates or accounts, not a reconciled count. The Monitor also reported, citing state data, that Bay Head voter registration was 47% Republican, 23% Democratic, and 30% unaffiliated. Those figures provide local context but do not establish whether either side’s legal position is correct.
