There is no single owner of “video game music.” Ownership depends on which protected work you mean, who created or acquired it, and what the contracts grant. A game can contain a musical composition (the melody, harmony and lyrics) and a separate sound recording (a particular recorded performance). Different people or companies may control each layer.
For a developer, the practical answer is contractual: identify the composition and, when applicable, the exact recording; trace the writers, publishers and recording owner; then confirm that the written grant covers the game and every planned release and promotion. U.S. rules provide the framework discussed here, while local law and the actual agreement control a particular project.

Start with the two copyrights inside a soundtrack
The most important distinction is between the musical work and the sound recording. The U.S. Copyright Office puts it plainly: “A sound recording and the music, lyrics, words, or other content included in the recording are separate copyright-protected works.” A melody written for piano and a studio recording of that melody are therefore not interchangeable assets.
| Layer | What it covers | Who may control it | Typical permission needed in a game |
|---|---|---|---|
| Musical work (composition) | Music and any lyrics, independent of one particular performance | Composer or songwriter, publisher, an assignee, or an administrator; shares may be divided | Permission to synchronize the composition with game visuals and other audiovisual content |
| Sound recording (master) | A specific recorded performance, including the recorded sounds and production embodied in that track | Record label, artist, producer, studio, or another party that owns or controls the master under its agreement | Master-use permission for that exact recording |
If a developer records a new performance of an existing song, the old master is not automatically licensed; the new recording has its own rights, while the underlying composition still needs clearance. Conversely, obtaining a composition license does not authorize use of a commercially released recording.

Who can own an original game score?
A commissioned score is not automatically owned by the studio simply because the studio hired and paid the composer. The contract and applicable law determine whether the composer keeps the copyright, assigns it, or grants a license.
Work made for hire
In the United States, a work-made-for-hire arrangement can place ownership with the commissioning party when the legal requirements and the written agreement are satisfied. WIPO’s Mastering the Game: Business and Legal Issues for Video Game Developers discusses this structure in the game-development context. It is not a universal consequence of calling someone an employee, calling a project “commissioned,” or paying an invoice. Whether the requirements are met must be assessed under the governing law and the actual contract.
Assignment to the developer or publisher
A composer may sign an assignment transferring copyright in the specified music. The agreement should identify what is being assigned and whether the transfer covers the complete score, alternate versions, stems, edits and future additions. If the composer has co-writers, subcontractors or pre-existing material in the delivery, each relevant interest needs its own chain of title.

License while the composer retains ownership
The composer can retain ownership and grant the developer a license. A license may be exclusive or non-exclusive and may be limited by game, platform, territory, term or type of exploitation. A retained-rights deal can leave the composer free to make other uses, but only if those uses do not conflict with the grant. The fact that the developer has a broad license does not by itself prove that the developer owns the copyright.
Why payment is not the test
Payment establishes that a commercial transaction occurred; it does not answer the ownership question. A purchase order, invoice or email may describe deliverables without transferring copyright. Read the signed agreement, amendments and any incorporated terms before relying on assumptions about ownership.
What happens when the game uses a pre-existing song?
Using an already released song normally involves two separate clearances. WIPO explains that a developer will, in most situations, need synchronization rights for the composition and master-use rights for the sound recording.

- Clear the composition. Find the songwriter or songwriters, their publisher or publishers, and any administrator or other owner who can grant synchronization permission.
- Clear the master. Identify the party controlling the exact recording that will ship in the game. That may be different from the composition owner.
- Match the recording to the grant. A license for one version, edit, remix or live performance does not automatically cover another recording.
- Confirm the game uses. Make sure the permissions cover the in-game implementation and any trailers, advertisements, downloadable content, soundtrack release or other planned exploitation.
These permissions can be negotiated together or separately. A single intermediary may administer both layers, but do not infer that from a single contact or invoice; verify what that party is authorized to license.

Sometimes, but the answer is contract-specific. “The soundtrack” can mean the compositions, the recordings delivered to the developer, or a later commercial soundtrack album. Those may have different owners and different grants.
- Composer-owned composition: The composer retains the musical-work copyright and licenses the studio to use it.
- Developer- or publisher-owned composition: A valid work-for-hire arrangement or assignment places the relevant rights with the commissioning party.
- Third-party recording: The composer may have written the music while a label, artist or another entity controls the master.
- Co-created score: Multiple writers, publishers or contributors may hold shares, requiring authority from each relevant interest.
A composer can also retain rights in material that predates the project, such as a library cue or an earlier song, even when newly commissioned tracks are assigned. The agreement should distinguish project-created music from pre-existing material and state the license for anything retained.
Which parties may appear in the chain of title?
Rights information is often split rather than held by one “soundtrack owner.” U.S. Copyright Office reporting fields distinguish the songwriter, publisher, musical-work owner and ownership shares, illustrating why a developer must map the participants instead of relying on a single name.
| Party | Possible role | Question to verify |
|---|---|---|
| Composer or songwriter | Creates the musical work; may retain or transfer rights | What did this person sign, and are there co-writers? |
| Publisher | Administers or owns some or all composition rights | Can the publisher grant synchronization permission for the stated uses? |
| Musical-work administrator | Acts for an owner or group of owners | What territory, share and rights does the administration mandate cover? |
| Recording owner or master controller | Controls a particular recorded performance | Who can grant master-use permission for this exact file or release? |
| Developer or publisher | May own assigned rights or hold a license | Does the grant cover the shipped game and later exploitation? |
Ownership percentages, co-writer splits and administrative mandates can change who must sign or approve a deal. Keep copies of agreements and schedules that document those shares.

Identify the work and deliverables
- Name the game, expansion or project and identify each composition and recording.
- Describe delivered files, alternate mixes, edits, stems, loops and replacement cues if they are part of the bargain.
- List any pre-existing music and state whether it is assigned or merely licensed.
State the ownership model
- Say expressly whether rights are work made for hire, assigned, or licensed.
- If licensed, state whether the license is exclusive or non-exclusive and which rights are included.
- Address composer-retained uses, portfolio display and other permitted activities instead of leaving them to implication.
Define the exploitation scope
- Game and versions: Identify the base game, ports, remasters, bundles, demos and updates that are covered.
- Platforms: Name the console, PC, mobile, cloud or other platforms in scope, or use wording that clearly defines the permitted set.
- Territories: Specify where the game may be distributed.
- Term: State how long the license lasts and what happens at expiration.
- Downloadable content: Confirm whether new missions, characters, seasonal content and later expansions may use the music.
- Promotion: Cover trailers, advertisements, social clips, events, demos, press materials and storefront videos if they are planned.
- Soundtrack release: Treat a digital or physical soundtrack, streaming release or sale of isolated tracks as a separate planned use and ensure the grant addresses it.
WIPO’s discussion of licensing and exploitation beyond the game supports checking these uses in the actual agreement. The exact business terms remain deal-specific; do not assume a grant for in-game playback includes every promotional or album use.
Do you need both synchronization and master rights?
For a pre-existing recording combined with game visuals or gameplay, generally yes: synchronization permission for the composition and master-use permission for the recording. The two rights answer different questions:
- Synchronization: May this musical work be timed to and used with the game’s audiovisual content?
- Master use: May this particular recorded performance be copied, loaded, streamed or otherwise used in the game as licensed?
One clearance cannot be used as evidence of the other. If the developer commissions a new recording of a song, the master negotiation concerns the new recording, but the composition still requires authorization. If the developer writes an entirely new score and owns or licenses both the composition and the recording created for the game, a separate third-party master clearance may not be needed for that score; the contract still has to grant the intended uses.

| Commissioned original score | Document ownership or a license for newly created compositions and recordings | Music can be tailored to the game and may avoid clearing an unrelated commercial master | Unclear work-for-hire language, unassigned co-writer interests, retained pre-existing material, or missing rights for DLC and promotion |
| Pre-existing commercial track | Obtain composition synchronization permission and master-use permission | Recognizable music and an established recording | Two negotiations, split ownership, territory or term limits, and a grant that covers only the original release |
| Music-library track | Verify what the library owns or administers and read its game-use license | Potentially streamlined access to pre-cleared or licensable tracks | License may exclude games, advertising, soundtrack sales, certain territories, or uses after a term; the library may not control every underlying right |
A library label is not a substitute for a rights audit. Confirm the library’s authority, the exact track and recording, and all intended uses before shipping.
A verification workflow for developers
- Inventory the music. Create a list of every cue, song, recording, loop, sample and alternate version intended for the game, trailer or soundtrack.
- Separate the layers. For each item, record the composition title and writers separately from the recording title, performers and master owner or controller.
- Trace ownership. Collect publisher, administrator, label and assignment information. Record ownership shares where applicable and identify every co-writer or co-owner.
- Read the governing documents. Review composer, publisher, label, library and contractor agreements, including schedules, amendments and incorporated terms. Mark whether each right is assigned or licensed, whether the grant is exclusive, and any restrictions.
- Map intended exploitation. Write down the game edition, platforms, territories, duration, DLC, patches, trailers, advertising, events, social clips and soundtrack release. Compare this list with the grant rather than assuming “all media” language resolves every issue.
- Resolve gaps before integration. If a signer cannot demonstrate authority for a co-owner or for the master, pause use of that asset or obtain the missing permission. Substituting a different recording does not cure a missing composition license.
- Preserve evidence. Keep executed agreements, licenses, cue sheets, ownership statements and correspondence with the project records so a later platform, distributor or soundtrack partner can verify the chain.
- Escalate material uncertainty. Obtain qualified legal review for a commercial release, an unclear chain of title, a disputed share or a cross-border distribution plan. This guide is general information, not advice on a specific transaction.
Common mistakes and how to correct them
“We paid the composer, so we own everything.”
Why it fails: Payment does not replace a work-for-hire, assignment or license provision. Correction: Locate the signed agreement and determine exactly what was transferred or licensed.
“The publisher cleared the song, so the recording is covered.”
Why it fails: A publisher generally deals with the musical work, not necessarily the master. Correction: Obtain separate confirmation from the party controlling the exact recording.

An indie studio hires one composer for all original music
The studio should still choose and document an ownership model. If the composer retains copyright, obtain a license broad enough for the planned game and promotion. If the studio expects ownership, use an agreement that satisfies the applicable assignment or work-for-hire rules and addresses any co-creators or pre-existing cues.
A publisher wants a famous released track
The publisher must budget time for two clearances and identify the exact master. Negotiations should specify the game versions, distribution territories, term, trailers, advertising, DLC and any soundtrack release. A deal for the composition alone leaves the recording unresolved, and a master deal alone leaves the composition unresolved.

A developer selects a library catalogue
The developer should request the catalogue’s rights information, confirm who controls each composition and recording, and compare the license’s permitted uses with the release plan. Keep the track identifier and the license version with the build records so a later replacement or catalogue change does not create uncertainty.
The score has several writers
Map every writer, publisher and ownership share. Determine whether one party has authority to grant the whole composition or whether separate signatures are required. Do not treat a single composer’s delivery as proof that all interests were transferred.
Jurisdiction, dates and limits of this guide
The framework here is based on U.S. Copyright Office guidance, the U.S. statutory copyright framework and WIPO’s 2022 discussion of game-development agreements and music licensing. It is not a conclusion about the law in every country or about a particular game contract. Definitions of work made for hire, assignment formalities, collective administration, moral rights, term, and cross-border enforcement can differ by jurisdiction.
The U.S. Copyright Office’s reporting regulations distinguish contributors and ownership shares for registration and reporting purposes; those fields help illustrate how fragmented a rights chain can be, but the reporting rule itself does not decide who owns a particular soundtrack. For a release distributed internationally, have counsel analyze the governing law, local formalities and the territories named in each license.
Further reading and records to keep
For a developer-focused treatment of business and legal issues, WIPO’s book-length reference Mastering the Game: Business and Legal Issues for Video Game Developers discusses commissioned music, work-for-hire, assignment, licensing and pre-existing music. Verify the edition and current availability before relying on a particular passage. The U.S. Copyright Office’s guidance for musicians is useful for the composition-versus-recording distinction quoted above.
Maintain a rights register that links each in-game cue to its composition documents, master documents, ownership shares, permitted territories and approved uses. Update it when a track is replaced, a DLC pack is added or a promotional plan expands.
