A person’s original story text, creative edits, and sufficiently original selection or arrangement may be protected; simply writing prompts or choosing an output does not, by itself, make the user the copyright author of generated text or images. Who owns any protected rights after creation depends on agreements and applicable work-made-for-hire rules.
Which parts of the book can be protected?
Think of a children’s book as several kinds of authorship rather than one indivisible object: story text, illustrations, and the selection and arrangement of material across the book. Each component can have a different copyright result. The U.S. Copyright Office’s AI and Copyright report and guidance say copyright requires human authorship, while allowing protection for qualifying human contributions within a work that also contains AI-generated material.

There is no universal percentage of human editing or minimum number of rewritten words that decides the issue. The Office says whether human contributions to AI-generated output qualify as authorship must be assessed case by case.

Does writing the prompt make you the author?
Not by itself. The Copyright Office says prompts typically do not give users sufficient control over the expressive elements produced by current generally available AI systems. Typing a detailed prompt, paying for an account, or clicking “generate” therefore does not automatically make someone the copyright author of the resulting story passage or illustration.

The relevant distinction is between ideas or instructions and the human expression actually fixed in the work. If a writer used AI for suggestions but supplied the final wording, that human expression may qualify. If the writer accepted generated passages unchanged, those passages should not be described as human-authored just because the writer selected them. Extensive revision may support a claim in the human-written revisions, depending on what the person contributed.
What if AI made the illustrations but a person wrote the story?
The story text and pictures can receive different treatment. A person’s original story may be copyrightable even if the illustrations were generated by AI and are not themselves protected as human-authored artwork. The Copyright Office’s registration example is closely analogous: its graphic novel combined human-written text with Midjourney-generated images. The Office concluded that the text and human selection and arrangement could be protected, while the generated images themselves were not. This is an example, not a blanket ruling about every children’s book or every editing workflow.

If a person creatively modifies an AI-generated image, copyright may cover the human-authored modifications without covering the underlying generated image. Likewise, original additions to the page design or arrangement may be claimed separately where they meet the standard. Describe the claim in terms of the human-authored material rather than saying the entire illustration—or the entire book—is simply “copyrighted” or “uncopyrighted.”
Can the book’s layout or page order be protected?
Potentially. The Copyright Office recognizes copyrightable authorship in the selection, coordination, or arrangement of material in a collective work. Its guidance gives a children’s book made by a writer and illustrator as an example of a work whose human-authored arrangement may be registered. A sufficiently creative human arrangement can therefore be protectable even when some included images are not. It does not convert AI-generated images into human-authored art.

Who owns the rights after the book is made?
Authorship and current ownership are different questions. The author is generally the person or people who created the copyrightable material, but rights can later be transferred. Employment terms, publishing contracts, illustrator agreements, and commissioned-work arrangements can affect who owns the rights.
For specially commissioned work to qualify as work made for hire under U.S. law, the parties must expressly agree in a writing signed by both sides, and the work must fit one of the statutory categories. Do not assume that a publisher, illustrator, parent, employer, AI provider, or person who paid an invoice owns all rights without reviewing the relevant agreement and applicable law. The Copyright Office’s copyright FAQ also distinguishes owning a physical copy from owning copyright in its contents. Minors may claim copyright, though state law may regulate business dealings involving copyrights owned by minors.

What should you disclose when registering the book?
For a U.S. registration, follow the Copyright Office’s current application instructions for AI-generated material. Disclose the generated content and identify the human-authored material you are claiming; do not claim generated passages or images as human-created. The graphic-novel example shows how a claimant can identify human text and arrangement while excluding AI-generated images from the claim.
