Who owns AI-generated creative work? Copyright and attribution explained

There is no universal owner for AI-generated creative work. In the United States, copyright normally follows human-authored expression: a prompt by itself is not enough, but a person’s original writing, visual elements, creative arrangement or substantial editing can be protected. The United Kingdom has a separate statutory rule for some computer-generated works, treating the person who made the necessary arrangements as the author, although its fit with modern generative AI remains uncertain.

“Who owns it?” and “Who should be credited?” are different questions. Copyright, moral rights, disclosure duties, contracts and training-data issues can point to different answers, so identify the jurisdiction, the human contribution and the type of work before assigning rights or publishing.

Start with the human contribution, not the tool

Generative systems can produce text, images, music, video and code, but the software is not treated in the cited sources as a human or statutory author. The practical question is what a person actually contributed to the final work and how much of the final expression was determined by that person rather than by the system.

  • Human-authored material: Your own prose, illustrations, photographs, recordings, choreography or other original expression can remain protected when it appears in a work that also contains AI-generated material.
  • Creative selection and arrangement: Choosing, sequencing or combining generated elements can qualify when the choices create sufficiently original expression.
  • Creative modification: Rewriting, repainting, editing, composing or otherwise changing output may protect the human-created changes, even if the unchanged machine-generated material is not protected.
  • Prompting alone: Entering instructions does not automatically make you the copyright author of the resulting expression.

Protection is therefore often partial. A finished project may contain protectable human passages and unprotectable machine-determined passages side by side. Copyright analysis is fact-specific; the same tool can produce different results depending on the person’s process and the final edits.

United States: copyright follows sufficient human authorship

What the Copyright Office says

The U.S. Copyright Office’s January 29, 2025 Part 2 report says an AI output can be protected when a human author has determined sufficient expressive elements. It identifies protection where human-authored work is perceptible in the output, or where a person makes creative arrangements or modifications. The Office also says that AI-assisted creation, and inclusion of AI-generated material in a larger human-generated work, do not automatically bar protection for the larger work. Any claim should be limited to the human-authored expression. The Office’s announcement and the Part 2 report provide the controlling guidance cited here.

Register of Copyrights and Director Shira Perlmutter summarized the principle this way: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” That statement protects human creativity expressed with AI; it does not grant copyright to every output generated after a person types a prompt.

Why a prompt usually is not enough

A prompt can describe a subject, mood, style or desired result without determining the specific expressive details that appear in the output. Under the current Office analysis, merely supplying prompts generally does not provide the human control over expressive elements required for authorship. A long or detailed prompt is not automatically different: the legal question is what expression the person actually authored, not the word count of the instruction.

When editing and arrangement matter

Suppose a novelist writes the plot, characters and dialogue, uses an AI system for a few descriptive passages, then rewrites those passages and edits the manuscript. The human-written and human-revised expression can be claimed, while any text left entirely to machine determination may need to be excluded. A designer who creates an original layout, selects generated components and makes substantial visual changes may likewise protect that human arrangement and modification. Courts and the Office examine the concrete workflow and the resulting expression, not a label such as “AI-assisted.”

Registration disclosure is a separate obligation

The Office’s March 2023 registration guidance requires an applicant to disclose AI-generated content in a work submitted for registration. Disclosure does not mean the entire work is unprotectable. The later Part 2 report expressly recognizes that human-authored elements and qualifying human arrangements or modifications may be protected. Describe the AI material accurately and claim only the portions supported by human authorship. The registration guidance should be read with the Part 2 report.

United Kingdom: a statutory rule for computer-generated works

What section 9(3) says

Section 9(3) of the Copyright, Designs and Patents Act 1988 provides: “In the case of a literary, dramatic, musical or artistic work which is computer-generated, the author shall be taken to be the person by whom the arrangements necessary for the creation of the work are undertaken.” The provision addresses works generated by a computer in circumstances where there is no human author. Read the wording in the statute.

This is not a simple “the prompter always owns it” rule. Identifying who undertook the necessary arrangements depends on the facts: people may design a process, commission a generation, curate outputs or make later changes. A company, client, employee or contractor might also have contractual interests that differ from the statutory starting point.

Duration and the unresolved originality issue

A 2026 UK government report describes protection for computer-generated works as lasting 50 years from creation. The same report notes a tension with modern originality doctrine, which is commonly associated with an author’s own intellectual creation and creative choices. That tension leaves uncertainty about how the statutory rule applies to fully AI-generated works. Present the 50-year rule and the uncertainty together; UK law does not settle every ownership question for generative systems. Read the report.

United States and United Kingdom compared

Issue United States United Kingdom
Basic authorship approach Copyright requires human authorship of sufficient expressive elements. AI use does not disqualify a work, but machine-determined expression is not automatically protected. Section 9(3) assigns authorship of certain computer-generated literary, dramatic, musical or artistic works to the person who undertook the necessary arrangements when there is no human author.
Prompting Prompts alone generally do not supply enough expressive authorship under the Copyright Office’s current guidance. The statute does not say that a prompt writer always qualifies; the necessary-arrangements question is fact-sensitive.
Editing and arrangement Creative modification, selection or arrangement can be protected; claims should be limited to the human expression. Human creative choices may affect the analysis, but the interaction between section 9(3) and originality doctrine remains uncertain.
Mixed works Human-authored parts of a larger work can remain protected even when AI-generated material is included. Protection depends on the statutory and originality analysis applicable to the work and circumstances.
Duration for fully computer-generated output No general AI-specific term is established by the cited guidance; protection depends on qualifying human authorship. The 2026 government report describes 50 years from creation for computer-generated works, while warning that application to modern AI is unsettled.
Registration or formalities AI-generated content must be disclosed in a U.S. registration application; disclosure is not a ruling that the whole work lacks protection. The cited materials do not establish a matching general registration-disclosure rule.

Attribution is not ownership

A credit line can identify a contributor without transferring copyright, and a person may own rights without having an unrestricted legal right to a particular credit. Attribution rules vary by country, work and context.

United States

The U.S. Copyright Office’s moral-rights study describes attribution as a personal interest in being credited as author, alongside integrity rights against prejudicial distortion. U.S. protection is limited and arises through several legal provisions rather than one general attribution right covering every creator and work. A publisher’s credit policy may therefore be sensible even when no universal statutory credit duty applies. See the Office’s moral-rights study.

United Kingdom

UK law gives specified authors of specified works a right to be identified, but the right generally requires assertion and is subject to exceptions. The statute also contains exceptions involving computer-generated works in specified contexts. A voluntary credit such as “created with generative AI assistance” can communicate provenance, but it does not decide who owns copyright. Consult the moral-rights provisions for the applicable work and exception.

EU AI Act transparency duties do not assign copyright

The 2026 UK government report summarizes two EU AI Act duties relevant to generative content. Providers of general-purpose AI models must publish a sufficiently detailed summary of training material. Providers of systems that generate synthetic audio, image, video or text must ensure outputs are marked in a machine-readable format and detectable as AI-generated or manipulated.

Those are provider transparency obligations. They do not determine which person owns copyright in a particular image, article, song or video. Commencement dates and implementation guidance can change, so check the rules that apply to the provider, user and market at the time of release. Do not treat an output label as proof of ownership or a missing label as proof that a human owns the work.

A practical workflow before you publish or license an AI-assisted work

  1. Identify the governing places. Note where you are based, where the client or employer is located, where the work will be released and which law your contract selects. Copyright is territorial.
  2. Preserve the creation record. Keep drafts, source files, prompts, model settings, generated alternatives, timestamps and editing history. The record helps separate your expression from unedited output.
  3. Map human expression. Mark passages, images, sounds, code, layouts and edits you created yourself. Record selection and arrangement decisions that give the final work its original structure.
  4. Separate machine-determined material. Identify output used without creative alteration. Avoid claiming that portion as human-authored where the applicable law requires human authorship.
  5. Check third-party material. Confirm that uploaded references, likenesses, voices, trademarks and confidential information can be used. Copyright ownership does not eliminate privacy, publicity, contract or other rights.
  6. Read the service and client contracts. Terms may allocate permitted use, indemnities, confidentiality, delivery rights or ownership between customer, employer and contractor. A contract can change who receives an economic interest even when it cannot change the underlying authorship analysis in every jurisdiction.
  7. Prepare truthful credits and disclosures. State human contributors, AI assistance and any required registration or machine-readable labeling without implying that a credit line itself transfers ownership.
  8. Obtain jurisdiction-specific advice for high stakes. Commercial licensing, disputes, employment assignments and registration choices warrant advice based on current law rather than a universal internet rule.

Common scenarios

Only a prompt, no meaningful selection or editing

In the United States, the current Copyright Office position gives you no automatic claim to the expressive output merely because you wrote the prompt. You may still own your original prompt text as text if it is sufficiently original, but that is different from owning every resulting image or paragraph.

AI output inserted into a human-written book

The author can generally claim qualifying human-written chapters, original characters, structure and revisions, while excluding machine-determined passages as required. The presence of AI material does not automatically destroy protection for the rest of the book.

Generated image extensively repainted and composited

The untouched generated pixels may raise a human-authorship problem in the United States. Your original repainting, compositing, typography and arrangement can provide protectable expression if they are sufficiently creative. Document which elements you made.

A UK commission where a studio operates the generation process

Section 9(3) requires a fact-based inquiry into who undertook the necessary arrangements. The answer may involve the commissioning client, studio, operator or another participant, and the contract may allocate exploitation rights separately. Do not assume the person who typed the final prompt is automatically the statutory author.

What the official sources do not establish

No representative official statistic currently shows what percentage of AI outputs are protected or who owns them. The U.S. Copyright Office reports receiving more than 10,000 comments by the December 2023 deadline in its AI notice-of-inquiry process, but that is a comment count, not a measure of registrations, ownership outcomes, infringement or public opinion. The Office’s AI study page records the process.

The cited materials also do not settle whether a particular model’s training use is lawful. The Office’s study page says Part 3, concerning generative-AI training, was released in pre-publication form on May 9, 2025 and that a final version is forthcoming. Training-data legality is a separate issue from ownership of an output.

Decision checklist

  • Have you named the country or countries whose law matters?
  • Can you point to the human-authored expression in the final file?
  • Did you distinguish prompting from creative editing, arrangement and selection?
  • Did you disclose AI-generated material where registration rules require it?
  • Are credit, copyright, contract, training, privacy and labeling being treated as separate questions?
  • Does your proposed credit accurately describe contribution without claiming ownership by implication?
  • Have you retained evidence of drafts and revisions?
