The person who actually types or approves a message is determined by that agency’s procedures, the sign’s purpose, and any contract covering the site. A state transportation department, county, city, toll authority, or another designated highway agency may run a permanent sign. A contractor may operate a portable sign at a work zone, but that does not automatically remove the public agency’s overall responsibility.
This explanation applies to roads in the United States. The controlling national standard is the Federal Highway Administration’s Manual on Uniform Traffic Control Devices (MUTCD), 11th Edition, published in 2023, together with the responsible state’s and locality’s policies and contracts.

What “changing a roadside sign” actually involves
A lighted roadside board that can show different words is generally a changeable message sign. The MUTCD defines a CMS as a traffic-control device capable of displaying one or more alternative messages. That definition matters because the board is not treated like an ordinary advertising display. Its messages, placement, operation, and maintenance are governed by traffic-control rules.
Several responsibilities can be separated even when the public sees only one sign:

- Equipment ownership or furnishing: The agency may own a permanent sign, while a contractor may furnish a portable unit for a project.
- Day-to-day operation: An agency traffic-management center, field office, maintenance crew, or an authorized contractor may enter the message under local procedures.
- Message development and approval: Technical staff decide what the sign should say and how it should be formatted, subject to the agency’s policy and the MUTCD.
Those roles can be held by different organizations. Finding the operator therefore does not by itself answer who is responsible for the sign.
Permanent highway signs: the jurisdictional agency is responsible
For a permanently installed or positioned CMS, responsibility starts with the public agency that has jurisdiction over the highway. Depending on the road, that may be a state department of transportation, a county or municipal highway department, a toll-road authority, or another public road owner. The agency is responsible for the device’s design, placement, operation, and maintenance, even if a vendor supplied equipment or a private party performs some operational work under contract.
The MUTCD does not assign every sign to one nationwide job title. It does not say that a particular kind of CMS must always be changed by a state dispatcher, a police officer, a maintenance supervisor, or a named control room. Instead, the agency with jurisdiction establishes an operating arrangement that fits its network.
What the local CMS policy must cover
For permanently installed or positioned CMS, state and local highway agencies must maintain policies addressing how the signs are used. Those policies cover the types of messages allowed, their priority, the syntax or wording conventions, timing, and related operational elements. A policy may also define who can request a message, who reviews it, who authorizes it, and which staff have access to the sign-control system. Those details vary by agency, so a neighboring state or city may use a different workflow without violating the national standard.
Why the agency remains accountable when a contractor is involved
A maintenance, technology, or traffic-management contractor can perform work for the agency, but a contract does not turn the sign into a private traffic device. The public agency’s policy and the contract determine the contractor’s authority. The agency still has to ensure that messages follow traffic-control requirements and that the device is operated safely.

Temporary work-zone signs: who operates a portable CMS?
Road projects often use portable CMS mounted on trailers. A contractor may furnish and operate one of these signs when the public agency’s construction requirements allow it. The contractor’s operation can include moving the trailer, connecting power, entering an approved message, and maintaining the unit. That practical role is different from the agency’s ultimate responsibility for traffic control on the project.
There is no single nationwide allocation of duties for every work zone. The governing state manual, project specifications, and contract determine the arrangement. As a specific example, the North Carolina Department of Transportation construction manual says the Division Engineer has ultimate responsibility for messages used on changeable message signs, while a contractor is responsible for operating a contractor-furnished sign. That is a North Carolina rule, not a universal rule for all states.
Questions to ask at a work zone
- Which public agency has jurisdiction over the project?
- Does the contract identify the contractor as the party furnishing or operating the portable CMS?
- Who approves the wording before it is displayed?
- Does the project use an agency-owned sign, a contractor-furnished sign, or both?
The answers identify the operational chain without confusing the equipment supplier with the authority responsible for traffic control.
What messages are allowed on a CMS?
Section 2L.02 of the 2023 MUTCD states: “CMS shall display only traffic operational, regulatory, warning, and guidance information except as otherwise provided in this Chapter.” In practical terms, a sign can warn drivers about a crash or queue, provide route or detour guidance, communicate a traffic regulation, or give an operational instruction such as a lane or ramp status. The sign is not a general-purpose billboard.
The permitted categories explain why a public agency, rather than an informal group or an individual driver, controls the message. A short, dramatic phrase that attracts attention may still be unsuitable if it does not convey traffic information in the form required by the MUTCD and the agency policy.

How wording is developed
Agencies normally use conventional traffic-sign principles: concise wording, recognizable abbreviations, legible line breaks, and a sequence that drivers can read while moving. The agency policy determines the syntax and timing for its network. A technical representative may translate a field report into an approved legend, select a standard warning, or remove a message when the condition ends.
FHWA’s January 4, 2021 interpretation addresses public involvement in that process. It says that if public input is solicited on traffic-control devices, it should inform the message developed and displayed by agency technical representatives, “in accordance with conventional sign legend syntax.” Public comments can therefore provide useful information about a hazard or confusing condition, but they do not give commenters authority to publish wording directly to the sign.
Who can request, approve, and enter a message?
Because agencies set their own policies, these functions may be distributed among several people:
| Function | Typical responsible party | What the national standard establishes |
|---|---|---|
| Overall responsibility | Public agency or official with jurisdiction | The jurisdictional authority is responsible for traffic-control devices, including operation. |
| Message request | Field staff, incident managers, law enforcement, or another authorized agency unit | No universal job title is specified. |
| Message development and approval | Agency technical representatives under the CMS policy | Messages must follow MUTCD principles and the agency’s policy. |
| Message entry | Authorized agency operator or, where permitted, a contractor | The local operating arrangement controls. |
| Portable work-zone operation | Sometimes the contractor that furnished the unit | Project requirements and state practice determine the assignment. |
| Maintenance and repair | Agency staff or an agency-authorized contractor | The public agency remains accountable for the device. |
This is why two signs displaying similar warnings can be changed by different people in different jurisdictions. The visible board does not reveal the internal staffing model.
How to identify the responsible agency for a specific sign
If you need to know who changed a message, or who can correct it, use the road’s jurisdiction rather than guessing from the sign’s appearance.

- Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft
- Identify the road owner. Look for the route number, toll-road name, city boundary, county boundary, or project signs. State routes are commonly handled by the state transportation agency; city and county roads are handled locally, but exceptions exist.
- Determine whether the sign is permanent or portable. A trailer, wheels, temporary supports, or a work-zone setup indicate a portable CMS. A pole-mounted board on a fixed structure is usually permanent, although the agency still needs to be confirmed.
- Check the project information. Work-zone signs often identify a project office, resident engineer, emergency number, or contractor. That information can reveal the operational contact without proving that the contractor has final authority.
- Use the agency’s traffic or road-conditions contact. Call the transportation agency, local public-works department, toll authority, or 311 service for the location. Ask for the unit responsible for the CMS or traffic-management center.
- Report the exact sign and message. Provide the road, direction of travel, nearest exit or intersection, date and time, displayed wording, and the problem you observed. A precise report lets the responsible unit verify whether the message is still needed.
What to do if the message appears wrong
Do not stop on the shoulder, approach the cabinet, or attempt to access a sign-control device. If the message creates an immediate safety risk, contact emergency services while remaining in a safe location. For a non-emergency error, use the road agency’s official reporting channel and include a photograph only if it can be taken legally and safely by a passenger or from a safe stopped location.

“The person who typed it is responsible for everything.”
Not necessarily. The operator may be an authorized employee or contractor acting under an agency policy. Overall responsibility still rests with the public agency or official having jurisdiction.
“The contractor owns the sign, so the contractor controls traffic.”
Furnishing a portable sign can give a contractor an operating duty, especially on a construction project, but it does not automatically transfer public authority. The contract and the agency’s construction requirements define the contractor’s limits.
“Drivers can vote on the exact wording.”
Public input can inform an agency’s decision, but FHWA’s 2021 interpretation places message development and display with agency technical representatives using conventional sign-legend syntax.

“A CMS can display any public-service announcement.”
The MUTCD limits CMS content principally to traffic operational, regulatory, warning, and guidance information, subject to the exceptions in Chapter 2L. An agency policy may be more specific about what qualifies and how long a message may remain active.
What the 2023 MUTCD changes for this question
The 11th Edition of the MUTCD, published in 2023, is the relevant edition identified for U.S. practice here. It provides the national framework, including the definition of a CMS, the content rule in Section 2L.02, and the expectation that agencies with permanently installed or positioned signs maintain policies for message types, priority, syntax, timing, and related matters.
Federal standards can be amended or replaced. Before relying on a particular requirement for a legal dispute, project specification, or formal complaint, check the current FHWA MUTCD material and the applicable state and local policy. The road agency’s own policy and the project contract may contain operational details that the national manual leaves to local choice.
