There is no automatic nationwide answer. After a vehicle crashes into a crowd in Australia, responsibility depends on the evidence and the state or territory where it happened. The driver may be investigated for an offence and may also be civilly liable for injuries, but those are separate legal questions. Injured people and families may also be able to claim through the local compulsory third-party (CTP) or motor-accident compensation scheme, whether or not anyone has been convicted.
What does “responsible” mean?
It can refer to three different processes. A police investigation, a civil claim for loss, and a statutory compensation claim may proceed under different rules and reach different outcomes. One does not automatically decide the others.

Criminal responsibility
Police investigate whether an offence may have occurred, and prosecutors and courts determine criminal outcomes under the law that applies in that jurisdiction. A collision into a crowd does not, by itself, establish that the driver committed an offence. Without the location and findings of an investigation, it is not possible to identify a particular offence or say that anyone is guilty.
Civil liability
A civil claim asks whether someone’s conduct caused injury or other loss and whether that person is legally responsible for it. Legal Aid NSW explains: “There is a difference between a driving offence (criminal responsibility) and responsibility for damage (civil liability).” Its guidance says a driver may be responsible for damage if they failed to take reasonable care, and responsibility can be shared. A decision not to charge a driver does not, on its own, establish that no civil liability exists.

Compensation under a motor injury scheme
CTP and statutory motor-accident schemes provide benefits or a route to compensation under local rules. A claim is not the same as a criminal conviction, and eligibility does not itself prove that a person committed an offence or was civilly at fault.
Who could be held responsible?
The driver
The driver’s actions are central to an investigation and may also matter to a civil claim. Authorities and insurers assess the facts against the relevant legal tests; a driver should not be described as guilty or liable merely because their vehicle was involved.
The vehicle owner
Owning the vehicle does not automatically make someone criminally or civilly responsible for a crash. Legal Aid NSW gives a narrower example: an owner may also be responsible if their agent was driving and at fault, such as a friend driving the owner’s vehicle on an errand. The driver may remain responsible as well. Insurance coverage is a separate question: South Australia’s CTP regulator says the policy covers the owner and other people who drive or ride in the vehicle, subject to its terms. That coverage does not establish the owner’s fault.

Other parties
An employer, vehicle manufacturer, road authority or another party could only be considered if the particular evidence and applicable law support a claim against them. Their involvement should not be assumed from the fact that a vehicle entered a crowd.
How compensation and CTP claims vary across Australia
CTP is compulsory in every Australian state and territory, according to NSW SIRA, but compulsory insurance does not mean every kind of loss is covered. For example, Queensland’s MAIC says its CTP scheme can support eligible injury costs but does not cover vehicle or property damage. The crash jurisdiction’s scheme determines eligibility and available benefits; if a crash occurred interstate, SIRA says the law of the state or territory where it happened determines eligibility.
High-level scheme classification
NSW SIRA’s interstate overview groups the schemes as follows. This is a broad classification, not a complete comparison of current benefits, common-law rights, exceptions or deadlines.
Rank #3
- Installs in Moments - Includes Hook and Loop Straps
- Universal Design - Adjustable Fit
- 47.75" Wide x 23" Height
- Palclear PVC - Transparent, Durable & Practical - Easy Clean and Anti-Scuff
- Made in the USA
| Classification in SIRA’s overview | Jurisdictions listed | What the classification means at a high level |
|---|---|---|
| Fault-based | Queensland, South Australia and Western Australia | An injured person may need to establish that another party was at fault to qualify for relevant benefits or compensation; details vary by scheme. |
| No-fault | Victoria, Tasmania, the Australian Capital Territory and the Northern Territory | Some benefits may be available even if the injured person was at fault; the particular benefits and conditions depend on the local scheme. |
SIRA describes its interstate overview as brief and warns that information may change. The classification should not be treated as a definitive statement of an individual’s entitlement. Common-law damages, exceptions, benefit levels and time limits vary, so check the current official rules for the place where the crash occurred.
Queensland example
Queensland’s MAIC says an injured pedestrian or other road user can submit a claim to the insurer of a vehicle that may have been partly or wholly at fault. Eligible costs may include medical treatment and rehabilitation, as well as compensation. The scheme excludes vehicle and property damage and some injuries in wholly at-fault or no-fault cases.
In Queensland, the insurer investigates fault using evidence that can include police reports and witness statements. MAIC says the insurer provides a liability decision within six months after receiving a correctly lodged claim. This is a Queensland process detail, not a national deadline.

Other jurisdiction-specific rules
NSW SIRA says its scheme protects pedestrians and other road users and, to a limited extent, the driver at fault, as well as close relatives of people killed in a crash. South Australia’s CTP regulator says policy breaches such as drink or drug driving, dangerous driving or intentionally causing injury may allow the insurer to recover claim costs from the insured. These are jurisdiction-specific examples, not rules that should be applied across Australia without checking the relevant scheme.

Evidence helps police, insurers and courts assess what happened, but no single record guarantees a particular outcome. Depending on the issue being decided, relevant material may include:
- Vehicle registration details and information about who was driving.
- Witness accounts and contact details.
- Police reports, an accident diagram and photographs.
- Medical reports and records of treatment or rehabilitation.
- Evidence of financial losses, such as income loss or other claimed expenses.
Queensland MAIC identifies police reports and witness statements as material to an insurer’s fault investigation, and medical reports and evidence of financial losses as claim documents. Legal Aid NSW recommends witness statements, a crash diagram and photographs in crash matters. These records can help establish facts; they do not predetermine liability or compensation.

What to do after a crash
If the collision is happening now
Prioritise emergency care and follow directions from emergency services and local police. NSW Legal Aid says police must be called in circumstances including when someone is injured or trapped, hazards or traffic direction require police, a vehicle needs towing, details have not been exchanged, or a driver appears affected by alcohol or drugs. That is NSW guidance; for a live emergency, follow the applicable emergency service and police instructions.
If you are injured or helping someone make a claim
- Keep available records of the crash, including registration details, witness contacts, photographs and police information.
- Keep medical reports and records of expenses or financial loss that may be relevant to a claim.
- Identify the state or territory where the crash occurred, then check that jurisdiction’s current motor injury scheme rules and claim process.
- Do not assume another state’s claim deadline, exclusions or benefits apply. In Queensland, MAIC acknowledges claimants may seek legal advice.
For a specific collision, the responsible person and any compensation entitlement cannot be determined from the fact that a vehicle struck a crowd alone. The applicable jurisdiction, investigation findings and individual evidence are essential.
