Who Has Legal Authority Over an Aircraft in International Airspace?

There is no single state with exclusive authority over every aspect of an aircraft in international airspace. If “international airspace” means airspace over the high seas, no state has territorial sovereignty there; flight rules established under the Chicago Convention still apply. The aircraft’s state of registration has an important nationality-based role, while jurisdiction over an onboard offence can also depend on the state where the aircraft lands, the operator, and which treaties apply.

What “international airspace” means

“International airspace” is commonly used as shorthand for airspace over the high seas. It is not a single legal category that answers every question about who may regulate a flight or deal with an incident. The answer changes depending on whether the issue is sovereignty over the airspace, rules of flight, aircraft nationality, operational safety, or criminal jurisdiction.

The Chicago Convention draws the basic territorial line: each state has complete and exclusive sovereignty over the airspace above its territory, which for purposes of the Convention includes its land and adjacent territorial waters. That principle concerns airspace above a state’s territory, not the high seas. (Chicago Convention, Articles 1–3.)

Which flight rules apply over the high seas?

High-seas airspace is not a rules-free zone. Article 12 of the Chicago Convention states: “Over the high seas, the rules in force shall be those established under this Convention.” Contracting states also undertake to ensure that aircraft carrying their nationality mark comply with applicable rules of flight and manoeuvre wherever they fly, and to ensure prosecution of people who violate applicable rules. (Chicago Convention, Article 12.)

  • HIGH QUALITY MICROPHONE - Equipped with an advanced noise canceling electret microphone, you can ensure your communication remains clear and uninterrupted.
  • PROTECT YOUR INVESTMENT - A custom padded headset bag is included to protect your headset outside of flying times. This bag is FREE when purchasing the headset.

This is distinct from territorial sovereignty. The Convention provides an agreed framework for civil aviation rules over the high seas; it does not make one state sovereign over that airspace.

What authority does the state of registration have?

Under Article 17 of the Chicago Convention, an aircraft has the nationality of the state in which it is registered. Article 18 does not permit valid registration in more than one state at the same time. Registration therefore gives the state a continuing legal connection to the aircraft, including responsibility under Article 12 to take measures concerning compliance by aircraft bearing its nationality mark wherever they fly. (Chicago Convention, Articles 17–20.)

Bose A30 Bluetooth Aviation Headset - Lightweight Comfortable Design, Adjustable ANR and Noise Cancelling Microphone, [Dual Plug] – Black
  • UNPARALLELED COMFORT: The Bose A30 is a full-sized circumaural aviation headset with a lightweight design and 20% lower clamping force than the A20 along with soft, comfortable ear seals.
  • PRECISION-FOCUSED NOISE CANCELLING MICROPHONE: The Bose A30’s microphone is engineered for aircraft with “hot mic” or PTT systems to increase clarity and reduce background noise during transmission.
  • FAA TSO and EASA E/TSO-C139a CERTIFIED: The Bose A30’s robust design has passed 145 tests by the Bose engineering and quality assurance team to ensure endurance in challenging flight environments.
  • THREE SELECTABLE MODES OF ACTIVE NOISE CANCELLATION: Industry-leading active noise reduction with adjustable modes accommodates different use cases or pilot personal preference.
  • ACTIVE EQUALIZATION: Incoming signals are shaped and equalized for unmatched audio clarity and intelligibility to this headset with mic.

That connection does not make the registration state the exclusive authority in every situation. The aircraft may be within another state’s territorial airspace, and a separate treaty or domestic law may provide jurisdiction over particular conduct.

Who can exercise jurisdiction over an onboard offence?

The Tokyo Convention addresses offences and certain acts committed onboard aircraft within its scope. It makes the state of registration competent to exercise jurisdiction. Under the 2014 Montréal Protocol, the state where the aircraft lands can also have jurisdiction when it lands there with the alleged offender still onboard. The Protocol also provides a basis for jurisdiction for the state of the operator in a specified dry-lease situation. (Consolidated Tokyo Convention text and Montréal Protocol provisions.)

These are jurisdictional bases, not a blanket declaration that only one state may act. Whether a particular basis is available depends on the facts and on whether the relevant states are parties to the applicable instrument. ICAO publishes treaty participation and status information; check the relevant parties and instrument rather than assuming the same rules apply to every flight. (ICAO list of parties and treaty status.)

Does ICAO control or grant permission for flights?

No. ICAO is not a global air traffic authority that exercises sovereignty over high-seas airspace or decides whether each aircraft may fly through a particular zone. Its material describes responsibilities carried out by states: states are responsible for air traffic services in the airspace concerned and for timely, accurate aeronautical information. ICAO’s 1 December 2025 statement says that deciding whether a civil aircraft will be flown over a particular geographic zone is the responsibility of the stakeholders involved. ICAO also said in its 13 January 2020 clarification that member states are responsible for coordinating and publishing information about activities hazardous to civil aviation arising in their territories. Airlines assess route risks using available information. These safety and information roles do not make ICAO the authority that closes airspace or directs every flight. (ICAO clarification on airspace safety management.)

Does the answer change for a state aircraft?

Yes. The Chicago Convention’s civil aviation provisions do not apply to state aircraft. It identifies aircraft used in military, customs, and police services as state aircraft. An incident involving such an aircraft therefore requires a separate analysis; the civil-aircraft framework above should not be applied automatically. (Chicago Convention, Article 3.)

How to assess a particular incident

To identify which authority may be relevant, establish the legal issue and facts before drawing a conclusion:

  1. Locate the aircraft. Determine whether it was over a state’s land or territorial waters, or over the high seas.
  2. Identify the aircraft’s status. Establish whether it was a civil aircraft or a state aircraft.
  3. Identify the issue. A flight-rule violation, airspace-safety question, and alleged onboard offence involve different legal frameworks.
  4. Check registration and operation. Find the state of registration and, if relevant to an alleged offence, whether a dry-lease arrangement brings the operator-state provision into play.
  5. Check treaty applicability and domestic law. Confirm whether the states concerned are parties to the relevant treaty and whether its conditions are met; the treaties provide a general framework, not a determination of a specific case.

The Chicago Convention entered into force on 4 April 1947, and the Tokyo Convention entered into force on 4 December 1969, according to ICAO’s treaty history and status material. (ICAO treaty history and status.)
