Who Can See Your Federal Tax Returns? Privacy Rules and Exceptions

For U.S. federal tax returns, the default is confidentiality: the IRS generally may not disclose returns or return information unless you authorize it or a law permits it. That protection has specific exceptions, so it does not mean only you can ever see the information. This article covers federal tax information; state tax-return privacy depends on each state’s laws.

What federal tax-return privacy protects

Internal Revenue Code §6103 generally makes federal returns and return information confidential, subject to disclosures authorized elsewhere in the law. Return information can include more than the filed form itself. The IRS’s Taxpayer Bill of Rights says taxpayers may expect information they provide to the IRS not to be disclosed unless authorized by the taxpayer or by law.

The rule governs information held by the IRS and disclosures by recipients subject to the applicable restrictions. It does not make every fact about your finances secret. An employer, lender, or other person might independently possess financial information, or you might give them a return or transcript yourself. That is different from the IRS disclosing it.

Who can receive your return information

Recipient or route Why access may be allowed What limits it
A person you designate You can authorize disclosure through Form 8821, a limited oral authorization, or a third-party designee option on some tax forms. The authorization defines the information and purpose; it does not automatically grant permanent or unrestricted access.
Your representative Form 2848 appoints a qualified representative to act for you before the IRS. The representative’s authority is limited by the form and applicable rules.
A tax return preparer or tax professional A preparer receives information needed to prepare your return; certain tax advice may also receive a limited federal privilege. Preparers may not freely use or disclose client information for unrelated purposes. The tax-practitioner privilege is narrow and does not cover ordinary return-preparation communications.
A state tax agency IRC §6103(d) permits specified federal tax information to be provided for state tax administration. Access is limited to what is necessary for that purpose and subject to safeguards and restrictions on onward disclosure.
Another government agency, a court, or a law-enforcement actor IRC §6103 contains specific routes for certain purposes and proceedings. The particular legal authority, purpose, information sought, and any required procedure must fit the applicable provision; there is no blanket right of access.
Specified congressional tax committees The statute provides a route for certain committees to obtain returns and return information. Access is subject to statutory conditions and confidentiality rules; it does not make ordinary taxpayers’ returns public.

The current text of IRC §6103 is the controlling source for a particular government request. The IRS also states that government officials have no right to access beyond what §6103 explicitly provides, and that agencies cannot use tax records for a non-tax program unless legislation authorizes that access.

How to let someone deal with the IRS

Use Form 8821 for information-only access

Form 8821 lets you authorize a named person to receive specified tax information for tax or non-tax purposes. It does not let that person represent you, argue your case, or otherwise act as your representative before the IRS. The IRS’s Topic 312, “Disclosure authorizations,” explains this distinction.

Use Form 2848 to appoint a representative

Form 2848 is the power-of-attorney route for appointing a qualified representative to act before the IRS within the authority you grant. Choose it when you need representation rather than disclosure alone; the form’s scope and rules still govern what the representative can do.

Understand oral permission and form scope

Oral authorization during an IRS conversation is normally limited to that conversation, after the IRS confirms identity, subject matter, and what information may be discussed. It is not a standing permission for future calls. Written authorizations and designees also have defined scopes and expiration rules, so naming someone once should not be treated as unlimited access.

What employers, lenders, and other private parties can see

Your employer does not receive your federal return simply because it employs you. A lender does not receive it merely because you apply for credit. A private party may ask you to provide a return or transcript, and you may choose to share it, but that is not the same as the IRS giving the party access. A third party may also possess financial records independently of the IRS.

For an IRS transcript or other IRS-held tax information, the same confidentiality framework applies: someone generally needs your authorization or a valid statutory disclosure route. Do not confuse the privacy of IRS records with a guarantee that no outside person already has related financial information.

What limits access by tax professionals

Tax preparers are restricted in how they use or disclose information obtained to prepare a return. The Taxpayer Advocate Service explains that unauthorized use or disclosure may lead to civil penalties and, when knowing or reckless, criminal penalties.

That confidentiality obligation is not the same as an evidentiary privilege. The federal tax-practitioner privilege applies only to qualifying confidential tax advice by a practitioner authorized to practice before the IRS, only where attorney-client privilege would otherwise apply, and only in specified noncriminal IRS or federal court matters. It does not cover communications made for return preparation. Nor should “accountant-client privilege” be assumed to protect every conversation; any separate attorney-client privilege depends on the communication and circumstances.

How government sharing and third-party contacts work

Section 6103 authorizes certain disclosures for tax administration and other specifically defined purposes. For state tax administration, the IRS describes access controls, records, secure storage, and restrictions on passing federal tax information onward. Federal tax information cannot simply be relabeled as state information to enable disclosure to local authorities. Each state also has its own rules for state returns, so federal law does not answer every state-privacy question.

A separate rule concerns IRS contacts with third parties. For certain adjustment or collection work, the IRS generally must give reasonable advance notice before contacting an employer, neighbor, bank, or other person to obtain information, subject to exceptions. This notice framework does not mean the IRS can never contact third parties, and it does not make information those parties already hold confidential under §6103.

What to do if you suspect an improper disclosure

The IRS says taxpayers may expect appropriate action against employees, preparers, and others who wrongfully use or disclose tax information. If you believe your information was improperly disclosed, consult the IRS’s current instructions for reporting the concern and consider speaking with a qualified attorney or tax practitioner about your specific circumstances. The applicable reporting route and any remedy depend on the facts; a privacy concern alone does not establish what happened or what relief is available.
