Under Rule 138B of the Central Goods and Services Tax (CGST) Rules, 2017, a conveyance carrying goods may be intercepted for e-way bill verification on an inter-State or intra-State movement when the Commissioner, or an officer empowered by the Commissioner, authorizes the check. The physical verification is performed by the authorized proper officer. In a case involving specific information about tax evasion, another officer may physically verify a particular conveyance after obtaining the required approval.
The person in charge should be able to produce the applicable tax invoice, bill of supply, or delivery challan, together with the e-way bill or its number in an allowed electronic form. A printed e-way bill is not invariably required. The exact record depends on the transaction and transport mode, so an officer’s request should be tied to the documents prescribed for that movement rather than an unlimited demand for unrelated papers.

Who has authority to stop an e-way bill vehicle?
Rule 138B creates two separate questions: who authorizes an interception and who carries out the physical verification. The distinction matters when a driver or transporter wants to understand whether a roadside check follows the procedure in the CGST Rules.

For both inter-State and intra-State movement of goods, the Commissioner or an officer empowered by the Commissioner may authorize a proper officer to intercept a conveyance and verify the e-way bill. “Conveyance” includes the vehicle or other means carrying the goods. The rule is not limited to movement between different States; an authorized check can also concern movement within one State or Union territory.

Officer who performs the verification
The physical verification is carried out by the proper officer authorized by the Commissioner or by the empowered officer. The rule also allows another officer to physically verify a specific conveyance when that officer has specific information relating to tax evasion and obtains the necessary approval. That route is different from an unrestricted power for any officer to stop any vehicle without the authorization or approval required by the rule.
Authorization wording in a government FAQ
A Press Information Bureau FAQ published on 9 October 2026 describes interception in terms of authorization and recorded reasons. The cited CBIC compilation of Rule 138B does not use exactly that wording in the rule text supplied for this guidance. Treat the two formulations separately: the rule text is the statutory starting point, while the FAQ is an administrative explanation. Because rules, notifications and state-level procedures can change, verify the current consolidated Rule 138B and any applicable notification before relying on a procedural detail such as how reasons must be recorded.
What documents and information should be available?
Rule 138A and the official GST e-way bill FAQ point to a transaction-specific set of records. The person in charge should not assume that every movement requires all possible documents, or that one document can replace another in every case.
| Record or information | When it is generally relevant | How it may be shown |
|---|---|---|
| Tax invoice | Goods moved under a taxable supply supported by an invoice. | The applicable invoice record, in the form permitted for the transaction and current rules. |
| Bill of supply | Goods supplied in a situation where a bill of supply, rather than a tax invoice, is the prescribed document. | The bill of supply associated with the consignment. |
| Delivery challan | Goods transported for reasons other than by way of supply, where the rules require a delivery challan. | The delivery challan covering that movement. |
| E-way bill | Movement for which an e-way bill is required under the applicable threshold, exemption and movement conditions. | An e-way bill copy or the e-way bill number in an allowed electronic form. |
| Vehicle or transport particulars | Details needed to match the conveyance and the mode of transport with the e-way bill record. | For road transport, the vehicle number recorded in the e-way bill; other modes use the transport-document particulars required by the record. |
Invoice, bill of supply or delivery challan: choose the applicable one
The documents are alternatives tied to the transaction. A normal taxable supply will generally be supported by the applicable tax invoice. A movement documented with a bill of supply uses that record instead. Where goods are moved for a reason other than supply, such as a movement covered by the delivery-challan provisions, the delivery challan is the relevant accompanying document. Do not tell a driver that all three must be carried for every consignment.

The e-way bill need not be a paper printout
The GST Network’s official e-way bill FAQ says the person in charge may carry the e-way bill number electronically and quote it to the proper officer. A phone, tablet or another permitted electronic record can therefore be useful when a paper copy is unavailable. The practical requirement is that the officer can retrieve and verify the relevant e-way bill, not that every driver must possess a printed sheet.
Electronic availability does not cure an incorrect record. The e-way bill should correspond to the goods, consignor and consignee details, document number and date, and the transport information required for the mode. For road transport, the vehicle number is a key matching detail. If the vehicle changes, the e-way bill transport details must be updated as required by the portal rules before or during the movement.
Can an officer demand any other document?
The sources identified for this question support requests for the applicable invoice, bill of supply or delivery challan, e-way bill information and relevant transport particulars. They do not establish that Rule 138B gives an officer an unlimited power to demand unrelated documents. If an additional record is requested, the person in charge can politely ask which statutory requirement or movement fact makes it relevant, while continuing to cooperate with the verification and preserving the details of the interaction.

What happens during an interception?
An interception is a verification event, not automatically a finding of tax evasion or an order to seize the goods. The officer may compare the physical consignment and conveyance with the e-way bill and accompanying record, check whether the movement is covered by the applicable requirements, and record the inspection in the prescribed system.
- Keep the records ready. The driver or person in charge should have the applicable invoice, bill of supply or delivery challan and the e-way bill number or copy accessible without altering the records.
- Provide the e-way bill number electronically when needed. Quote the number to the proper officer if the record is stored electronically rather than printed.
- Identify the movement accurately. Explain whether the goods are being supplied, returned, transferred, sent for repair or moved for another non-supply reason, because that fact determines which accompanying document applies.
- Allow the prescribed verification. The officer can check the goods, vehicle details and records within the authority granted by the CGST Rules and applicable orders.
- Record discrepancies carefully. If the officer identifies a mismatch, note the exact issue, the documents examined and any written direction or notice issued.
Inspection reports and the rule against routine repeat checks
Online report deadlines
Rule 138C requires the proper officer to record a summary report of each transit inspection online in Part A of FORM GST EWB-03 within 24 hours. The final report is to be entered in Part B within three days, subject to the extension provision in the rule. These periods are measured from midnight of the date on which the vehicle was intercepted, as stated in the rule’s explanation.
The reporting requirement is directed at the officer and the system record. A driver does not create the EWB-03 report, but the transporter should retain the interception details and any notice or acknowledgment that helps establish what occurred.
When a second physical verification is restricted
After a physical verification during transit at one place in a State or Union territory, another physical verification should not ordinarily be carried out in that same State or Union territory. Rule 138C allows an exception when specific information relating to tax evasion becomes available later. The restriction is therefore not a promise that no officer can ever stop the vehicle again anywhere; it is a safeguard against routine repeat physical checks in the same State or Union territory unless the stated exception applies.

What if detention lasts more than 30 minutes?
Rule 138D gives the transporter a recording facility when an intercepted vehicle is detained for more than 30 minutes. The transporter may upload information about the detention in FORM GST EWB-04 on the common portal.
FORM GST EWB-04 is an online record of the delay. It is not described in the rule as an automatic release application, a substitute for responding to a notice, or a guarantee that the goods must be released immediately. The transporter should enter accurate details, preserve the submission acknowledgment and continue to follow any lawful instruction or proceedings connected with the interception.

The PIB FAQ discusses situations in which electronic consignment information is absent or prescribed documents are missing and refers to possible inspection or action under section 129 of the CGST Act. That FAQ is a summary and does not replace the current Act, rules, notifications and the facts of the consignment.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsMissing or inconsistent records can therefore have consequences, but the consequence is not automatic merely because a vehicle was stopped. Whether detention, a notice, tax and penalty proceedings or another measure is legally available depends on the nature of the discrepancy, the applicable statutory provision and the procedure followed. A person receiving a written notice should read the cited section and deadline, obtain the underlying records and seek professional advice where the amount or dispute is significant.

Practical preparation before the vehicle leaves
For the consignor or supplier
- Confirm whether the movement requires an e-way bill under the current threshold, exemption and notification framework.
- Issue the document appropriate to the transaction: tax invoice, bill of supply or delivery challan.
- Check that the e-way bill describes the goods and matches the document number, date, consignor, consignee and transport mode.
- Enter the correct road vehicle number or the required transport-document particulars for another mode.
- Give the person in charge the e-way bill number and a reliable electronic way to retrieve it.
For the transporter and driver
- Keep the e-way bill number available offline as well as online where practical, because network coverage can be unreliable.
- Carry or be able to retrieve the applicable invoice, bill of supply or delivery challan.
- Check that the vehicle number shown to the officer is the number recorded in the e-way bill, and report a permitted vehicle change through the prescribed process.
- Note the location, time, officer’s instructions and any detention period.
- If detention exceeds 30 minutes, consider uploading the information in FORM GST EWB-04 and retain the acknowledgment.
Common mistakes and how to avoid them
Assuming paper is mandatory
The official FAQ supports quoting the e-way bill number electronically. A paper printout can be a useful backup, but it should not be described as an absolute requirement when the permitted electronic number is available.
Carrying the wrong transaction document
An invoice, bill of supply and delivery challan are not interchangeable labels. The correct choice follows the legal character of the movement. A delivery challan is especially important where goods are transported for a reason other than supply and the rules call for that document.
Confusing an interception with a seizure
Rule 138B concerns interception and verification. Any detention, tax, penalty or seizure consequence must be linked to the relevant statutory provision and procedural facts; it should not be presented as an automatic result of every check.
Assuming a previous check bars every later stop
The repeat-verification protection in Rule 138C concerns another physical verification in the same State or Union territory after a transit inspection. Specific later information relating to tax evasion is an express exception.
What to verify when rules or notifications change
The CBIC rules compilation cited for Rules 138A to 138D is a dated compilation, and official FAQ pages can be updated. Before relying on a checklist for a live consignment, confirm the current consolidated text of Rules 138A, 138B, 138C and 138D, later Central notifications and any applicable State or Union territory instructions.
Pay particular attention to the e-way bill threshold, exemptions, special movement conditions, document requirements for the mode of transport and the current process for updating vehicle details. Those matters depend on the consignment and may not be resolved by a general FAQ alone.
Quick Recap
Quick answer for the roadside check
- Who may authorize the interception? The Commissioner or an officer empowered by the Commissioner, for inter-State or intra-State movement.
- Who performs physical verification? The authorized proper officer; another officer may verify a specific conveyance where specific tax-evasion information and the required approval exist.
- What should be available? The applicable tax invoice, bill of supply or delivery challan, plus the e-way bill or its number and relevant transport details.
- Must the e-way bill be printed? Not invariably; the official FAQ allows the number to be carried electronically and quoted.
- Can a second check occur in the same State or Union territory? Not ordinarily after a completed transit physical verification, unless specific information relating to tax evasion subsequently becomes available.
- What if the vehicle is held over 30 minutes? The transporter may upload detention information in FORM GST EWB-04; this records the delay but does not itself guarantee release.
