For Indian GST, construction-related input tax credit (ITC) is not decided simply by whether the business makes taxable supplies. Section 17(5)(c) blocks certain works-contract services used to construct immovable property; section 17(5)(d) separately addresses goods or services used for construction of immovable property on a taxable person’s own account. The procurement route, property, capitalisation, and claim period all matter. Ordinary ITC eligibility under section 16 does not override either block.
Which construction credits are blocked?
Sections 17(5)(c) and 17(5)(d) address different situations. The first concerns a recipient’s input service that is a works-contract service. The second concerns goods or services used for construction on the recipient’s own account. Apply the relevant clause to the facts rather than treating all construction spending as one category.

| Question | Section 17(5)(c) | Section 17(5)(d) |
|---|---|---|
| What does it cover? | Works-contract services supplied for construction of immovable property other than plant and machinery. | Goods or services received for construction of immovable property on the taxable person’s own account. |
| Does business use alone remove the block? | No. The clause’s stated exception concerns a works-contract input service used for a further supply of works-contract service. | No. The clause expressly includes own-account construction even where the property is used in the course or furtherance of business. |
| What exception or qualification is especially relevant? | The further-supply-of-works-contract-service exception. | The provision’s “plant or machinery” wording, the interpretation in Safari Retreats, and any later amendment applicable to the claim period. |
When does a contract count as a works contract?
The statutory definition covers a contract for building, construction, fabrication, completion, erection, installation, fitting out, improvement, modification, repair, maintenance, renovation, alteration, or commissioning of immovable property, where transfer of property in goods is involved in executing the contract. Classification depends on the supplier’s contract and the work performed. A pure service or a supply of goods alone is not automatically a works contract under this definition.
The exception for onward works-contract supplies
Section 17(5)(c) allows the relevant works-contract input service when it is an input service for a further supply of works-contract service. This is a specific downstream exception, not a general allowance for every contractor, developer, or taxable business. Check that the onward supply is itself a works-contract service and that the inward service is used as its input.

How does own-account construction affect ITC?
Section 17(5)(d) addresses goods or services received for construction of immovable property on the taxable person’s own account. The provision says this applies even if the property is used in the course or furtherance of business. Consequently, a business purpose or taxable outward activity does not by itself make construction credit available.
The clause’s plant-related wording requires particular care. In Safari Retreats, decided on October 3, 2024, the Supreme Court distinguished “plant or machinery” in clause (d) from the defined phrase “plant and machinery.” It said: “Functionality test will have to be applied to decide whether a building is a plant.” Whether a building qualifies as a plant was described as a fact question, assessed in light of the business and the building’s role. The Court’s reasoning does not mean every commercial, rental, or business building qualifies.

The GST Council’s 55th meeting record and CBIC’s corresponding press release state that the Council recommended replacing “plant or machinery” with “plant and machinery” in section 17(5)(d), retrospectively from July 1, 2017. A Council recommendation is not, by itself, proof that Parliament enacted an amendment or that it commenced. The materials available for this article do not establish the later central enactment and commencement status. Before relying on either the recommendation or Safari Retreats for a claim, check the central Act text and effective date applicable to that claim period.

For clauses (c) and (d), the statutory explanation includes reconstruction, renovation, additions, alterations, and repairs within “construction” to the extent they are capitalised to the immovable property. That makes both the nature of the work and its accounting treatment relevant. The wording does not state that every routine repair or maintenance invoice is blocked merely because it relates to a building; it ties these listed activities to capitalisation.

How do common real-estate situations fit the rules?
Developer constructing units for taxable pre-completion sale
Taxable intended sales do not automatically settle the ITC question. Identify the inward supplies and determine whether the procurement falls under clause (c), clause (d), or neither; then apply any relevant exception and the ordinary eligibility rules. Do not infer availability solely from the tax treatment of the planned outward supply.
Contractor using subcontract works-contract services
Check whether the contractor makes a further supply of works-contract service and whether the subcontract service is an input to that supply. If both conditions fit the statutory exception, clause (c)’s exception may apply. It does not create a general exception for other construction-related business costs.
Business constructing its own office, warehouse, mall, or rental premises
Own-account construction used in business is within clause (d)’s stated scope. For a building-as-plant argument, document the building’s actual function and role in the business, and verify the central statutory wording and effective date for the relevant claim period. A building’s commercial use or rental income alone does not establish the functionality test.

Separate machinery and equipment at a site
Do not automatically treat separately identifiable machinery as part of the building. The statutory definition of “plant and machinery” covers apparatus, equipment, and machinery fixed to earth by foundation or structural support and used to make outward supplies; it also includes those foundations and supports. It excludes land, buildings or other civil structures, telecommunication towers, and pipelines outside factory premises. Apply the definition to the particular item and distinguish it from the civil structure.

What should you check before taking construction ITC?
- Identify the inward supply. Determine whether it is goods, a service, or a supplier contract that meets the statutory works-contract definition.
- Establish who is constructing and for what arrangement. Distinguish own-account construction from an inward works-contract service used to make a further works-contract supply.
- Classify the property and assets. Separate an immovable building or civil structure from equipment that may meet the plant-and-machinery definition.
- Review capitalisation. For reconstruction, renovation, additions, alterations, and repairs, determine whether the cost is capitalised to the immovable property.
- Record the property’s actual function where relevant. If relying on a plant argument under clause (d), retain evidence of how the building functions in the business and its relationship to outward supplies.
- Verify the law for the claim period. Check the central CGST Act wording, any enacted amendment and commencement date, and applicable ordinary section 16 conditions. A Council recommendation alone does not establish an operative amendment.
Which facts usually decide the result?
- Whether the inward supply is a defined works-contract service or another type of supply.
- Whether the work is on the recipient’s own account or supports an onward works-contract supply.
- Whether the cost relates to immovable property or to separately identifiable plant and machinery.
- Whether relevant repair, renovation, addition, or alteration costs are capitalised.
- The property’s actual function and its role in the business, where the plant analysis is relied on.
- The claim period and the central statutory text and commencement position then applicable.
