As of 3 October 2026, the International Criminal Court (ICC) lists 125 States Parties to the Rome Statute. “Member” is common shorthand for a country that has joined that treaty; it does not mean the ICC is investigating or prosecuting that country. The ICC’s official roster is the source for the current list.

Which countries are members of the ICC?

The ICC roster lists these 125 States Parties to the Rome Statute, using the names shown on the roster:

What does ICC membership mean?

The formal designation is “State Party to the Rome Statute,” the treaty that established the Court. The Statute entered into force on 1 July 2002. Treaty participation is separate from membership in the United Nations, and being a State Party does not by itself mean that a country is the subject of an ICC case. See the ICC roster and the Rome Statute.

The ICC groups its 125 States Parties by region as follows:

  • Africa: 33
  • Asia-Pacific: 19
  • Eastern Europe: 20
  • Latin America and the Caribbean: 28
  • Western Europe and other States: 25

Have any countries withdrawn?

A government’s announcement or initial steps toward withdrawal do not necessarily mean that its membership has ended. Under Article 127 of the Rome Statute, withdrawal requires written notification to the UN Secretary-General and normally takes effect one year after the notification is received, unless a later date is specified. The article also preserves obligations accrued while the state was a party, certain cooperation duties, and consideration of matters already before the Court.

Article 127(2) states: “A State shall not be discharged, by reason of its withdrawal, from the obligations arising from this Statute while it was a Party to the Statute, including any financial obligations which may have accrued.”

Naoero (Nauru)

Naoero remains on the ICC’s roster. On 30 September 2026, the Assembly Presidency said it had taken note of Naoero’s steps towards withdrawal, urged it to remain committed as a State Party, and recalled that withdrawal does not erase obligations from the period of membership. Those steps should not be described as an effective exit. See the ICC roster and the Assembly Presidency’s statement on Naoero.

Hungary

Hungary remains a State Party. On 25 May 2026, the Assembly Presidency welcomed the Hungarian government’s decision to discontinue its withdrawal process and remain in the treaty. See the ICC roster and the statement on Hungary.

Where can you verify the list?

For the clearest current country list, consult the ICC’s States Parties roster. The UN Treaty Collection record is the treaty-depositary record of participation. These sources describe treaty status; the ICC roster is the most direct reference for the Court’s States Parties.
