Which Business Vehicle Expenses Qualify for GST Input Tax Credit in India?

In India, business use alone does not make a vehicle expense eligible for GST input tax credit (ITC). ITC is generally blocked on ordinary passenger cars with an approved seating capacity of up to 13 persons, including the driver, and on specified insurance, servicing, repair and maintenance related to those vehicles. Exceptions can apply when a covered vehicle is used for certain taxable outward supplies. Goods vehicles are not automatically caught by this passenger-vehicle restriction, but must still meet the usual ITC rules and any other applicable restrictions.

Which vehicle expenses are generally eligible?

The central GST rules treat passenger vehicles, goods vehicles and expenses connected with a vehicle differently. Use this table as a starting point; the vehicle’s classification, the business’s outward supplies and the particular invoice can change the result. The controlling provisions are in sections 16 and 17 of the CGST Act.

Expense General treatment What may change the result
Purchase of a passenger vehicle with approved seating capacity of up to 13 persons, including the driver ITC is generally blocked, even if the vehicle is a business asset. Credit may be available when the vehicle is used to make taxable outward supplies by further supplying the vehicle, transporting passengers or imparting driving training. Ordinary business or staff travel is not, by itself, one of these listed uses. CGST Act, section 17(5); CBIC FAQ 127.
Insurance, servicing, repair or maintenance related to a vehicle in the restricted passenger-vehicle class Generally blocked along with the vehicle-related services specified in the Act. Specified taxable uses can qualify for an exception. The Act also provides exceptions for a manufacturer and for a qualifying insurer. Check the relevant statutory wording against the recipient and the vehicle’s use. CGST Act, section 17(5).
Lease, rental or hire of a covered passenger vehicle Generally restricted; a business purpose on its own does not remove the block. Specified taxable uses and the statutory proviso concerning outward supplies of the same category, or qualifying composite or mixed supplies, can affect eligibility. Assess the contract and what the business supplies onward. CGST Act, section 17(5); CBIC Circular 172/04/2022-GST.
Rent-a-cab service CBIC’s sectoral FAQ gives a general answer that ITC is unavailable. Do not apply that summary without checking the statutory exceptions and the exact supply arrangement. CBIC Sectoral FAQs; CGST Act, section 17(5).
Purchase and running costs of a goods vehicle Not automatically blocked by the specific restriction for covered passenger vehicles. Confirm the vehicle’s legal classification and use, then apply the ordinary business-use, taxable-supply, documentation and other blocked-credit rules. CGST Act, sections 16 and 17; CBIC Sectoral FAQs.
Petrol, diesel or other fuel Do not assume that fuel qualifies because the vehicle is used for business. Check whether GST was charged on the particular fuel for the relevant tax period and whether the applicable rules permit credit. The treatment of each fuel is not established by the sources cited here; section 9 of the Act addresses notification of GST on specified petroleum products. CGST Act.

How to test a vehicle claim

Apply these checks to the specific vehicle and expense before claiming credit. The order matters: a claim that falls within a statutory block does not become eligible simply because the business has an invoice or uses the vehicle for work.

  1. Identify the vehicle and its classification. Record its design, legal classification and approved seating capacity. The passenger-vehicle restriction applies to the covered class with seating for no more than 13 persons including the driver. Specialized vehicles require a classification-specific assessment; a CBIC FAQ discusses earth-moving machinery and notes that tippers and dumpers may not fall within the Motor Vehicles Act definition cited there, but that does not settle the classification of every specialized vehicle. CGST Act, section 17(5); CBIC Sectoral FAQs.
  2. For a covered passenger vehicle, identify the taxable outward activity. Ask whether the vehicle is used for further taxable supply of the vehicle, taxable passenger transportation or driving training. A company car used for ordinary staff or business travel does not qualify under one of these exceptions merely because the travel supports the business. CBIC’s FAQ likewise cautions that capital expenditure on a car is not enough to establish eligibility. CGST Act, section 17(5); CBIC FAQ 127.
  3. Separate the vehicle from related services and arrangements. Check whether the claim is for buying the vehicle, insuring or maintaining it, or leasing, renting or hiring it. For a covered vehicle, the Act names specified related services and vehicle leasing, renting and hiring; their exceptions depend on the statutory use and, in some cases, the outward supply. CGST Act, section 17(5); CBIC Circular 172/04/2022-GST.
  4. Check the ordinary ITC conditions. Section 16 requires business use or intended business use and statutory conditions that include a prescribed tax invoice or debit note, receipt of the goods or services, supplier-furnished invoice details communicated as required, payment of tax to the government and filing the return. Further conditions and time limits can apply. CGST Act, section 16.
  5. Apportion mixed use and screen for other blocks. If an otherwise eligible input or capital good serves both business and non-business purposes, restrict credit to the attributable business portion. If it relates to both taxable or zero-rated supplies and exempt supplies, restrict credit to the attributable eligible portion. Also check other section 17(5) restrictions, including tax paid under the composition scheme and goods or services used for personal consumption. CGST Act, sections 17(1), 17(2) and 17(5); CBIC Input Tax Credit Rules.

Important distinctions that can change the answer

Passenger vehicle versus goods vehicle

The specific vehicle restriction is framed around a passenger-vehicle class, not every motor vehicle. A goods vehicle therefore is not automatically blocked by that rule. That distinction is only the first step: eligibility still depends on its classification and use, the general ITC conditions, any business or exempt-supply apportionment, and any other applicable restriction. CGST Act, sections 16 and 17.

Business travel versus a listed taxable use

Using a car to visit clients, carry employees or support operations may serve the business, but those facts do not themselves establish one of the passenger-vehicle exceptions. For a covered passenger vehicle, connect the claim to further taxable supply of the vehicle, taxable passenger transportation or driving training. CGST Act, section 17(5).

Buying a vehicle versus buying a cab service

A vehicle purchase, a lease or rental of a vehicle, and a rent-a-cab service are not interchangeable transactions. The Act addresses vehicle leasing, renting and hiring, while CBIC’s sectoral FAQ gives a general rent-a-cab answer. Read that FAQ alongside the statutory exceptions and the transaction’s actual terms rather than treating its short answer as a complete test. CBIC Sectoral FAQs; CGST Act, section 17(5).

Check the law for the tax period you are filing

CBIC Circular 172/04/2022-GST discusses interpretation of section 17(5)(b), including the scope of its proviso and the reference to leasing. A circular can help interpret the provision, but it does not replace checking the statutory text and the facts of the transaction. Read the circular.

The CBIC Act compilation identified in the official materials is stated to be as of 1 January 2022. Because amendments, notifications and later clarifications can affect a filing position, verify the law effective for the relevant tax period, along with applicable central, state or IGST context, invoice facts and current case law.
