Coca-leaf activity is lawful or specifically regulated in Bolivia, Peru, and Argentina under different rules; Colombia describes a narrower, purpose-specific framework for coca seeds. None of these examples makes coca generally legal, and permission to possess or use leaves does not automatically permit cultivation, sale, import, or export. The rules below reflect official materials available as of October 4, 2026—not a complete worldwide survey.
What “coca is legal” means—and what it does not
Coca is the plant and its leaves; cocaine is a different substance. The country rules below concern the plant or leaf and specified traditional, medical, scientific, or industrial activity. They do not authorize processing coca into cocaine.

Legality depends on the activity and the country: possessing leaves, chewing or infusing them, growing the plant, selling or processing leaves, and carrying them across a border are separate legal questions. A domestic exception is not an import permit, and a lawful use in one country does not make the same conduct lawful elsewhere.
How the documented country rules compare
| Jurisdiction | Possession or use | Cultivation | Domestic commerce | Import or transit |
|---|---|---|---|---|
| Bolivia | Traditional chewing and natural-state cultural or medicinal use, including infusions, are covered by Bolivia’s reservation to the 1988 Convention, subject to controls. | Allowed only to the extent necessary for those lawful purposes; cultivation remains controlled. | Trade is covered only to the extent necessary for the specified lawful purposes, with controls. | Not established by the cited treaty reservation. |
| Peru | The cited government materials describe legal coca production as serving traditional chewing demand; they do not establish a general personal-use rule for every circumstance. | Legal production is limited to registered plots; production from unregistered plots is outside the law under the 2016 implementing regulation. | ENACO has an authorized role in collecting, industrializing, and commercializing legal leaf and derivatives; other actors require applicable authorization. | Not established by the cited Peruvian materials. |
| Argentina | Law 23,737 says possession and consumption of natural coca leaves for chewing or infusion are not treated as narcotic possession or consumption. | Not established by that statutory exception. | Not established by that statutory exception. | Decree 648/1978 prohibits importing leaves for habitual consumption or chewing nationwide. |
| Colombia | The Justice Ministry describes a regulated framework for possession and use of coca seeds for specified medical, scientific, and industrial purposes. | The described seed pathway is purpose-specific and requires a project or detailed activity description. | General commercial sale is not established by the ministry’s summary. | Not established by the cited ministry summary. |
Country rules in detail
Bolivia: a controlled traditional-use reservation
Bolivia’s reservation to the 1988 drug convention preserves the right to allow traditional chewing and the consumption and use of coca leaf in its natural state for cultural and medicinal purposes, including infusions. It also covers cultivation, trade, and possession only to the extent necessary for those lawful purposes. The reservation says Bolivia will continue controlling cultivation to prevent abuse and illicit narcotics production from the leaves. It is a bounded domestic exception, not unrestricted permission to grow coca or produce cocaine.

Peru: registration and authorization matter
Peru’s 2016 implementing regulation puts lawful production on registered plots; production from unregistered plots is outside the law. ENACO is the state entity authorized to collect, process, and commercialize legal coca leaf and derivatives, and the government describes its role as meeting lawful traditional-chewing demand. Third-party commercial activity requires applicable authorization. It is therefore inaccurate to treat every coca plant or sale in Peru as legal.
Argentina: possession exception, separate import ban
Article 15 of consolidated Law 23,737 provides a narrow exception: possession and consumption of natural coca leaves intended for chewing or infusion are not considered possession or consumption of narcotic drugs. That wording does not itself establish a right to cultivate or sell leaves.

- Mammoth Poppy: Somniferum is the variety of poppy whose seeds are most often used in culinary activities and baking. The seed oil is also used for a variety of purposes such as making paints, varnishes and salad dressings. This variety is valued because it produces a lot of seeds.
- Large Showy Blooms: Produces oversized, papery flowers typically 4–6 inches across in shades of red, pink, white, and purple, creating strong visual impact in garden spaces.
- Low-Maintenance Annuals: These poppies require minimal care beyond initial planting and occasional deadheading. Fertilizing is optional; a light dose of balanced fertilizer encourages stronger stems and extended blooms.
- Tall Upright Growth: Plants grow approximately 3–5 feet tall with sturdy stems, making them ideal for back borders and mixed flower beds.
- Low Maintenance Annual: Requires minimal care beyond watering during establishment; plants can self-seed if pods are left to mature naturally.
Decree 648/1978 separately prohibits importing coca leaves for habitual consumption or “coqueo” throughout Argentina. Anyone traveling with leaves should check the current customs and border rules for the origin, every transit country, and the destination rather than relying on Argentina’s domestic possession exception.

Colombia’s Ministry of Justice describes a regulated framework for possessing, cultivating, and using coca seeds for medical, scientific, and industrial purposes. Its summary calls for a project or detailed activity description that covers objectives, justification, seed source, projected quantities, and intended uses at each stage. For proposed medical use, it also specifies an approved therapeutic indication. This ministry summary does not establish general permission for personal cultivation or commercial sale; it is not a substitute for checking the underlying current regulation before acting.
How international controls fit with national rules
International control and nationally regulated lawful uses coexist. On December 10, 2025, the World Health Organization reported that its Expert Committee on Drug Dependence recommended that coca leaf remain in Schedule I of the 1961 Single Convention on Narcotic Drugs. The recommendation followed the committee’s 48th meeting in Geneva on October 20–22, 2025; it was not a change to the Convention. WHO also described the framework as allowing legitimate traditional, medical, and scientific use in countries where coca is produced and used, while controlling diversion for non-medical cocaine production.

- Check the law and customs rules of the departure country, every transit country, and the destination.
- Do not infer an import, export, transit, or mailing right from permission to possess or use leaves domestically.
- Check separately if the item is a coca-derived product or processed derivative; the country rules summarized here do not settle those products’ legality.
The official materials summarized here document distinct rules in four countries, not a complete list of every jurisdiction where coca may be grown, possessed, used, or sold. For travel or cultivation, confirm the current rules with the relevant national authority before acting.
