If an advance was received, the point of taxation for that advance was generally the date of receipt. For other amounts, the relevant event was usually the earlier of invoice issuance or payment receipt when either occurred before the service was provided. A continuous-supply contract followed a separate rule: a stage or periodic amount was generally treated as provided on its contractual payment due date, unless an earlier invoice or receipt fixed the point for that amount.
This is a historical service-tax analysis. The Point of Taxation Rules commenced on 1 April 2011, and GST replaced service tax for new supplies from 1 July 2017. A transaction after that changeover must be tested under GST law and its transition provisions, not automatically under the service-tax rules.

First establish which tax regime applies
Service tax timing cannot be decided without identifying the date of the transaction and the version of the law then in force. Notification No. 18/2011-Service Tax was issued on 1 March 2011 and stated that the Point of Taxation Rules, 2011 would come into force on 1 April 2011. Those rules governed the timing of service tax for the relevant legacy period, subject to later amendments and transitional provisions.

How an advance triggered service tax
The ordinary point-of-taxation rule looked at the service, the invoice and the payment. Where an invoice was issued or payment was received before the service was provided, the point of taxation for the amount covered was the earlier of those events. The rule contains a specific advance explanation:
“Explanation.- For the purposes of this rule, wherever any advance, by whatever name known, is received by the service provider towards the provision of taxable service, the point of taxation shall be the date of receipt of each such advance.”
The practical consequence is important for construction contracts. A provider generally could not wait for completion of the building, phase or work order before accounting for service tax on an advance that had already been received for a taxable service. Each receipt had to be examined separately and connected to the service or portion that it funded.
What counts as the decisive event
| Event | Why it matters under the legacy rule | What must be identified |
|---|---|---|
| Receipt of an advance | The point of taxation for that advance was the date it was received. | The actual receipt date, amount, payer and service or stage to which it relates. |
| Invoice issued before service | The invoice date could establish the point of taxation for the amount covered, unless an earlier payment had already done so. | Invoice date, amount, description and whether it covered the same portion as the payment. |
| Payment received before service | Payment receipt could establish the point of taxation before work was performed. | Bank or other reliable receipt evidence and the contractual allocation of the payment. |
| Service provided before invoice or payment | The service-provision event may be relevant because neither a prior invoice nor a prior receipt occurred. | When the relevant service or portion was actually provided under the contract. |
Contract labels do not change the timing merely because a receipt is called a “deposit,” “mobilisation amount,” “security,” “part payment” or another name. The rule refers to an advance “by whatever name known” when it is received toward a taxable service.
Part payments under a continuous-supply contract
Construction arrangements often involve work over time, with monthly bills, stage certificates or milestone instalments. For a continuous supply of service where all or part of the service was payable periodically or from time to time, Rule 6 provided a different timing framework. Its wording states:

- Ergonomically Designed: Work in tight areas with a compact design that gets into tough spots
- Both tools are designed to fit into difficult to reach spaces
- Complete a wide range of applications with a high-performance motor that delivers up to 300 UWO, and an impact driver delivering up to 1,400 in-lbs of torque
- Both the DEWALT impact driver and drill driver feature integrated LED work lights with a convenient 20-second delay, ensuring enhanced visibility in dimly lit or challenging work areas
- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
“In case of continuous supply of service, the whole or part of which is determined or payable periodically or from time to time, shall be treated as separately provided at the date on which the payment is liable to be made by the service receiver, if such date is specified in the contract.”
Accordingly, the payment due date specified in the contract could be the point of taxation for that separately identified portion. That does not make the due date interchangeable with the invoice date or the date money reached the provider. If an invoice was issued earlier, or the customer actually paid earlier, the earlier event could fix the point for the amount covered.

Comparing an advance with a milestone instalment
| Question | Advance before the work | Contractual milestone or periodic amount |
|---|---|---|
| What starts the analysis? | Receipt of money toward the taxable service. | The continuous-supply terms and the specified contractual payment date. |
| Can completion be awaited? | Generally no for the amount already received as an advance. | Generally no once the contractual due date, an earlier invoice or an earlier receipt applies to that portion. |
| Which records are central? | Receipt evidence and the allocation of the advance. | Agreement, stage schedule, due date, invoice and receipt records. |
| What must be separated? | Each advance and the service it funds. | Each stage or periodic portion and the event that occurred first for that amount. |
A practical timing test
Use the following sequence for a legacy transaction. It is a fact-finding method, not a substitute for checking the exact notification, amendment or transition provision applicable to the period.
- Fix the date and legal regime. Record when the agreement was made, when each invoice was issued, when each payment was received and when the relevant work was provided. Determine whether the event falls under service tax, GST or a transition rule.
- Identify the supply. Confirm that the transaction is a taxable service for the period under review. A construction-related receipt is not enough by itself; classification, exclusions, exemptions and any abatement must be checked.
- Break the contract into amounts. List the advance, each instalment, retention, variation and other receipt separately. Link every amount to a defined work package, stage or service portion rather than treating the contract price as one undifferentiated sum.
- Test for an advance. If money was received toward a taxable service before that service or portion was provided, use the date of receipt for that advance under the specific explanation to the ordinary rule.
- Compare invoice and payment dates. For an amount not governed solely by the advance explanation, compare when the service was provided or was to be provided with invoice issuance and payment receipt. Where invoice or payment preceded provision, the earlier invoice or receipt generally controls the covered amount.
- Test for continuous supply. If the contract requires payment periodically or from time to time, determine whether it specifies when the amount is due. For the relevant portion, the contractual due date is generally the separate-provision date, subject to an earlier invoice or actual receipt for that portion.
- Verify the amount and rate treatment. Establish the taxable value attributable to the event and check the rate, exemption, abatement and return requirements applicable to that historical period. Do not assume the full contract value became taxable merely because one instalment was received.
Worked construction examples
Example 1: mobilisation advance before site work
A contractor receives a mobilisation amount on 10 May for a taxable construction service, while physical work begins in June. The advance explanation points to 10 May for that receipt. The later start date does not postpone the point of taxation for the amount received, although the taxable classification, value and any relief still require verification.
Example 2: invoice issued before payment
An invoice for a defined stage is issued on 4 August. The customer pays on 20 August, and the stage is completed in September. Because the invoice preceded both payment and completion, the invoice date can establish the point for the amount covered, assuming the invoice is valid and the amount is the same portion under review.

Example 3: payment received before an invoice
A customer transfers an instalment on 12 September under a contract that calls for work later in the month. The invoice is raised on 18 September. For the amount received as an advance, 12 September is the relevant receipt date; the later invoice does not move that date forward.
Example 4: continuous supply with a specified due date
A long-term contract states that a certified monthly portion is payable on the 15th of the following month. If no earlier invoice is issued and no earlier payment is received, the contractual due date can be the date on which that portion is treated as separately provided. If the customer pays on the 8th, or an invoice for that portion is issued on the 5th, the earlier event can control the amount it covers.
Example 5: one receipt covering several stages
A single transfer is described as covering two milestones and future materials. The provider should allocate the receipt to the portions supported by the agreement and records. The date of receipt may trigger the advance rule for the amount received, but the value and classification of each covered portion cannot be inferred safely from the bank narration alone.
Construction classification, exemptions and valuation still matter
The timing rule answers when the point of taxation arises; it does not establish that service tax was payable in every construction arrangement. A case-specific review must determine whether the activity was a taxable service under the law then in force, whether an exemption or abatement applied, and what value belonged to the taxable portion.
Contract wording can affect that analysis. Terms may distinguish design, construction, repair, commissioning, material supply, land-related rights, completion certificates or separate work packages. The payment schedule may also identify whether an amount is a true advance, a payment for a completed stage, a reimbursable item or a retention. Those characterisations should be supported by the agreement, invoices, certificates and accounting records rather than by labels alone.

Records to preserve for a legacy review
- The signed agreement and every amendment, including the payment schedule and any clause specifying periodic or milestone due dates.
- Invoices, debit notes, credit notes and stage or measurement certificates, with issue dates and the portions they describe.
- Bank statements, receipts, remittance advice and ledger entries showing when each advance or instalment was actually received.
- Evidence of when each service portion was performed or certified, including completion or handover records where relevant.
- Tax registrations, classification analysis, exemption or abatement documents and returns for the period.
- Reconciliations that map every receipt to the corresponding taxable value and point-of-taxation event.
These records help distinguish a contractual due date from an invoice date and from the date money was actually received. That distinction is often decisive when the three dates do not coincide.
Frequent errors and how to correct them
Waiting until project completion
Completion is not a universal trigger. For an advance received toward a taxable service, the specific rule uses the receipt date. Recalculate each receipt instead of posting all tax at handover.
Treating every instalment as an advance
A milestone amount in a continuous-supply contract may be governed by its contractual due date, while an earlier invoice or payment can move the point forward. Read the payment clause and identify the portion covered before applying the advance explanation.
Using the contract due date as the payment date
A due date is a contractual entitlement; receipt is an actual event. Keep both dates in the timeline. The rule may use one or the other depending on the supply pattern and which event occurred first.

Ignoring partial or mixed receipts
Allocate a part payment to the work or value it covers. A receipt that combines several stages should not automatically be assigned wholly to the final stage or treated as unrelated security.

Applying service-tax rules to a post-GST payment
Stop the legacy analysis at the relevant transition boundary and test later supplies under GST law. A construction transaction after 1 July 2017 can involve different classification and time-of-supply questions.
Assuming timing proves liability
Even a receipt that fixes a point of taxation does not resolve whether the service was taxable, exempt, abated or correctly valued. Those issues must be examined separately.
What a case-specific opinion must establish
Before concluding on a disputed construction advance or instalment, gather the transaction date, agreement and amendments, payment schedule, invoice dates, proof and dates of receipt, description of each service portion, classification, applicable exemption or abatement and any transition notification. Then build a date-by-date schedule showing the contractual due date, invoice date, receipt date and service date for every amount.
