Indian courts have applied the Supreme Court’s Andaman Timber reasoning in GST cases, but no reviewed decision creates an unconditional right in every proceeding or guarantees the same result in every state.
The practical rule: reliance, dispute and a timely request
Cross-examination is most defensible when all of the following are present:
As an Amazon Associate I earn from qualifying purchases.
- A witness has given a statement or supplied evidence adverse to the taxpayer.
- The show-cause notice, relied-upon documents or proposed order uses that evidence to support a tax demand, penalty or other adverse finding.
- The taxpayer specifically disputes the statement’s truth, context, completeness, consistency or credibility.
- The taxpayer asks the adjudicating authority for an opportunity to question the witness while the case is still being adjudicated.
- The request explains why questioning could affect the factual or legal conclusion.
This is a practical synthesis of recent decisions, not a statutory checklist that guarantees success. The closer the witness statement is to the foundation of the proposed order, the stronger the fairness argument. A request concerning evidence that is immaterial, cumulative or never relied upon is substantially weaker.
The phrase “departmental witness” can be misleading. The reported GST disputes generally concern statements taken by the tax department from third parties—such as customers, suppliers, employees or other persons connected with an investigation. Whether a taxpayer can insist on questioning a departmental officer about every investigative act is a separate issue. The decisions discussed here focus on adverse evidence attributed to a witness and used against the taxpayer.

Why natural justice matters under the GST framework
The question is not answered only by searching for the words “right to cross-examine” in the Central Goods and Services Tax Act. Courts have connected cross-examination with the broader duty to provide a meaningful hearing when an authority relies on a person’s adverse statement.
The Delhi High Court’s judgment dated 29 July 2025 in W.P.(C) 4853/2025 discusses the opportunity of hearing under section 75(4) of the CGST Act. It records the proposition that, where a third-party statement is used against a taxpayer, the hearing may include an opportunity to test that statement by cross-examination. The exact scope still depends on the evidence and the statutory setting of the case.
The leading Supreme Court authority usually cited is Andaman Timber Industries v. Commissioner of Central Excise, Kolkata-II, decided on 2 September 2015 under central excise law, not the CGST Act. In the passage quoted by the Kerala High Court, the Supreme Court held:

“According to us, not allowing the assessee to cross-examine the witnesses by the Adjudicating Authority though the statements of those witnesses were made the basis of the impugned order is a serious flaw which makes the order nullity inasmuch as it amounted to violation of principles of natural justice because of which the assessee was adversely affected.”
That ruling does not mean every GST taxpayer automatically receives cross-examination whenever a statement appears in a file. GST High Courts have used the reasoning in their own factual and statutory contexts, while some Revenue arguments contend that the CGST Act does not grant a general, standalone right. The safer formulation is that refusal can be unlawful when it deprives the taxpayer of a meaningful opportunity to answer material adverse evidence.
When a request is strongest
The statement is actually relied upon
Identify the exact paragraph, annexure or passage that the notice or proposed order relies on. A witness may have made several statements during an investigation, but only the portions used to establish a taxable supply, undervaluation, clandestine removal, wrongful input-tax credit or intent for penalty are central. If the authority does not rely on the statement, it is harder to show that denying questioning caused procedural prejudice.

The taxpayer identifies a concrete factual dispute
State what is wrong or incomplete. Examples include a witness lacking direct knowledge, a statement recorded in circumstances that require clarification, an internal inconsistency, an omitted transaction document, or a claim that does not match the taxpayer’s books. A bare sentence saying “I want cross-examination” gives the authority less information on which to assess materiality.
The evidence could change the result
Explain the link between the disputed assertion and the proposed demand or penalty. If removing the statement would leave the department without proof of a key element, say so. If independent invoices, transport records or electronic data already establish the same fact, the authority may argue that questioning would not affect the outcome. The taxpayer should address that argument rather than assume that citing Andaman Timber is enough.
The request is made before the decision
The Madhya Pradesh High Court, in W.P. No. 12326 of 2024 (final order dated 20 May 2024), described fair hearing as requiring an opportunity to cross-examine witnesses whose evidence was relied upon in the show-cause notices, at an appropriate stage before adjudication. Waiting until after the final order makes it easier for the department to argue that the request was late or that the taxpayer accepted the procedure.

How to submit and preserve the request
- List each witness. Use the name, designation or identifying details appearing in the notice. If the department has withheld the identity, ask for sufficient particulars and the statement itself.
- Identify the relied-upon statement. Give its date, document number, page and paragraph, if available. Quote only the disputed assertion needed to identify the issue.
- Explain the dispute. Describe the factual proposition contested and why the witness’s basis of knowledge, context or credibility matters.
- Connect the evidence to the case. State whether the statement supports the proposed tax, interest, penalty, confiscation or another finding, and why questioning could affect that finding.
- Request a hearing before reliance. Ask that cross-examination occur before the authority relies on the statement in the adjudication order.
- Ask for a reasoned decision. If the authority refuses, request written reasons addressing materiality and the specific issues raised.
- Retain proof. Keep the signed letter, portal acknowledgement, email delivery record, hearing minutes and every response. Preserve the final order’s passages showing whether the statement was used.
No single application form, universal deadline or mandatory filing channel is established by the decisions summarized here. Follow the notice’s filing directions and the applicable state or central adjudication procedure. If the authority schedules a hearing, repeat the request on the record if it has not been decided.
A useful request structure
Subject: Request to cross-examine relied-upon witness(es) in [notice number]
1. Witness and statement: [name/identifier, date, document and paragraph].
2. Disputed assertions: [identify each assertion and the taxpayer’s position].
3. Materiality: [explain which proposed finding, demand or penalty depends on it].
4. Relevance of questioning: [basis of knowledge, circumstances of recording,
inconsistencies, omissions or other credibility issues to be tested].
5. Request: permit cross-examination before the statement is relied upon in the
adjudication order; if refused, issue a reasoned written decision.
6. Documents: provide copies of all relied-upon material needed to respond.
This is a practical format, not a court-prescribed template. The request should be adapted to the notice and supported by the taxpayer’s records.

Cross-examination and access to documents are different requests
A taxpayer may need both the opportunity to question a witness and copies of the material relied upon. They are related but distinct safeguards. The Madhya Pradesh decision discusses access to documents and refers to section 67(3)’s rule concerning return of documents that are not relied upon. That document-return issue does not itself decide whether cross-examination is required.
Best Value
Ask separately for the relied-upon statement, annexures, recordings or translations necessary to understand the evidence. If the department says a document is not relied upon, ask the authority to confirm that it will not be used to decide the demand or penalty. Avoid treating a document-access dispute as proof that cross-examination must automatically be granted.
What if the authority refuses or ignores the request?
A refusal can support a natural-justice challenge when the disputed statement materially supports the adverse decision and the taxpayer was not given a meaningful chance to test it. The Kerala High Court’s decision in Nishad K.U. v. The Joint Commissioner (17 December 2024) criticized an adjudicator who assumed that cross-examination would not affect credibility. The court stated:
“The Adjudicating Authority cannot presuppose or presume what could be the subject matter of the cross-examination, or what benefit would be derived by the person proceeded against, through such cross- examination.”

In practical terms, preserve four items: the original request, proof of filing, the authority’s response or silence, and the final order’s treatment of the statement. If the order relies on the witness despite an unresolved request, identify that procedural history in the statutory appeal or other available challenge.
The remedy is not automatic. Courts may set aside an order, remand it for a fresh hearing or decline relief where the evidence was immaterial, the taxpayer suffered no demonstrated prejudice, the request was not specific or the statutory remedy should be used first. Whether a writ petition is appropriate depends on the order, alternative remedies and the relevant High Court’s practice. Obtain advice on the particular record before selecting a remedy or missing an appeal limitation period.
How the reported decisions compare
| Decision | Jurisdiction and date | Point relevant to cross-examination | Important qualification |
|---|---|---|---|
| Andaman Timber Industries v. Commissioner of Central Excise, Kolkata-II | Supreme Court; 2 September 2015 | Denial of cross-examination of witnesses whose statements formed the basis of the order was described as a serious natural-justice flaw. | Central excise case, not a CGST adjudication; later GST courts apply the reasoning in their own contexts. |
| Nishad K.U. v. The Joint Commissioner | Kerala High Court; 17 December 2024 | Questioned an adjudicator’s assumption that cross-examination could not affect credibility when investigation statements were relied upon. | Outcome turns on the record and the use of the statements in that proceeding. |
| W.P. No. 12326 of 2024 | Madhya Pradesh High Court; final order 20 May 2024 | Described fair hearing as including an opportunity to cross-examine witnesses whose evidence was relied upon in show-cause notices before adjudication. | Also addressed document access; that issue is separate from the cross-examination request. |
| W.P.(C) 4853/2025 | Delhi High Court; judgment 29 July 2025 | Discussed section 75(4) of the CGST Act and the proposition that hearing may include cross-examination when adverse third-party statements are used. | The statutory and factual setting must be checked in each case. |
| M/S JSW Steel Limited proceedings | Karnataka High Court material; 13 August 2025 | Recorded competing Revenue and taxpayer arguments about whether the CGST Act itself confers a general right and how natural justice applies. | The reviewed material does not establish the final Division Bench disposition of W.A. No. 303 of 2025; verify the signed judgment and later appeals before stating a definitive Karnataka rule. |
Limits and common mistakes
- Assuming every witness must attend. The strongest cases involve material adverse statements. The decisions do not establish an unconditional right to question every departmental or third-party witness.
- Making a generic request. Failure to identify the statement, disputed facts and materiality weakens the fairness argument.
- Waiting for the final order. Ask during adjudication and renew the request at the hearing if necessary.
- Ignoring independent evidence. Explain why the witness still matters even if the department cites invoices, electronic records or other material.
- Overstating Andaman Timber. It is a Supreme Court natural-justice precedent from central excise, not a blanket GST rule that resolves every factual dispute.
- Confusing jurisdictional arguments with settled law. High Court decisions are fact-sensitive, and the Karnataka appellate position described above remains unresolved in the material available here.
A decision checklist for taxpayers
- Does the notice expressly rely on the witness statement?
- Can you identify the exact assertion that is disputed?
- Would excluding or clarifying that assertion affect the proposed demand or penalty?
- Have you requested questioning in writing before adjudication is completed?
- Have you asked for the relied-upon documents separately?
- Do you have proof of filing and a copy of every response?
- Does the final order explain why the request was granted, refused or considered unnecessary?
- Which statutory appeal or judicial-review route and limitation period apply in your jurisdiction?
Because the controlling result can depend on the state, the evidence and the procedural stage, a taxpayer should check the current signed judgments, any statutory amendments and binding authority before relying on a broad proposition.
