When Are You Entitled to Compensation for a Delayed or Canceled Flight?

By Freedom251 Team · · 9 min read

You may be entitled to fixed compensation when a covered flight arrives at its final destination at least three hours late, or when an airline cancels your flight on short notice. The result depends on the governing regime (EU or UK rules), departure and arrival airports, operating carrier, travel date, cancellation notice, re-routing offered, and the cause of the disruption. Fixed compensation is separate from your rights to a refund, re-routing, meals, accommodation, and reimbursement of reasonable expenses.

This guide explains the current EU and UK frameworks in force in October 2026. It is not a universal statement of passenger law: flights governed by another country’s rules require that country’s regulator guidance.

Start by identifying which law covers the flight

Do not choose a compensation amount before checking coverage. The departure airport, arrival airport, operating airline (the carrier actually running the flight), and date determine whether EU passenger-rights rules or UK261 apply.

When current EU passenger rights apply

Current EU guidance generally covers:

  • Flights within the EU, regardless of the airline.
  • Flights arriving in the EU from outside the EU when operated by an EU airline.
  • Flights departing the EU for a non-EU country, regardless of the airline.
  • Flights covered by the same framework in Iceland, Norway, and Switzerland, as reflected in the official guidance.

The EU rules do not apply again if you have already received benefits under the relevant non-EU passenger law for the same flight disruption.

When UK261 applies

UK261 generally covers:

  • A flight departing a UK airport, on any airline.
  • A flight arriving at a UK airport when operated by an EU or UK airline.
  • A flight arriving at an EU airport when operated by a UK airline.

A flight can therefore be covered by one regime, both at different points in a journey, or neither. Check the operating carrier rather than only the code shown on your booking.

Coverage checklist

  • Write down every departure and arrival airport.
  • Identify the operating carrier for each sector.
  • Record the scheduled and actual travel dates.
  • Check whether all sectors were on one reservation or were separate self-transfer bookings.
  • Determine whether another country’s passenger law already paid benefits for the same disruption.

Delayed flights under EU rules

Measure arrival at the final destination

For an EU-covered delay, the key test is arrival at the final destination, not simply how late the first aircraft left. A covered connection on a single reservation is assessed by the time you reach the ticketed final destination. Arrival at least three hours late can trigger compensation unless the airline establishes extraordinary circumstances.

Keep evidence of when the aircraft door opened or passengers were allowed to leave, because that is the practical arrival point used for delay claims. If you booked a self-transfer on separate reservations, the missed connection may not be treated as one protected journey under the EU framework.

EU compensation amounts for qualifying delays

Covered flight and arrival delay Standard compensation per passenger Possible 50% reduced amount when qualifying re-routing is offered
1,500 km or less; arrival at least three hours late €250 €125
Intra-EU flight over 1,500 km, or another flight between 1,500 and 3,500 km; arrival at least three hours late €400 €200
Covered flight over 3,500 km involving an EU departure or an EU arrival operated by an EU carrier; arrival at least three but under four hours late €300 €300 is not a separate 50% band; the applicable reduction depends on the re-routing terms
Other covered flights over 3,500 km; arrival at least four hours late €600 €300

The €250, €400, and €600 figures are the standard distance bands in the current Your Europe guidance. The €300 figure applies to the specified long-haul delay of at least three but under four hours. A qualifying alternative flight that gets you to the destination within the applicable legal window can reduce compensation by half; the exact window must be checked against the offer and route.

When an EU delay does not qualify for fixed compensation

Three hours is necessary but not sufficient. The airline can refuse fixed compensation when it proves that extraordinary circumstances caused the delay and that the disruption could not have been avoided even after all reasonable measures were taken. Examples in the official guidance include severe weather, natural disasters, air-traffic-control decisions, bird strikes, and political instability.

An airline label such as “technical issue” is not automatically decisive. Ask what happened, how it caused your particular delay, what measures were attempted, and why the event could not reasonably have been prevented or worked around. The carrier bears the proof burden under the current EU guidance.

Canceled flights under EU rules

Separate your remedy choice from compensation

When an EU-covered flight is canceled, you normally choose one of three one-time remedies:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Reimbursement of the ticket.
  2. Re-routing to the destination at the earliest opportunity.
  3. Re-routing at a later convenient date, subject to available seats.

Choosing one remedy does not by itself answer whether fixed compensation is also due. Compensation is a separate question based mainly on notice, the quality and timing of any alternative flight, distance, and extraordinary circumstances.

Notice and alternative-flight offers

Cancellation compensation can apply when the airline informs you less than 14 days before scheduled departure. It is generally not due when notice is given more than 14 days in advance, or when the carrier’s alternative flight meets the notice-specific departure and arrival windows set by the EU rules. An alternative can also reduce the payment by 50% when it delivers you within the applicable short-delay window.

The standard cancellation amounts before a reduction or exception are €250, €400, and €600, matching the distance bands in the EU guidance. Do not assume the largest amount: calculate the route distance, inspect the exact re-routing offer, and check the notice timestamp.

What counts as a cancellation problem

The EU guidance treats a flight as canceled in situations that include abandoning the original schedule and transferring passengers to another scheduled flight. Preserve the original itinerary, the replacement itinerary, and the message showing when the airline notified you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Care, meals, accommodation, and refunds

Fixed compensation is not the same as assistance while you wait. For covered EU disruptions, the airline must provide care after these departure-delay thresholds:

Flight distance or category Care threshold Typical assistance
Flights up to 1,500 km Two hours Meals and refreshments in reasonable relation to the waiting time, plus two communications
Intra-EU flights over 1,500 km and other flights from 1,500 to 3,000 km Three hours Meals, refreshments, and two communications
Other flights Four hours Meals, refreshments, and two communications

If the wait requires an overnight stay, care includes suitable accommodation and transport between the airport and lodging. At five hours of departure delay, you can choose ticket reimbursement and, where relevant, a return flight to the original departure point. Keep itemized receipts: necessary, reasonable, and appropriate expenses can be reimbursed when the airline did not provide the assistance.

Care is intended to cover immediate disruption needs. It is not a substitute for the separate fixed-compensation test, and an extraordinary circumstance that defeats compensation does not automatically erase an applicable duty to provide care.

Delayed and canceled flights under UK261

UK delay threshold and amounts

Under current UK guidance, compensation may apply when a covered flight reaches its destination more than three hours late. Extraordinary circumstances can defeat the payment, but care is due once the distance-based threshold is met regardless of why the covered delay occurred.

Covered flight distance and arrival delay UK compensation per passenger
Under 1,500 km £220
1,500 to 3,500 km £350
Over 3,500 km; arrival between three and four hours late £260
Over 3,500 km; arrival more than four hours late £520

These figures are the UK Civil Aviation Authority’s current guidance amounts. Apply the coverage rules first; an amount from this table cannot be claimed merely because a journey was sold in the UK.

UK care and the five-hour choice

For a covered delay, the airline should arrange appropriate food, refreshments, communications, and overnight accommodation with transport when necessary. At least five hours’ delay gives you the choice not to travel and to seek a refund for unused flights. If you arrange reasonable necessities yourself, retain an itemized receipt or invoice.

Escalating a UK claim

Claim from the airline first. If its final response is unsatisfactory, or it has not replied after eight weeks, you may be able to escalate through the airline’s approved alternative-dispute-resolution provider or the Civil Aviation Authority’s Passenger Advice and Complaints Team route. The applicable process depends on the airline and complaint type.

Why the cause of the disruption matters

Airlines are not automatically exempt whenever they cite weather, staffing, a technical fault, or an operational problem. The legally relevant questions are whether the event was extraordinary, whether it actually caused your delay or cancellation, and whether reasonable measures could have avoided the result.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For an EU claim, request the precise reason and the evidence supporting the extraordinary-circumstances defense. The airline must establish both the event and the reasonable-measures test. Comparable UK guidance describes circumstances outside the airline’s control, with examples such as severe weather and air-traffic-control restrictions.

Connections, tickets, and final-destination evidence

A single reservation is important because EU delay assessment uses the final destination of the covered itinerary. Save the booking confirmation showing the reservation number and all sectors. Record the scheduled arrival and the actual time you reached the final destination.

Separate bookings can change the analysis. If you purchased two unrelated tickets and the first delay caused you to miss the second flight, the second carrier may not owe compensation for the missed self-transfer under the same passenger-rights calculation. Other contract, insurance, or consumer-law remedies may be relevant, but they are outside this fixed-compensation test.

How to submit a claim

  1. Preserve the record. Save the booking confirmation, boarding passes, cancellation or delay notices, replacement itinerary, and proof of when the airline notified you.
  2. Calculate the final-arrival delay. Use the time you reached the final destination, not only the first departure delay. Note whether all sectors were on one reservation.
  3. Identify the governing regime. Apply the EU or UK coverage tests using the departure airport, arrival airport, operating carrier, and travel date.
  4. Separate the requests. Ask for fixed compensation, the remedy you selected after cancellation, and reimbursement of reasonable care expenses as distinct items.
  5. Request the cause in writing. If compensation is denied, ask for the specific event, its causal link to the disruption, and the legal basis for the extraordinary-circumstances decision.
  6. Attach expense evidence. Submit itemized receipts for necessary, reasonable, and appropriate meals, lodging, and transport that the airline failed to provide.
  7. Escalate when allowed. For UK claims, use the airline’s ADR provider or the CAA PACT route after an unsatisfactory final response or eight weeks without a response. Other jurisdictions have their own deadlines and enforcement bodies.

Common mistakes that weaken otherwise valid claims

  • Using the first flight’s departure delay instead of arrival at the final destination.
  • Claiming under EU or UK rules without checking the operating carrier and route.
  • Treating a code-share seller as the operating airline automatically.
  • Accepting a replacement flight without recording its proposed departure and arrival times.
  • Submitting unitemized or extravagant expenses instead of reasonable receipts.
  • Assuming every technical problem is extraordinary, or assuming every weather reference proves an exemption.
  • Confusing a refund or re-routing choice with the separate question of fixed compensation.
  • Applying the 2027 EU amendment to a flight taken before its application date.

What changes from 23 October 2027

Regulation (EU) 2026/2202 was adopted on 16 September 2026 and published in the Official Journal on 2 October 2026. It applies from 23 October 2027, not to flights governed by the existing framework in October 2026. The regulation amends provisions concerning disruption information, compensation, connections, and extraordinary circumstances.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For flights before that application date, use the existing EU regulation and current Your Europe guidance. For flights on or after 23 October 2027, check the amended text and updated official guidance because the legal tests and information duties may differ.

A practical decision checklist

  • Covered route? Confirm EU or UK scope before looking at amounts.
  • Delay? Measure arrival at the final destination; three hours is the EU threshold and more than three hours is the UK threshold, subject to the applicable rules.
  • Cancellation? Check notification timing, the alternative flight offered, and whether you selected reimbursement or re-routing.
  • Cause? Test the airline’s extraordinary-circumstances explanation and evidence.
  • Care? Claim meals, communications, accommodation, transport, and reasonable receipts separately.
  • Documentation? Keep the itinerary, notices, actual arrival record, reservation structure, and receipts.
  • Escalation? Submit to the airline first; use the available regulator or ADR route if the response is missing or inadequate.

Bottom line

You are most likely to qualify for fixed compensation when a covered EU or UK flight reaches its final destination more than three hours late, or when a covered flight is canceled with insufficient notice and the alternative offered does not meet the legal timing conditions. Distance, operating carrier, route, notice, re-routing, and the documented cause determine the result. Refunds, re-routing, meals, accommodation, and expense reimbursement are separate rights, so claim each one that applies and keep the evidence needed to prove it.
