Water-stressed jurisdictions can make a proposed data center prove that its withdrawals will not undermine existing users, water-system reliability, water quality or sensitive ecosystems. Depending on the site, approval may also require a water-source and loss inventory, conservation plan, reclaimed-water analysis, cooling-technology demonstration, public disclosure, a hearing, environmental clearance, local zoning approval or payment for supply upgrades.

There is no single nationwide checklist. The controlling requirements depend on the jurisdiction, the facility’s size and demand, its cooling and water systems, the proposed source, and which permits or land-use approvals are triggered. The examples below show how current rules and proposals operate in specific places; they are not legal advice for every project.

What a water-stressed jurisdiction can examine

Regulators generally start with the water balance rather than the server capacity alone. An application may need to identify every source—public supply, groundwater, surface water, reclaimed water, rainwater or other non-potable supplies—along with withdrawals, recirculation, treatment, discharge and losses. Reviewers can then ask whether the source is legally available, whether the use is reasonable and beneficial, and whether the project would impair existing legal users or sensitive resources.

  • Availability and competing demand: Can the supplier or aquifer meet the project’s peak and annual needs during drought and other stressed conditions?
  • System and environmental effects: Would withdrawals reduce reliability, affect water quality, draw down an aquifer, alter a stream or conflict with protected resources?
  • Cooling design: Has the applicant compared air cooling, closed-loop systems, direct liquid cooling, recycled or reclaimed water, stormwater reuse and other feasible options?
  • Conservation and losses: Will cooling water be recycled, will leaks be detected and repaired, and are fixtures, treatment and irrigation efficient?
  • Cumulative impacts: Does the project add to other data centers or industrial users drawing on the same watershed or public system?
  • Transparency and participation: Must the applicant report withdrawals and consumption, undergo a hearing, or provide information to local governments and water suppliers?

These questions can appear in separate permits. A water-allocation permit, wastewater or discharge permit, stormwater authorization, air permit, environmental clearance and local zoning decision may each impose different conditions. A favorable decision in one process does not automatically satisfy the others.

Current jurisdiction examples

Maryland: agency direction on permits, cooling and disclosure

Maryland Executive Order 01.01.2026.16 directs the Department of the Environment, when using its existing authority over water-appropriation, discharge, stormwater and air-quality permits and to the extent allowed by law, to require evidence that adequate water is available without adverse effects on existing users, system reliability, water quality or sensitive natural resources. The order is an executive direction to agencies; it does not mean every listed condition automatically applies to every facility. The order is available at Maryland Executive Order 01.01.2026.16.

The same direction calls for analysis of cooling choices that can reduce potable-water use, including closed-loop and air-cooled systems and reclaimed water. It also calls for ongoing public disclosure of withdrawals and consumption, review of cumulative effects, and examination of whether existing appropriation rules and reporting adequately account for data-center demand, reuse, drought and impacts on aquifers, surface waters and public systems. A Maryland applicant should therefore be prepared to document alternatives and cumulative effects, not merely state a total daily withdrawal.

Florida: statutory allocation findings and a 100,000-gallon trigger

Section 373.262 of the 2026 Florida Statutes bars a water-allocation permit for a large-scale data center when the proposed use would harm area water resources or conflict with applicable local zoning or comprehensive plans. The applicant must establish reasonable-beneficial use, no interference with existing legal uses and consistency with the public interest. The operative text is at the Florida Senate’s 2026 Statutes, section 373.262.

Florida’s water-management district or the department must require reclaimed water instead of all or part of proposed surface-water or groundwater use when specific conditions are satisfied. A suitable permitted reclaimed source must exist; distribution lines must reach the property boundary with enough capacity and suitable quality; the applicant must be able to access the source; reclaimed use must be environmentally, economically and technically feasible; and it must not conflict with discharge-permit requirements. The requirement is conditional, so an applicant must test each condition rather than assume reclaimed water is mandatory or unavailable.

For an application requesting at least 100,000 gallons per day, the statute requires identification of all sources, amounts and losses associated with cooling, industrial and treatment processes, employee needs and irrigation. The application must include a conservation plan covering cooling-water recycling before discharge or disposal, leak detection and repair, efficient fixtures and employee water-conservation education. Covered applications require a hearing. The 100,000-gallon figure is a statutory application threshold for these added submissions; it is not an estimate of typical data-center consumption.

India: environmental clearance depends on classification and area thresholds

In a parliamentary reply posted 6 August 2026, India’s Ministry of Environment, Forest and Climate Change said that an AI data center does not, by itself, require environmental clearance under the EIA Notification, 2006, as amended. Clearance is required when the project is proposed as a qualifying building-and-construction project with built-up area exceeding 20,000 square metres, or as a township and area-development project covering at least 50 hectares and/or having built-up area of at least 150,000 square metres. For the building-project category described, the stated authority is the State Environment Impact Assessment Authority. See the 6 August 2026 Ministry reply.

Where that clearance process applies, appraisal considers freshwater availability, with particular attention to water-stressed regions, water-balance reports, greywater generation, and greywater recycling and reuse. The reply also describes water-use and discharge controls, state pollution-control monitoring, groundwater-extraction guidelines and Bureau of Energy Efficiency district-cooling guidance that recommends treated water as cooling-tower make-up wherever feasible. The clearance trigger is tied to project classification and thresholds; groundwater and discharge controls can arise through separate rules even when a project is outside that clearance category.

Virginia: planned scarcity-area criteria and technology demonstrations

Virginia’s 2026 reenrolled budget directs the Department of Environmental Quality to amend local and regional water-supply planning rules by 1 July 2027 to establish criteria for “Cooling Water Scarcity Areas,” with particular attention to the Eastern Virginia Groundwater Management Area. The budget language is available in HB30, Item 366.

For data centers in a designated scarcity area before 1 July 2032, the text calls for a demonstration that cooling-water use is minimized and that the project uses best available water-efficient technology. Examples include air cooling, closed-loop systems, recycled water, stormwater reuse and non-potable reclaimed water. Direct evaporative cooling may be used only alongside an approved primary technology. In the Eastern Virginia Groundwater Management Area, a new data center whose complete DEQ air-permit application is submitted after 1 January 2027 must make the specified demonstration. Because the provision depends on designated areas and implementing rules, applicants should verify the current criteria and the project’s permit dates.

California: information duties and potentially applicant-funded upgrades

A 21 September 2026 announcement from the California Governor’s Office says seven signed bills require proposed data centers to give local governments and water suppliers information about water use, supply, efficiency and drought planning. It also says that any water-supply upgrades needed would be paid for by the data center, and lists AB 2469 and AB 2619 among the signed bills. The announcement is at the Governor’s Office release. An announcement summarizes a legislative package; project teams must consult the enacted bill text and implementation rules before treating a particular disclosure, cost or approval as operative.

North Carolina: a proposal, not an established permit rule

North Carolina Senate Bill 730, Edition 5, contains proposed water-use standards that could require closed-loop or reclaimed-water systems in areas with water-availability concerns. It would also prohibit evaporative cooling for its defined data centers with at least 100 MW of peak monthly electricity demand. The source is bill text. The status established here is proposal text, not confirmed enacted law, so it should not be presented as a current permit condition without checking the legislature’s latest action.

Cooling and water options: compare the whole system

No cooling method is automatically the lowest-impact choice. A sound application compares freshwater consumption, local availability and competing demand, reclaimed-water quality and capacity, capital and operating cost, energy use, discharge limits, weather reliability and the exact wording of the applicable permit or rule.

Approach Potential water benefit Important limitations to document
Air cooling Can reduce or avoid routine cooling-tower water use. Performance and energy demand vary with outdoor temperature and humidity; equipment and reliability design still matter.
Closed-loop cooling Recirculates coolant and can sharply reduce ongoing make-up water. It is not necessarily zero-water for the facility; heat rejection, treatment, maintenance, staff use and other systems may still consume water.
Reclaimed or recycled water Substitutes non-potable supply for potable or fresh surface-water withdrawals where quality and volume are adequate. Requires a permitted source, physical connection, capacity, treatment compatibility and economic and technical feasibility; discharge rules can limit use.
Stormwater reuse Uses captured precipitation for suitable non-potable demands. Availability is seasonal and storage, treatment, permits and reliability during drought must be demonstrated.
Direct liquid cooling Moves heat from IT equipment into a recirculating liquid loop. The heat may still be rejected through a cooling tower, so the facility’s final heat-rejection design determines water use.
Reverse osmosis on cooling-tower blowdown Can recover water for reuse as cooling-tower make-up and reduce freshwater demand. DOE cautions that RO adds energy use and operating cost and can worsen overall power usage effectiveness.

The U.S. Department of Energy’s Federal Energy Management Program explains that cooling-tower use depends on facility heat load and cooling-system efficiency. Its water-use effectiveness (WUE) metric is annual site water use in liters divided by annual IT-equipment energy use in kilowatt-hours. WUE is useful for comparing site performance, but it is not itself a permit standard and does not capture every effect on a stressed watershed. DOE’s guidance is available in Cooling Water Efficiency Opportunities for Federal Data Centers.

How to build an approvable water case

  1. Map the approvals before selecting a site. Identify the water supplier, groundwater or surface-water authority, wastewater and discharge regulator, stormwater agency, air-permit authority, environmental-clearance authority and local zoning body. Record whether each approval is issued by a state, regional or local entity.
  2. Define demand under normal and stressed conditions. Quantify peak-day and annual withdrawals, cooling make-up, blowdown, treatment losses, employee use, irrigation, construction demand and emergency operations. Show how demand changes with IT load, weather and drought restrictions.
  3. Prove the source. Provide permits, supplier commitments, hydraulic capacity, water-quality specifications and drought-reliability information. For groundwater, address extraction limits and aquifer effects; for surface water, address seasonal availability and competing legal users.
  4. Compare feasible cooling designs. Evaluate air cooling, closed-loop, direct liquid, reclaimed, recycled and stormwater options using water, energy, cost, reliability and discharge criteria. Do not label a system “waterless” unless the entire facility water balance supports that description.
  5. Test reclaimed-water conditions. Confirm that a permitted source and distribution line reach the property with adequate capacity and quality, that the project can connect, and that use is environmentally, economically and technically feasible without violating discharge conditions.
  6. Prepare the conservation and reuse plan. Include recycling before discharge or disposal where required, leak detection and repair, efficient fixtures, treatment controls, employee practices, greywater or stormwater reuse, and measurable performance targets.
  7. Analyze cumulative and community effects. Explain interaction with other withdrawals, public-system reliability, aquifers, streams, drought plans and sensitive resources. Provide the information needed for any public disclosure or hearing.
  8. Track legal status and dates. Separate enacted statutes, executive directions, agency guidance, reenrolled budget language, signed-bill announcements and proposals. Recheck thresholds, designated areas, implementing rules and permit-submission dates immediately before filing.

Questions agencies and communities commonly ask

Is a large electrical load automatically a water permit trigger?

No. The cited jurisdictions use different triggers: Florida’s added disclosure and conservation provisions use a request for at least 100,000 gallons per day; India’s environmental-clearance examples use building and township area classifications; Virginia’s proposed demonstrations depend on scarcity-area designation and specific permit timing; and North Carolina’s 100 MW figure appears in a bill proposal. Electrical capacity, building area and water demand are not interchangeable thresholds.

Does closed-loop cooling eliminate a project’s water impact?

No. A recirculating loop can reduce make-up water, but heat may still be rejected through a cooling tower and the site can consume water for treatment, blowdown, staff needs, irrigation and other systems. Regulators assess the complete facility balance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When can reclaimed water be required?

Florida’s 2026 statute provides a conditional requirement when a suitable permitted source and capable distribution line exist, the applicant can access them, use is feasible and discharge requirements are not conflicted. Other jurisdictions may encourage or evaluate reclaimed water without imposing the same test. The site-specific rule and infrastructure determine the result.

What should residents verify in a project announcement?

Check the actual permit application, water supplier commitment, source and loss calculations, drought assumptions, cooling design, discharge route, cumulative-impact analysis, hearing notices and the legal status of any cited bill or policy. A press release or proposal may describe policy direction without creating an immediately enforceable permit condition.
