In the United States, vaccine-injury claims do not all use one system. Most routinely used, federally covered vaccines are handled through the National Vaccine Injury Compensation Program (VICP), a no-fault program that requires a petition in the U.S. Court of Federal Claims. Claims involving COVID-19 vaccines generally go to the separate Countermeasures Injury Compensation Program (CICP), which uses an administrative Request for Benefits and a one-year filing period.
Coverage, injury definitions, severity thresholds, evidence requirements and deadlines are different under each program. The program that applies to the product, the date of vaccination and the injury determines what you must prove and where you file.

Start by identifying the correct program
Do not begin with a generic vaccine-injury form. First identify whether the product is a VICP-covered vaccine or a CICP-covered countermeasure. The two programs have different eligibility tests, filing routes and deadlines.
| Issue | VICP | CICP |
|---|---|---|
| Typical products | Vaccines routinely administered in the United States that meet statutory coverage conditions, such as many childhood, pregnancy and seasonal vaccines. | Eligible countermeasures used against a public-health emergency or security threat, including some vaccines, medications, devices or other designated products. COVID-19 vaccine claims generally use this program. |
| How a claim starts | A legal petition filed with the U.S. Court of Federal Claims, followed by a copy sent to the Health Resources and Services Administration (HRSA). | A Request for Benefits Package submitted to the Countermeasures Injury Compensation Program. |
| General filing period | For an injury, three years from the first symptom or manifestation of onset or significant aggravation. Death claims generally have a two-year period from death and a four-year period from the first symptom or manifestation of the injury that led to death. | One year from receiving or using the countermeasure alleged to have caused the injury. |
| Evidence framework | The Vaccine Injury Table can provide a presumption of causation when its injury definition and timing requirements are met. Non-Table injuries generally require proof that the vaccine caused them. | Eligibility depends on the applicable countermeasure and covered-injury criteria; the process requires proof of administration or use and supporting medical records. |
| Decision route | HHS medical review, a Department of Justice report and a decision by a court-appointed special master, with appeal rights under applicable rules. | Administrative review by CICP, rather than a VICP special-master proceeding. |
| Potential benefits | Depending on the facts and legal limits, medical expenses, lost wages, reasonable legal costs, pain and suffering, and a death benefit. | Unreimbursed medical expenses, lost employment income and a survivor death benefit when program requirements are met. |
HRSA’s official description calls VICP “a no-fault alternative to the traditional legal system for resolving vaccine injury petitions.” No-fault means you do not have to prove negligence by a manufacturer or provider, not that every post-vaccination illness qualifies or that compensation is automatic.

What VICP covers
Covered vaccine categories
VICP generally covers vaccines recommended by the Centers for Disease Control and Prevention for routine administration to children or pregnant women, subject to federal excise-tax and other statutory requirements and formal addition to the program. HRSA’s covered-vaccine categories include diphtheria, Haemophilus influenzae type b (Hib), hepatitis A and B, human papillomavirus, seasonal influenza, measles, mumps, meningococcal, pertussis, pneumococcal conjugate, polio, rotavirus, rubella, tetanus and varicella.
Coverage is product-specific. Check the current formulation and the current HRSA coverage information before filing. HRSA identifies exceptions and distinctions that can change the answer, including non-seasonal influenza vaccines, pneumococcal polysaccharide vaccines and shingles vaccines, as well as differences among meningococcal formulations. A vaccine in a familiar category is not automatically covered merely because it was given in a clinic.
Administration outside the label or contrary to a recommendation does not, by itself, eliminate a claim for an otherwise covered vaccine. The vaccine must still be covered, and the injury and filing requirements still apply.
Injuries on the Vaccine Injury Table
The Vaccine Injury Table lists specified injuries or conditions and the periods in which they must begin. If the injury meets the Table’s definition and timing, causation is presumed unless another cause is established. This can reduce the need to prove medical causation, but it does not remove the need to document the diagnosis, onset and required severity.
A petitioner can also allege significant aggravation of a pre-existing condition. That means the vaccination substantially worsened an existing condition in a way that satisfies the program’s legal and medical standards; merely having symptoms after vaccination is not enough.
Injuries not listed on the Table
An injury outside the Table may still be claimable. HRSA says the petitioner generally must show that the vaccine caused the injury. Medical records, a coherent timeline, treating-provider opinions and other admissible evidence may be important because the Table’s causation presumption is unavailable.
Severity threshold
VICP has a threshold injury requirement. The covered injury must have:

- lasted more than six months after vaccination;
- resulted in inpatient hospitalization and surgical intervention; or
- resulted in death.
These are filing thresholds, not a finding that the petitioner will ultimately receive an award. A short-lived reaction that does not meet one of these conditions generally cannot proceed as a compensable VICP injury.
Who may file and where vaccination must occur
The vaccine recipient may petition regardless of age or U.S. citizenship. A parent or legal guardian may file for a child or an adult who is legally disabled, and an authorized estate representative may file in a death case.
Ordinarily, administration must have occurred in the United States or its territories. Exceptions can apply to certain U.S. government or military service abroad and to some people who return to the United States within six months when the manufacturer was located in the United States. Confirm the exception rather than assuming any overseas vaccination qualifies.
VICP deadlines and special timing rules
Deadlines are jurisdictionally important. HRSA’s 2026 guidance states that an injury petition generally must be filed within three years after the first symptom or manifestation of onset or significant aggravation. In a death case, filing is generally required within two years after death and within four years after the first symptom or manifestation of the injury from which the death resulted.
The relevant date is not necessarily the vaccination date. Organize evidence showing when the first symptom appeared, when a condition was medically recognized and, for significant aggravation, when the worsening manifested.
Congressional or regulatory changes to the Vaccine Injury Table can create a limited alternative period. When a revision newly enables or materially improves eligibility, the rules can allow a two-year filing period for injuries or deaths occurring up to eight years before the change. The exact revision and statutory conditions control.
HRSA also notes that the court may apply equitable tolling in very limited circumstances. Treat this as a narrow judicial possibility, not a routine extension. If a deadline may be close or has passed, obtain prompt advice from a qualified attorney or the Court of Federal Claims’ Office of Special Masters rather than waiting for an exception.

How to file a VICP petition
- Confirm the product and program. Identify the exact vaccine name, formulation, manufacturer if known, date and location of administration. Verify current VICP coverage and whether the injury is on the current Vaccine Injury Table.
- Build the medical timeline. Record the first symptom, every major change, diagnoses, hospitalizations, procedures, treatment dates and any pre-existing condition that was significantly aggravated.
- Collect records and proof. Obtain the vaccination record, clinical notes, hospital charts, test results, bills, employment or wage records and documentation of functional limitations. Request records from every relevant provider early; record requests can take time.
- Prepare the legal petition. HRSA describes the petition as a legal document. It should identify the recipient, vaccine, alleged injury, onset or aggravation date, severity threshold and supporting facts in the format required by the court.
- File with the U.S. Court of Federal Claims. Follow the court’s current Office of Special Masters instructions, include the required cover sheet and supporting documentation, and pay the applicable filing fee unless a court rule provides otherwise.
- Send HRSA a copy. After filing with the court, provide HRSA with a copy electronically through its Injury Compensation Programs website or by mail, using the method and address in the current filing instructions.
- Track the docket and requests. Respond to orders, requests for records and medical questions by their stated dates. Keep copies of everything submitted and proof of delivery.
An attorney is not mandatory. HRSA points petitioners to the Office of Special Masters for detailed submission information, sample filings and an attorney-referral list. The court generally awards reasonable attorneys’ fees and other legal costs when a petition is reasonable and filed in good faith, subject to the governing law and the court’s determination.

After filing, HHS medical staff reviews whether the medical criteria appear to be met and makes a preliminary recommendation. The Department of Justice prepares a report that combines the medical recommendation with legal analysis. A court-appointed special master then decides whether compensation is appropriate, sometimes after a hearing where evidence and expert opinions are considered.
If the special master awards compensation, the decision specifies the amount and type of payment, and the court orders HHS to pay. A decision may be appealed under the applicable court rules. A petitioner who rejects a decision or withdraws may, in some circumstances and within statutory timing limits, pursue a civil action against the manufacturer or administrator. Those choices can affect legal rights, so they should be evaluated before accepting, rejecting or withdrawing.
What VICP may pay
Payment depends on documented losses and the legal limits applicable to the case. Categories can include medical care, lost wages, reasonable attorneys’ fees, pain and suffering and a death benefit.
HRSA’s December 29, 2025 presentation lists a pain-and-suffering amount of up to $250,000 and a $250,000 death benefit. Those figures describe statutory categories in that presentation, not guaranteed awards. Individual compensation remains dependent on eligibility, proof, offsets and other legal restrictions; the amounts should be checked against current law when a claim is prepared.
How CICP claims for COVID-19 vaccines work
When CICP is the route
HRSA directs claims associated with COVID-19 vaccines and other COVID-19-related countermeasures to CICP rather than VICP. CICP can cover eligible serious injuries or deaths resulting from administration or use of designated countermeasures used against a public-health emergency or security threat. Depending on the declaration and coverage in effect, a countermeasure can be a vaccine, medication, device or other specified item.
Do not describe a COVID-19 vaccine as VICP-covered simply because other influenza or childhood vaccines are covered there. The exact product and the applicable countermeasure declaration matter.

Filing period and required proof
A CICP Request for Benefits Package generally must be filed within one year of receiving or using the countermeasure alleged to have caused the injury. Proof of administration or use is required, so retain the vaccination record, pharmacy or clinic documentation and any government or employer record showing the product and date.
The package includes a Request for Benefits form, health-information authorization forms, proof of use and medical records from relevant care, including records documenting pre-existing history. A separate authorization is required for each treating provider.
Submitting the package
- Download the current CICP Request for Benefits materials and confirm that the countermeasure and alleged injury fall within the applicable coverage.
- Complete the claimant information, countermeasure details, injury description and provider authorizations.
- Request complete records from every relevant provider, including records before vaccination when they help establish baseline health.
- Submit the package electronically or by mail using CICP’s current instructions.
- Do not send a package or letter of intent by email or fax; HRSA specifically says those methods are not accepted for CICP submissions.
- Confirm that CICP has received a complete package and promptly answer follow-up requests.
The claimant is responsible for ensuring that CICP receives the medical records. HRSA says CICP does not obtain records directly from providers or pay the provider’s record-production charges. Eligibility review begins only after the package is complete.
CICP benefits
When the program’s criteria are met, benefits may include unreimbursed medical expenses, lost employment income and a survivor death benefit. CICP is not the same as a VICP award: it uses its own covered-injury rules, documentation standards and administrative review.
CICP’s process page also describes a limited alternative deadline connected to an amendment to a Covered Countermeasure Injury Table. Because the amendment, covered countermeasure and injury dates control, use the current CICP instructions for that exception rather than assuming it applies.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Special situation: receiving products covered by both programs
HRSA explains that a person who received both a VICP-covered seasonal influenza vaccine and a CICP-covered countermeasure, such as the 2009 H1N1 vaccine, may file in either or both programs. Filing in both does not guarantee eligibility or payment in either program. The countermeasure, injury, timing and evidence must be evaluated under each program’s rules, and overlapping compensation restrictions may matter.

Common mistakes that can derail a claim
Using the wrong program
Submitting a COVID-19 vaccine injury as a VICP petition, or treating a routine vaccine as a CICP claim, can waste the period in which the correct filing must be made. Identify the program before assembling the application.
Best Value
Counting from the wrong date
VICP injury timing generally runs from the first symptom or manifestation, while CICP’s ordinary period runs from countermeasure administration or use. Death cases have their own VICP timing rules. A vaccination date alone may not answer the deadline question.
Assuming a Table entry guarantees payment
A Table listing helps only when the injury matches the legal definition and timing and the claimant satisfies the severity and other requirements. A listed condition is not an automatic award.
Submitting incomplete records
Missing vaccination proof, provider authorizations, pre-existing-history records or wage documentation can delay review and create avoidable disputes. Request records before the filing date and maintain a document index.
Do these 3 things before closing this tab:

Equitable tolling and Table-change provisions are limited. They should not be treated as a strategy for filing late. If a deadline is approaching, file and seek qualified advice under the applicable rules rather than relying on a speculative exception.
Where to get authoritative help
Use the current HRSA VICP and CICP pages for covered-vaccine lists, the Vaccine Injury Table, forms, addresses and submission instructions. For a VICP petition, consult the U.S. Court of Federal Claims and its Office of Special Masters for current procedural requirements and sample filings. A lawyer experienced with vaccine-injury petitions can help analyze causation, deadlines, records and the consequences of accepting or rejecting a decision, but legal representation is not a prerequisite to filing.
Program pages can change, and HRSA states that its website reflects the Department of Health and Human Services’ current thinking and does not bind the Department or the public. Recheck the current table, forms, deadlines and governing law before submitting a particular claim.
