There is no blanket U.S. ban on every chip or piece of data-center equipment going to Asia. The result for a proposed shipment depends on the item’s technical classification, the route and destination, the purchaser and ultimate parent, the intended use, restricted-party status, and whether a U.S. license or valid exception applies under the Export Administration Regulations (EAR).
That means a server installed in Singapore, a Chinese-owned company buying through an overseas subsidiary, and a semiconductor tool shipped to a foreign-owned fab in China can all produce different legal outcomes. The Bureau of Industry and Security (BIS) has also changed several policies during 2025 and 2026, so an old assumption about “Asia” or “China” can be dangerously incomplete.

The basic rule: controls follow the item and transaction, not a map label
The EAR, administered by the U.S. Department of Commerce’s BIS, is the main U.S. export-control framework for advanced-computing chips, semiconductor-manufacturing equipment, related software and technology, and many associated transactions.

Foreign manufacture does not automatically place a product outside U.S. jurisdiction. Foreign-produced items can become subject to the EAR under foreign-direct-product (FDP) rules when the required technical, destination, or end-user conditions are met. A non-U.S. company therefore cannot assume that buying outside the United States removes U.S. controls.
The relevant transaction may be more than a physical export. Reexport, an in-country transfer, a release of software or technology, remote access to a software key, installation, servicing, and certain technical-support activities can each require separate analysis.
- Item: exact part number, specifications, performance, ECCN, and EAR status.
- Route: every country through which the item travels, is installed, or is transferred.
- Parties: purchaser, consignee, operator, end user, parent company, owners, and intermediaries.
- Purpose: ordinary data-center operation versus chip design, training, production, or another controlled end use.
- Authorization: a specific license, license exception, conditions, and recordkeeping requirements.
Because these elements interact, a product description such as “AI accelerator” or “semiconductor tool” is not enough to determine the outcome.
Why a company’s headquarters can matter when its data center is elsewhere
BIS guidance issued on May 31, 2026 addresses advanced-computing exports to entities headquartered in Country Group D:5 or Macau. It states that a license is required for covered exports to a D:5- or Macau-headquartered entity, including an entity whose ultimate parent is headquartered there, even when the receiving facility is located outside those places.
This is important for multinational operators. A data center in Singapore, Malaysia, Japan, Taiwan, or another Asian location does not by itself settle the licensing question if the customer or its ultimate parent falls within the guidance. Compliance teams must document the ownership chain and headquarters location rather than checking only the shipping address.

The same guidance says bona fide data-center operators that are otherwise acting consistently with the EAR do not have to stop ongoing use, storage, disposal, or servicing of advanced-computing items solely because of the guidance, unless BIS says otherwise. That statement concerns existing lawful operations; it is not blanket permission for new shipments, transfers, capacity expansion, or technology upgrades.
Can a U.S. company sell advanced AI chips to China?
For China-bound Nvidia H200, AMD MI325X, and similar products, BIS announced on January 13, 2026 that applications would be reviewed case by case under specified safeguards. This is a licensing policy, not an automatic approval route.

BIS said an applicant must demonstrate all of the following:
- the export will not reduce semiconductor production capacity currently available to U.S. customers;
- the Chinese purchaser has export-compliance procedures, including customer screening; and
- the product underwent independent third-party testing in the United States.
Even when an application meets those stated elements, BIS can request more information, impose conditions, or deny the application. Filing an application, receiving a case number, or relying on a distributor’s statement is not authorization to ship.
The chip’s technical classification, the buyer’s identity and ownership, the data-center use, the route, and any applicable Entity List or other party-based restriction still have to be assessed. A different model or configuration can produce a different result, so a decision on one accelerator cannot be generalized to an entire product family.

Does a Singapore or Malaysia data center avoid U.S. controls?
No. Physical location is only one factor. A proposed installation should be evaluated as a complete transaction:
| Question | Why it matters | What to document |
|---|---|---|
| Where is the item shipped and installed? | Destination and routing rules can differ, including for reexports and in-country transfers. | Commercial invoices, shipping route, installation site, and transfer records. |
| Who buys and operates it? | The purchaser, ultimate consignee, operator, and end user may be different legal entities. | Contracts, organization charts, beneficial-ownership information, and end-use statements. |
| Where is the ultimate parent headquartered? | BIS’s May 31, 2026 guidance covers certain D:5- or Macau-headquartered entities even when the facility is elsewhere. | Current parent-company headquarters and control documentation. |
| What will the system do? | Data-center operation, chip development, manufacturing, and other end uses can trigger different rules. | Technical description, deployment plan, workloads, and customer-use controls. |
| Is a party restricted? | Entity List and other party-based controls can change licensing requirements or prohibit transactions. | Screening results taken at onboarding, order, shipment, and other required points. |
| What authorization covers the transaction? | A license exception or license may have conditions, quantity limits, recordkeeping duties, or reporting requirements. | License number or exception analysis, conditions, internal approvals, and records. |
For a Chinese-owned group using an overseas subsidiary, the subsidiary’s incorporation country is therefore not the only relevant fact. The ownership chain, ultimate parent, end user, and actual use must be established before the order is accepted.
What equipment is restricted?
BIS controls specified semiconductor-manufacturing equipment and associated software and technology for covered destinations and end uses. The controls can affect tools used to produce advanced-node chips, as well as technical data, software, components, and support connected with those tools.
FDP provisions can extend U.S. jurisdiction to certain foreign-produced equipment or components when the rule’s technical and destination or end-user conditions are met. A tool made in Europe or Asia is not automatically outside the EAR merely because it was not manufactured in the United States.
Data-center operators should distinguish between equipment used to run workloads and equipment used to design or manufacture semiconductors. A server installation and a wafer-fabrication tool do not receive the same analysis, but both can involve controlled chips, software, technology releases, servicing, and restricted parties. The exact model, specifications, ECCN, destination, and use must be checked against the current EAR; a broad category label is insufficient.

What changed for foreign-owned semiconductor fabs in China?
On August 29, 2025, BIS announced that foreign-owned semiconductor fabs in China could no longer use the prior Validated End-User (VEU) license-free route for most U.S.-origin items. BIS said former participants had 120 days after publication to apply for licenses.
BIS stated that its policy was to authorize existing-fab operations but not capacity expansion or technology upgrades. That announcement describes the agency’s policy direction; it does not establish that every fab received authorization or that every item is covered. A fab must verify its current license scope, conditions, expiration dates, and the status of each item before importing, transferring, servicing, or upgrading equipment.

Chip controls operate through the supply chain, not only at the final sale. A January 2025 BIS update added due-diligence obligations and structured routes involving approved or authorized integrated-circuit designers. In certain fabrication and packaging situations, parties may need to verify transistor counts and maintain evidence supporting the transaction.
Screening should cover the immediate buyer as well as the consignee, end user, parent, owners, design house, foundry, packaging provider, logistics company, and service contractor. Entity List designations create party-specific licensing consequences that can apply even when the physical destination appears permissible.
BIS’s December 2024 action described 140 Entity List additions and 14 modifications. Its January 2025 action reported 16 additions. Those are dated figures for those particular actions, not the current total number of listed entities. Lists and entries can change, so screening must be current at the time of the transaction.

A practical review workflow before shipment or installation
- Freeze the exact configuration. Record manufacturer, model, firmware, memory, interconnect, performance characteristics, accessories, and software versions. Substituting a “similar” part can change the classification.
- Determine EAR jurisdiction and ECCN. Obtain the manufacturer’s classification where available, validate it against the current EAR, and assess whether an FDP rule captures a foreign-produced item.
- Map the transaction. Identify whether it is an export, reexport, in-country transfer, technology or software release, installation, service call, or remote-access arrangement.
- Map every location. Record shipping origin, transit points, installation site, storage site, and any planned transfer to another facility.
- Identify every party and parent. Verify purchaser, ultimate consignee, operator, end user, beneficial owners, control relationships, and ultimate-parent headquarters.
- Describe the real end use. Separate ordinary data-center workloads from chip design, model development, semiconductor production, or other controlled activities. Obtain a detailed end-use statement rather than a generic purchase description.
- Screen and document. Check the Entity List and other applicable restricted-party lists at the required stages, investigate matches, and preserve evidence of the review.
- Select authorization. Determine whether a specific license, license exception, or other authorization applies. Read all conditions and limits; do not treat a pending application or informal assurance as permission to ship.
- Control changes after approval. Recheck before changing the model, customer, route, site, workload, ownership, service provider, or software access. A transaction that was lawful at order time can become noncompliant after a material change.
Common mistakes and how to correct them
“The data center is outside China, so the China rules do not matter.”
Correct the analysis by checking the customer’s ultimate parent and headquarters, especially under the May 31, 2026 guidance. Also review the actual route, end user, and transfer plans.
“A license-review policy means the shipment is approved.”
It does not. The January 2026 H200 and MI325X policy is case-by-case review. Ship only after receiving the required authorization and confirming its conditions.
“The equipment was made outside the United States.”
Apply the EAR’s jurisdiction and FDP analysis. Foreign production alone does not answer either question.
Recommended Free Tools
“We screened the reseller, so the chain is cleared.”
Screen the ultimate consignee, end user, parent, owners, designers, foundry, packaging firm, and relevant service parties. Investigate ownership and control, not just names in the purchase order.
“Existing use and new expansion are the same.”
BIS’s May 2026 guidance distinguishes ongoing use, storage, disposal, and servicing from new shipments and expansion. The August 2025 fab policy likewise distinguishes existing operations from capacity expansion and technology upgrades.
“The old VEU status still covers every item.”
Foreign-owned fabs in China must verify the post-August 2025 authorization framework and the current scope of each license. Do not rely on historical VEU participation.
Key dates to keep in the compliance file
| Date | Development | Practical significance |
|---|---|---|
| December 31, 2026 | BIS timeline for certain Approved IC Designer applications and processing. | Relevant applicants should track the stated deadline and any subsequent rule changes. |
| May 31, 2026 | Guidance on advanced-computing licenses for D:5- or Macau-headquartered entities. | Parent headquarters can matter even when the facility is elsewhere; ongoing lawful use is addressed separately from new supply. |
| January 13, 2026 | Case-by-case review announcement for H200, MI325X, and similar chips. | Applicants must show supply-capacity safeguards, purchaser compliance and screening, and independent U.S. testing; approval is not automatic. |
| August 29, 2025 | VEU change for foreign-owned fabs in China. | The prior license-free route was ended for most U.S.-origin items, with stated intent to support existing operations rather than expansion or upgrades. |
| January 2025 and December 2024 | BIS due-diligence and Entity List actions. | Supply-chain screening and documentation must reflect current entries, not historical totals. |
BIS and the EAR can change classifications, thresholds, country treatment, exceptions, list entries, and licensing policies. Before committing a transaction, confirm the live rule text and obtain advice from qualified export-control counsel for the specific item and parties.
